September 21,2015Dear *** ***:In regard to the recent complaint sent to your office by *** *** (ID #***), please note the following response.*** *** did indeed purchase a mattress and box spring from C & Furniture on September 2, and accepted delivery on
the same date, *** *** did sample the mattress in the showroom prior to purchase and delivery and noted its comfort also stating, "I could stay here on this mattress all day" and this model was within his budget, In addition, *** *** signed the C & Purchase agreement which notes 'All Sales Final' and agreed to the termsThe Manufacturer warranty for the *** mattress does not cover 'comfort', a reason whyC & O has the *** mattresses on display for customer testing and approval prior to purchase.Pennsylvania Department of Labor and Industry (Act No, 249} prohibits the return and resale of used mattresses without a significant and thorough sterilization process that C & O Furniture does not have the capacity to doThis was explained to *** *** when he called asking for a new mattress because he no longer liked his choiceAgain, he was also reminded of the 'All Sales-Final' agreement and that the manufacturer's guarantee and C & O Furniture policy does not cover 'comfort' as a reason for mattress return or repair.As an act of good business faith, an offer was made to replace,the mattress only at an additional charge (to offset the disposal of the used mattress)The box spring ddes not affect the comfort of the mattress and once again cannot be resold and must be disposed; causing a significant loss of revenue*** *** agreed to a new mattress and returned to C & O Furniture to test and approve a new mattressHe once again tried various models and decided on a mattress (more expensive than original purchase)

I am rejecting this response because : Nothing was explained to me concerning [ the comfort ] guarantee that is mentioned in the response nor that all sales were final. Also, he never said that I would be getting a mattress only. If I was informed about the above mentioned clauses I would have had second thoughts about purchasing the mattress and box spring. On my sales order front of copy, it says nothing about " all sales are final, and nothing about a comfort guarantee." I was never shown the back of the sales agreement nor was anything mentioned.  I feel cheated and that C & O used a deceptive sales technique to make the sale. I still want the matching box spring and without any further expense on my part.

October 2, 2015Dear [redacted]:In regard to the recent complaint response sent to your office by [redacted] (ID #[redacted]), please note the following response,Once again, [redacted] came to C & O Furniture to purchase a new mattress and box spring. He noted he was in immediate need for a new set as his bed was taken by his sister-in-law and he needed a 'place to sleep'. He had a budget of $400.00. He sampled the mattresses and decided on a set, stating to my saleswoman; "It's perfect, I could stay here all day." The purchase transaction continued. [redacted] signed the sales agreement, which clearly notes "All Sales Final" and is once again attached for your perusal. No 'deceptive sales technique' or 'cheating' occurred on the part of the saleswoman or C & O Furniture. The same complete transparency was undertaken with [redacted] as with all C & O customers. [redacted] was pleased with the purchase and wanted delivery immediately. C&O delivered the set after hours to accommodate [redacted]'s immediate need.[redacted] called the store noting his poor night's sleep' and wanted a new mattress. As was already explained in our original response, [redacted] was told "all sales final", C & O and [redacted] mattress do not have 'comfort guarantees, and 'mattresses could not be resold according to PA law'. In good business, C & O President reluctantly agreed to replace the mattress only with a fee to cover disposal. [redacted] agreed and came to the store to once again try out sample mattresses. [redacted] decided on a mattress. Once again, the boxspring does not alter comfort, therefore with no need to replace. As noted in the previous correspondence, a $20.00 fee was charged for the new mattress to cover made regarding the boxspring at that time.In no way was [redacted] 'cheated' or given a 'deceptive' sales technique. C& Q Furniture has sold many mattress sets since [redacted]'s purchase, again without issue or concern.C & O Furniture has attempted in good faith to fix the issue with [redacted] by replacing the mattress to improve his comfort even though it is the policy of the store not to do so. The boxspring does not alter the comfort of the mattress.In addition, his rants on social media do nothing but raise the issue of slander.If you have any further questions, please do not hesitate to contact me.Andrew Y.President
