We had an agreement with our lender, C & R Mortgage, that we would receive a $5,500 credit at closing to cover closing costs. When we received the first, and what we thought was the final, HUD-1, the $5,500 credit was not listed. When we questioned this, we were instructed that a check would be cut after closing. We did not feel comfortable with that and asked them to submit a new HUD-1 with the credit listed. At the last minute during the day of closing, 08/22/2013, a new HUD-1 was submitted with the $5,500 credit listed but also a $7,128 charge on line 803 - Adjusted Origination Charges. We had no idea where this charge came from as it was not disclosed to us at any time during the loan application process (e.g., [redacted] Truth in Lending, etc). When we attempted to contact our main point of contact and C & R Mortgage owner, [redacted], was nowhere to be found. His assistant stated that the dollar amount included 2-points being charged to us. Again, we did not agree to pay points, nor was this disclosed to us in any documents. The assistant would not provide us any additional information and stated we would need to bring up the matter with Mr. [redacted]. We determined on our own that the $7,128 charge was $6,284 (2-points) plus $744, the original origination charge that was disclosed to us and we expected to pay. We had to close on the home that day or possibly lose it, so in good faith that the charge was an error and would be corrected, we closed.
The following day, Mr. [redacted] stated that the charge was in fact an error. He stated both on the phone and email that he would send us a check for $6,384 to cover the overcharge. When we received the check in the mail, a letter was included in which Mr. [redacted] deducted the following funds: $675 "processing fee" and $225 "funding fee". The total check we received was in the amount of $5,484. As neither of these two charges were disclosed on the GFE or at any point during the loan process we asked Mr. [redacted] what the charges were as we never agreed to pay them. Mr. [redacted] stated that the $675 was not a processing fee, but the "lenders fee" and the $225 was a "Goldome fee". Again, these two fees were never disclosed to us at any point during the loan process.
We have tried on two occasions to reach Mr. [redacted] by email to rectify this issue. We explained that he cannot charge us fees after the fact without disclosing those fees to us. This is why there are regulations to protect consumers against this exact issue. He has failed to respond to any attempts to resolve the matter. We feel that that Mr. [redacted] had no right to charge us these fees as he never disclosed them. Had he disclosed them, we would have went with a different lender because no other lender had these types of fees disclosed on their GFE's. We feel that Mr. [redacted] owes us $900 and are further concerned that if he did this to us, what's to say that he has not done this to other individuals.
