C S Levitetz Yachts

[redacted], owner of San Diego Yacht Sales, acting as Broker and seller, contracted to sell me an O'day 37 Sailboat. I signed purchase contract on 11/28/2012, subject to personal inspection, sea trial, and survey. I canceled the sale via phone call to [redacted], on 12/07/2012.On 12/11/2012, I e mailed [redacted], requesting the return of my $2250.00 deposit, which is due me per contract, page 2, item 4. [redacted] e mailed me on 12/13/2012, refusing to refund deposit, claiming he went ahead with survey, haul out, sea trial. I didn't order these. He had four days to cancel them He also claims he lost two buyers, and incurred marketing expenses. California Yacht Brokers Association standard contract calls for refund if buyer does not sign final approval. I did not. I never even saw the boat.
