Mr*** had numerous opportunities to view the agreement As you can see from the attachments several emails were sent to Mr*** in discussions of the work to be performed In the pdf #*** emailed 1/5/at 1:PM it clearly states that a deposit would be required and that the terms and conditions, agreement, and limited warranty were clearly listed If Mr *** did not want to agree to the terms he would not have given a deposit and would not have permitted us into his home to perform the work.In addition, in the letter attached labeled dissatisfied letter, Mr*** refers in paragraph to conversations that we had over the phone He was well aware of the fact before the job was even started that no permit was pulled and that it was my understanding that no permit was needed because we were not adding load to the circuits I had mentioned to him in the phone call about the use of "LBs" and that it would not be permissible because they would have to be accessible after the foam was applied to the roof Mr*** wanted the "LBs" to be covered over with the foam making the work out of code Even if we perform work that does not require a permit, we must perform the work up to code In this letter he called me a liar or not qualified Both of these statements are false.I am willing to return to finish the patching like I have expressed numerous times Please keep in mind it is a process of applying drywall mud, sanding, finishing, and texturing to match it is not a minute job The garage door is not damaged to the point of being unserviceable and I have a painter that has said that it could be remedied without replacement.I am also willing to settle this claim for $ That is deducting the cost of the painter of your choosing and having him repair the drywall

I am rejecting this response because:
MrElectric has not had a painter come by to look at the
garage doorWe presented the quotes we received and both the painter and the
garage door company have said that the garage door is irreparableIf an
attempt was made to fill the dent with some sort of body filler, it would
eventually fall outThis is due to the constant motion of the garage door, and
the fact that this garage faces the east, so it experiences multiple
temperature changes throughout the dayEventually, the expanding and
contracting of the filler along with the temperature fluctuations would lead to
the failure of any such repairWith our current standing with MrElectric, we
would not feel comfortable allowing them in our house to repair the interior
damage they had causedThe only way to satisfy the damages sustained to our house (garage door and interior damage) would be financial compensation for the appropriate repairs.In addition, sending someone terms and a "contract" via e-mail
in no such way eludes to an agreement of said "contract." In these e-mails they reference, they refer to the documents as either quotes or estimates, and not once as "contracts." The assumption that my
receipt of their e-mail, with their terms included, as an agreement to said terms
is preposterousIf MrElectric wants to reference e-mails sent to me, he
should also refer to where in these said terms and proposals it states that
“verbal understandings and agreements with representatives shall not be binding
unless set forth herein." Taking that into consideration, I would urge him
show where there was written agreement by myselfIn addition, in that same
e-mail there is a portion where it states that the amount due was “$0.00.” I
could point out several other errors within their documents that would render it
untenable as a contract.If you look at the file attached to MrElectrics last
response, which was written before I had gotten estimates to repair said
damages, I had offered to pay him $The paint repair was $900, not
including taxThe garage door replacement was $That brings the total of the two repairs to
$2266.72, including taxIf you remove that from the balance due of $3011.03, you would
arrive at $Since I am a man of my word, I will pay the
first amount I had said of $for full satisfaction of debtNothing
more
