I am rejecting this response because:Your offer is not what we agreed upon in an email sent Nov 18thI want to complete this project very much and am not stallingI have no reasons at all to stall and you are holding up my move into my townhouse My solution to resolve this is to split the cost of the two cabinets up to the amount of $and upon receipt of the cost from your cabinet supplierI am asking the cost of the two cabinets that need to be replaced and not the cost of all the kitchen cabinets. The cabinets to be ordered are: New 15in base and New trash insertNew 9" tray base with dividers3"filler on either side of pantry. Tilt out tray drawer for under sink as ordered and paid for. I have paid the 50% deposit as requested for the granite and have chosen what I wantI am not getting a new granite supplier.The price of the kitchen included granite and complete fabrication and installation with edge of my choice and sink and faucet cut outs. I will pay you 1/of the cost of the cabinets and the balance I owe upon the complete installation of the kitchen as stated aboveYou have long cashed my checks of $3800.00, $3140.00, and $ I want to have this completed and you are stalling If the above resolution is not acceptable then we will go to arbitration. the Revdex.com from one of our clients, *** ***Mrs*** signer contract with us on 8/4/This contract was based on her approval of the design with two other parties witnessing. This was after consultations in house to explain the layout as well as consultations in the kitchenShe had a clear understanding of the scope of work to be done. We have made several changes and accommodations to her design after signing of the contract. Mrs*** went on vacation in August and returned in September hence it was difficult to solidify her changes and order cabinetry. Upon her return from vacation, I did another walk through/ visit at her house to review changes she wanted to makeAfter that meeting we sent her #versions of her kitchen design on 9/10/On 9/15/she met with our Designer *** and *** in our showroom and made more revisions to her design On 9/17/*** sent the client her the final revised design via email for her approvalThese revisions were as follows: Increase the width of the base and wall cabinets to the left of the fridge 3" ( no charge) these cabinets were 18" wide and changed to 21" wide That same day she replied to that email and approved the layout and gave the okay to place the cabinetry order*Please see the attached email correspondences.According to her letter she states the following problems:Problem; Ordered an inch and a inch cabinetMrs *** approved a design with a 12" trash cabinet and a 15" base cabinet to the left of the sink, and a 12" drawer base to the right of the dishwasher. This was approved via email (please see attached email dated 6/2/15)Solution; we can simply add a new wider trash roll out to her 15" cabinet and it can be moved next to the sinkNo new cabinets need to be ordered.Problem; Does not like 6" filler to right of pantry. Mrs*** wanted roll out drawers inside the pantry, the window sill on the adjacent wall prohibited the functionality of the roll outs and sheagreed to the 18" pantry so that the roll outs would be functional Solution: We can install the 3" filler to right of the pantry if she wants the layout this way. Problem;Tilt out tray for sink base not installed.Solution; The job is not complete and was this is a planned item, it is simply not installed yet.Sited Problem;No response/communication:We have stayed in constant contact with her since June, except during her week trip in ***.We've made multiple revisions after the contract was signed, made multiple site visits and meetings in our showroom.Communication was made in person, by phone and multiple emails. Problem; Deposits made vswork completed:Her check was deposited August 4th, the cabinet order was placed August 6th then placed on hold per the customers multiple revisions which first started on August 8thThere were no delays caused by us, the client made revisions after signing contract then went on a week vacation before finalizing design.Payment terms per signed contract are as follows; 50% due upon ordering cabinetry, 40% due upon delivery of cabinets, 10% due upon installationGranite terms are 50% due upon order and 50% due upon granite installationShe has paid on time per standard payment terms on her signed contract. The job has been at a stand still due to customers unwillingness to come to an agreement about the cabinet layoutWe have presented solutions, 1st solution was to purchase the new cabinets the client wants and she would pay the work order2nd solution was to split the cost of a 15" trash insert and install it in her existing 15" base cabinet and keep all the cabinets the same.Problem; Customer states we threw out her faucet: We have an email stating the client will be purchasing a new faucet Sep 29th, When we demo a kitchen, if the customer does not ask the office to keep faucets or certain cabinets they get removed and hauled to the dumpsterShe asked us to keep the garbage disposal and we made notes and made sure it was not thrown awayAfter the demo the customer asked about her faucet, we went out of our way and checked the dumpster, but they were already gone.Problem; Damage to walls:Customer asked for us to quote removing existing tile back splash, we quoted it ways, installing new back splash tile and refinishing the drywall for later tile installationThe customer decided to leave her existing tile as isWhen her job started on 10/12/her back splash was already removed by another contractor unknown to us and the damage to the walls was already done, we had to postpone the cabinet install until she had someone repair the drywall.In summation, we have tried on multiple occasions to accommodate Mrs*** so that she will be happy with her new kitchen. We will continue to try to do this for Mrs*** and would appreciate Revdex.com's assistance in doing so. Our proposed solutions are as follows; I would gladly cover the cost of the new trash can insert for Mrs***. Change the location of the trash base so that it is directly to the left of the sink.Change filler size to right of pantry from 6" to 3". This will require a 3" filler on both sides of the pantry cabinet. Provide tilt out tray for sink base.
