Revdex.com: I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted] For Mr [redacted] to first say it was, “very windy and rainy” and then follow up with, “Beverly's downtown area was not flooded, nor subjected to power outages or 70+ mph winds,” is simply not trueHere is a link to a story of how bad Salem was that day: [redacted] “Causes Major Flooding” Here is another story, which literally says, “Beverly residents advised to stay inside as storm moves through.” [redacted] I complained about this because I paid for the tickets and my wifes sister, [redacted] used her credit card to purchase themI also drove that night and was not only the one who called ahead of time but the one who spoke to both the [redacted] police on the phone and at the bridge entrance on the day of the show When law enforcement is prohibiting travel into the area, there is absolutely no question that conditions in the area DID prevent safe accessFurthermore, a police vehicle, barriers and signs BLOCKING traffic and turning people away, saying it was too unsafe to cross, is in no way, “inaccurate information.” If people who happened to be coming in from the side where they did not have to cross the bridge were able to make it to the show, then people coming from the direction where taking the bridge was necessary, should not be punished To say that, “we received calls from many patrons asking to confirm that the concert was still going on as scheduled”, clearly shows that other people realized how bad the weather was, heard the same warning and/or were more likely than not being stopped from going over the bridgeMy wife has lived in the area her entire life and knows of no other way to get into Beverly from Salem Governor [redacted] appeared on television throughout the day of the concert and clearly stated, “all non-essential personnel are asked to stay off the road.” Not only did he ask this, Beverly Mayor [redacted] made the same request to ALL RESIDENTS OF BEVERLY“With a major nor’easter bearing down on the region, Beverly residents are being advised to stay inside throughout the eveningLate Friday, Beverly Mayor [redacted] issued an important message to residents via robocall.“Please respect the storm, and stay inside tonight,” he said“DPS Commissioner [***] [redacted] reports that the high winds are knocking down trees and live power lines throughout the cityPlease, if you do not absolutely need to travel tonight, stay insideAs long as the high winds keep up, it is dangerous to be outside.”As of p.mFriday, over 160,customers had lost their power statewide due to the storm, [redacted] said.”This is the direct quote from the link I had posted above; here again: [redacted] I am not asking the band to come back and perform for us, I am not asking for anyone to go above and beyond to make us happyBut when we bought these tickets as a Christmas present for their mother, who had looked forward to this show for several months, I would hope we could at least have the money for the cost of the original tickets refunded so that we are able to purchase tickets to something elseWe were LEGALLY and PHYSICALLY unable to attend this show and as such, I feel as though a refund is due in this caseThank you Regards, [redacted]

Dear Revdex.com,We are in receipt of the above complaint Please note that we do not have a record of a ticket purchase by [redacted] , but can confirm that the order number provided matches with a purchase made by another individual We have not heard from the purchaser and are not clear why the purchaser is not the one making this complaint? Also, please note that there is no one by the name [redacted] associated with The Cabot. We wish to respond to the complaint as follows:It was a very windy and rainy day on March 2, and we received calls from many patrons asking to confirm that the concert was still going on as scheduled Everyone we spoke with was informed that the concert would still happen as scheduled, as the band was prepared to perform and conditions in the area did not prevent safe access We monitored the weather news and other emergency resources all day in case a State of Emergency or other action was declared that would prohibit travel to the area No such action was taken by the governor until the next day, March 3, and that did not include a travel ban, but was declared to "allow the deployment of federal and interstate resources, if required..."Approximately people attended the concert the night of March 2, coming from various communities around the state and adjacent states While we understand that one of the two bridges between Salem and Beverly may have been closed at times that evening, the main bridge (Route 1A) remained open for travel Also, there are several routes into downtown Beverly that do not require going over one of these bridges, all of which remained passable (e.gRoute 62, Route and Route 1A from the north)It is unclear why Mr [redacted] ' party did not seek out one of those alternate routesIt also appears that Mr [redacted] received inaccurate information from others that night as the governor did not prohibit travel, Beverly's downtown area was not flooded, nor subjected to power outages or 70+ mph winds, and area businesses operated throughout the evening. We understand Mr [redacted] ' frustration at having missed the concert, which many other patrons attended despite the stormy weather However, each ticket and ticket sales receipt clearly states that ticket purchases are non-refundable and we are unable to honor his request for a refund since the concert was held as scheduled.Sincerely, [redacted] Director of OperationsThe Cabot [redacted] * [redacted]

Thank you for alerting us to this customer complaint. I have spoken to [redacted] on the telephone and resolved the dispute by sending her the full refund, $55, which she requested. The check was mailed this morning, October 9, 2015 and should arrive on Saturday October 10 or Monday October 12...

by US Mail. We believe that the dispute is fully resolved, and the telephone conversation ended with [redacted] saying that she fully supported our nonprofit organization's efforts to save Cabot Theater and that she intends to return to our performing arts center. I have attached a photocopy of the letter and the refund check. Here is alittle more detail on the incident. Ms. [redacted] purchased a front row reserved seat for a [redacted] concert in our venue which took place Friday, September 18. During the first part of the concert, no other audience members were standing near the stage, and its our policy to discourage this activity. Halfway through the concert, the band encouraged people to come to the front and dance, and many audience members immediately went forward, and therefore did block Ms. [redacted] view of the stage. Our security people attempted to clear the area, but there were 70 to 80 people dancing near the front of the stage, and removing them provided impossible, especially in light of the continued encouragement from the band. The day after the concert Ms. [redacted] called the theater, but unfortunately, our manager had been called out of the state due to a death in the family. Because of this unfortunate occurrence, no one was able to to get back to her and send her a refund. After we heard from Revdex.com, we followed up with her to apologize and send her a refund. In the near future, we are installing new seating in this 96 year old theater which removes the open space in the front, and therefore should resolve this problem. Please feel free to call me if you have any questions about the dispute and our ( we believe) successful attempts to resolve it.

Dear Revdex.com,We are in receipt of the above complaint.  Please note that we do not have a record of a ticket purchase by [redacted], but can confirm that the order number provided matches with a purchase made by another individual.  We have not heard from the purchaser...

and are not clear why the purchaser is not the one making this complaint? Also, please note that there is no one by the name [redacted] associated with The Cabot. We wish to respond to the complaint as follows:It was a very windy and rainy day on March 2, and we received calls from many patrons asking to confirm that the concert was still going on as scheduled.  Everyone we spoke with was informed that the concert would still happen as scheduled, as the band was prepared to perform and conditions in the area did not prevent safe access.  We monitored the weather news and other emergency resources all day in case a State of Emergency or other action was declared that would prohibit travel to the area.  No such action was taken by the governor until the next day, March 3, and that did not include a travel ban, but was declared to "allow the deployment of federal and interstate resources, if required..."Approximately 600 people attended the concert the night of March 2, coming from various communities around the state and adjacent states.  While we understand that one of the two bridges between Salem and Beverly may have been closed at times that evening, the main bridge (Route 1A) remained open for travel.  Also, there are several routes into downtown Beverly that do not require going over one of these bridges, all of which remained passable (e.g. Route 62, Route 22 and Route 1A from the north). It is unclear why Mr. [redacted]' party did not seek out one of those alternate routes. It also appears that Mr. [redacted] received inaccurate information from others that night as the governor did not prohibit travel, Beverly's downtown area was not flooded, nor subjected to power outages or 70+ mph winds, and area businesses operated throughout the evening. We understand Mr. [redacted]' frustration at having missed the concert, which many other patrons attended despite the stormy weather.  However, each ticket and ticket sales receipt clearly states that ticket purchases are non-refundable and we are unable to honor his request for a refund since the concert was held as scheduled.Sincerely,[redacted]Director of OperationsThe Cabot[redacted]

For Mr. [redacted] to first say it was, “very windy and rainy” and then follow up with, “Beverly's downtown area was not flooded, nor subjected to power outages or 70+ mph winds,” is simply not true. Here is a link to a story of how bad Salem was that day:[redacted]
“Causes Major Flooding” Here is another story, which literally says, “Beverly residents advised to stay inside as storm moves through.”[redacted] I complained about this because I paid for the tickets and my wifes sister, [redacted] used her credit card to purchase them. I also drove that night and was not only the one who called ahead of time but the one who spoke to both the [redacted] police on the phone and at the bridge entrance on the day of the show.  When law enforcement is prohibiting travel into the area, there is absolutely no question that conditions in the area DID prevent safe access. Furthermore, a police vehicle, barriers and signs BLOCKING traffic and turning people away, saying it was too unsafe to cross, is in no way, “inaccurate information.” If people who happened to be coming in from the side where they did not have to cross the bridge were able to make it to the show, then people coming from the direction where taking the bridge was necessary, should not be punished.  To say that, “we received calls from many patrons asking to confirm that the concert was still going on as scheduled”, clearly shows that other people realized how bad the weather was, heard the same warning and/or were more likely than not being stopped from going over the bridge. My wife has lived in the area her entire life and knows of no other way to get into Beverly from Salem.  Governor [redacted] appeared on television throughout the day of the concert and clearly stated, “all non-essential personnel are asked to stay off the road.” Not only did he ask this, Beverly Mayor [redacted] made the same request to ALL RESIDENTS OF BEVERLY. “With a major nor’easter bearing down on the region, Beverly residents are being advised to stay inside throughout the evening. Late Friday, Beverly Mayor [redacted] issued an important message to residents via robocall.“Please respect the storm, and stay inside tonight,” he said. “DPS Commissioner [[redacted] reports that the high winds are knocking down trees and live power lines throughout the city. Please, if you do not absolutely need to travel tonight, stay inside. As long as the high winds keep up, it is dangerous to be outside.”As of 5 p.m. Friday, over 160,000 customers had lost their power statewide due to the storm, [redacted] said.”This is the direct quote from the link I had posted above; here again:[redacted] I am not asking the band to come back and perform for us, I am not asking for anyone to go above and beyond to make us happy. But when we bought these tickets as a Christmas present for their mother, who had looked forward to this show for several months, I would hope we could at least have the money for the cost of the original tickets refunded so that we are able to purchase tickets to something else. We were LEGALLY and PHYSICALLY unable to attend this show and as such, I feel as though a refund is due in this case. Thank you.
