Complaint: [redacted] I am rejecting this response because: Cain and Herren said that they would refund dad's check, send documents (that we wanted them to draw up for us), and his trust booksAs of this writing, we have only received the trust books So, my response is that they have ripped us off because it was easy to do to someone old and feeble with no other family members on the island to advocate for him I don't know how else to interpret this situation I really don't They haven't offered ANY explanation at ALLBreathtaking!!! Gentlemen:Thank you for bringing this matter to our attention? We do not take these matters lightly and here is our account of the events that took place: ? On December 2, 2015, a house call was made to client's home? Many issues were discussed, to wit, preparing a general durable power of attorney, preparing a last will and testament, preparing a declaration of revocation of trusts (trusts), a request to review four (4) binders containing contracts, trust documents, incorporation documents, etc., preparing a management plan, exploring available options regarding his mortgage, and a referral to a tax accountantThe durable power of attorney, the last will and testament, and the declaration of revocation of trusts were all prepared and signed by our client? On January 14, 2016, we sent our client a draft ? "six month management agreement" for he and his business partner's review and comment? In discussing among other things, his many complicated trust issues, he was advised that extensive research regarding foreign corporations would be required, as some of his business affairs were conducted in Oregon, and we are not Oregon attorneysFurther, we made it clear that to accomplish his goals it would take time.? To resolve this matter, the firm will, together with a letter of termination of services, provide our client with the documents he signed, any and all original documents he provided for the firm's review (the four binders), and a refund of whatever monies are left in his IOLTA account after final billingLastly, we think it is important for you to know that [redacted] , the person that filed the complaint, is not our client.? We also returned white binders to [redacted] along with a refund check on March 14, ? Ms [redacted] needs to contact her father regarding the detail of the close out letter and refund

I am rejecting this response because: I am Mr***'s Power Of Attorney (which THEY provided me BTW), which gives me the right to inquire about all of my father's affairs and act on his behalf. I was also present at the meeting back in November and was made privy to ALL matters and also, Mr*** is of diminished capacity and has no grasp of time and does not realize HOW LONG IT HAS BEEN since he has heard from Cain & Herren. I believe this diminished capacity is what is at the heart of Cain & Herren's lack of interest in doing what Mr*** paid a hefty retainer fee for. What they CAN do is send my father EVERYTHING they have done so far so that he can show MEProblem solved. File the Will and send Mr*** a copy. Draw up the contract for the sale of the business. 3. Convey to Mr*** whether the the trusts have been dissolved after Mr*** signed the papers to do so in November. 4. Convey to *** if the LLC's address has been changed to a Hawaii address as was suggested by them during the meeting in November. Draw up a Health Care Directive for Mr***. Follow through on assigning Mr*** a tax accountant as was promised during the November meeting. Investigate what changes will be made to Mr***'s Mortgage and whether and how this mtg should be restructured for Mr*** to afford, if possible, and at least convey to Mr*** what will be happening to his mtg and when, so that he can prepare financially for any increases to his monthly payment. I, Ms***, am not giving them orders. I am simply REMINDING Cain & Herren of all the BILLABLE hours they were TASKED to do and what they SAID they would do. You guys.....come on....just follow thru! You are being mean and nasty to a frail old man! What is up with that? Just CALL him!

I wish there was another choice besides 'accept' or 'reject'.? I just want to convey that the documents and the check were not found by [redacted]'s first attempt to look for them but after I asked him to look again, he did find everything Cain & Herren said they sent.? However, these documents were the same ones produced at the big meeting at dad's house and are no proof whatsoever that the will was filed and is now active or that they went before a judge and dissolved the trusts.? Any close-out of my father's messy situation M.U.S.T be accompanied with lengthy E.X.P.L.A.N.A.T.I.O.N.S.!!!!? Cain & Herren SHOULD have EXPLAINED what they did or did not DO for [redacted]!? So....? Dear Revdex.com, I wish for you to pass on to C&H two simple questions? Was the will filed? (Is it a living, viable document ready to be executed?)2.? Are the Trusts dissolved??
