Gentlemen:
Thank you for bringing this matter to our attention.  We do not take these matters lightly and here is our account of the events that took place:  On December 2, 2015, a house call was made to client's home.  Many issues were...

discussed, to wit, preparing a general durable power of attorney, preparing a last will and testament, preparing a declaration of revocation of trusts (4 trusts), a request to review four (4) binders containing contracts, trust documents, incorporation documents, etc., preparing a management plan, exploring available options regarding his mortgage, and a referral to a tax accountant. The durable power of attorney, the last will and testament, and the declaration of revocation of trusts were all prepared and signed by our client.  On January 14, 2016, we sent our client a draft  "six month management agreement" for he and his business partner's review and comment.  In discussing among other things, his many complicated trust issues, he was advised that extensive research regarding foreign corporations would be required, as some of his business affairs were conducted in Oregon, and we are not Oregon attorneys. Further, we made it clear that to accomplish his goals it would take time. 
To resolve this matter, the firm will, together with a letter of termination of services, provide our client with the documents he signed, any and all original documents he provided for the firm's review (the four binders), and a refund of whatever monies are left in his IOLTA account after final billing. Lastly, we think it is important for you to know that [redacted], the person that filed the complaint, is not our client.

As Cain & Herren has terminated the Attorney-Client relationship, we are not in the position to be giving legal advice.  Generally speaking Wills do not get publicly recorded in the State of Hawaii.  Wills get probated in court when the decedent passes away.  Trusts are dissolved upon execution.  Trust dissolution is not an issue that requires court intervention.  Again, as we have terminated Attorney-Client relationship, further questions should be directed to the [redacted] Referral Line at [redacted].
