Mr*** has contacted our company several timesHe has made several requests, each request greater than the previous requestHis first contact with our company was to inquire about making a tax deductable donationWe informed him that we
are not a 501(c)(3) nonprofit companyHe then informed us he would make arrangements to donateAfter some period of time Mr*** again contacted us and wanted to know if we would be willing to purchase his used machineMr*** was informed that we do not deal in used equipment but would make an exception in his caseHe had days to accept or decline our offerAfter days Mr*** then called and asked for us to buy a completely different machine at our cost and refund him the full amount of his purchaseThis request was deniedHis request would have resulted in not only a full refund but a 3500$ cost of purchase for a different unitThe equipment that Mr*** purchased has a non-transferable Life Time warrantyFederal law gives Him the protection to change his mind within Three days of purchaseWe wait Days to register the lifetime warranty as a precautionary standardIf Mr*** had requested to cancel the sale within the day rescission that he was well aware of and signed several documents with his "right to cancel"We would have gladly canceled the saleUnfortunaly we have been unable to contact Mr ***He is no longer returning callsWe would love to resolve this complaint with some sort of middle ground, but terms or his request for a refund is not reasonableThe machine he purchased even though he states as still "new" is actually "used" and our company does not deal in used equipmentHere is a copy of Civ.code

I would be satisfied with the first offer which was $dollars, and a replacement Kirby vacuum cleaner of the same model, and year for my Kirby that was taken for a Trade-in

I am rejecting this response because: The product dose not work as demonstratedI was told that a repwould come to my home to verify that this vacuum was working poorly The company never came nor called.My complaint is that the vacuum dose not work even half as well as demoed and there has been no health improvement, there was also a sickness after using the product as rec amended.

We also asked if we could get her contact information and her answer was "NO WAY DUDE, I'M NOT GIVEN YOU A HEADS UP!!!" At this point we feel that she is trying to extort cash from us using the Revdex.com as a toolClient has received all that was promised from the startUnfortunately greed and ignorance have taken over

purchase. Purchase date was 6/19/2017. Clients have 3 days to cancel and return the unit for any reason. In this case we did not even deposit your check until the 4th day just to make sure nothing was sent via email or fax. We also have an internal policy that all prospective purchasers must have a phone interview before the sale is completed. this interview asks very specific questions. the first question is " Was the Representative courteous and respectful the entire time he was with you?" You answer was "yes". The second question was " what did you like most about the machine, the air cleaning or the surface cleaning?' your answer was "both". The last question was "we want to make sure your making the decision to purchase for the right reasons and not because you were pressured, so did the rep pressure you in anyway to purchase today?" your answer was "there was no pressure".  The FTC has a Federal law that both parties must comply with. It is a law to protect the buyer and the seller. Do to the nature of the machine and the Warranty that it comes with once the rescission period has expired and funds have been received we register the warranty. At that point we can no longer accept returns. Again Thank you for your time and we sincerely apologize for the delay in response. [redacted] has only contacted our office to ask for service. We have returned to her home to provide service for her purchase. Never once did she voice any concern for her purchase or request to cancel by oral or written statement. She...

even answered a 3 part questionnaire prior to any purchase agreement being made in her home. The questions were "was the representative courteous and respectful the entire visit?" Her answer was "yes". 2 "what is it you most liked about the machine the air cleaning, surface cleaning or both? "Her answer "I really liked how much filth this machine got out of my home." And the last question was "we want to make sure your investing in this unit for the right reasons and not because you were pressured. So at any point did you feel pressured?" Her answer was "no, the machine sold itself, no pressure here at all." We did however take a phone call from a "friend" That said she was calling to get information from our company. She was asking personal and confidential information about [redacted] that we can not disclose. She then tried to cancel the sale giving all kinds of excuses listed here in the complaint. We would have gladly canceled the sale if [redacted] herself had requested to cancel but so far the only contact we have had from [redacted] is to ask for service. It is our belief that this complaint is an attempt from the friend to cancel the sale. Which at this point is impossible. [redacted] entered into a financial agreement with a private lender to pay for the unit and we have zero authority on behalf of the buyer or lender to cancel. But once again. If [redacted] Had requested to cancel the sale we would have gladly done it, we are legally bound by federal law to cancel, like we have in the past with the a few clients when they have requested properly within the legal time frame. Cal state medical has concerns about this complaint and request that the Revdex.com verify with [redacted] that her "friend" has given her the chance to review this "story" for her approval before submitting to the Revdex.com. The complaint is not only fabricated but facts have embellished to sway a desired outcome. We do Not employ HIGH PRESSURE tactics. We ALWAYS verify with the client that there was NO PRESSURE, and at any point if prospective purchasers demonstrate lack of mental faculty we will not engage in business. We pride ourselves on providing customer care and straight forward business dealings.
