Our firm paid $on your behalf to *** *** due to a shortage collected by the closing agent, as evidenced in the attachments provided. This fee was part of the realty commission you owed your agent and not a fee due our office nor did we profit from it. We paid this on your behalf as a courtesy because you were not present at closing. Furthermore, we contacted you as soon as your agent made us aware of the error in their commission bill In fact, you attached the initial email we sent you below. As such, this debt remains unpaid and subject to collection. *** ***Saratoga Abstract, LLCCalabrese Law, PLLCDivision StreetSaratoga Springs, NY 12866***@calabrese-law.comP: ###-###-####F: ###-###-####

Attached is all the...

information on Hage.  As you
will see the HUD that the bank [redacted] prepared had incorrect commissions.  We were
only given a verbal if I remember correctly and when I came back from closing
and discovered the error I told Chris Conte from [redacted] we would cover the  difference and
collect it from [redacted].  The cancelled check from our operating account and
the new HUD which is what we use as our Statement of Sale that we prepared for
Sally is attached as well.  We called to explain this to her and sent her
the information so that she could see where the discrepancy was.  She was
supposed to call us back if she had any questions, but never did.  We sent
her several emails with no response.  A little over a year ago we sent her
a collection letter with no response.  Our office suffered a  flood last
year, so we are just now getting around to sending out follow up letters.
This is clearly her responsibility.  While we strive to always have accurate
numbers at closing, sometimes things get missed.  We tried to do her a
favor and make everyone happy and front the funds for her as she had already
moved to Boston.  We have given her ample time to pay this. I am not sure how much more we could have done.  Please let me know if there is anything else I can do.  We have also sent all of this information to her agent in hopes that they can assist in explaining this further to her.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Working with Calabrese Law  was different than any other attorney I have worked. They appeared to have difficulty with real estate accounting (coming up with the correct final numbers for the closing). They ran the closing numbers on my house several times and came up with different numbers during the few days before the closing. My own mortgage holder in Massachusetts was troubled by their difficulty, as she received a copy and found errors. My mortgage broker actually cautioned me about this firm and told me not to pay any additional amount they might come up with. On the day I signed all papers for the closing and final numbers were confirmed and agreed upon, I signed all final paperwork, which included ALL fees and commissions, including their full attorney fee. They did contact me a few days later and indicated the ran the numbers for the closing again and they were a few hundred short ($339.41), due to an error THEY had made. They called this amount "an advance" at that time and they apologized for their error; however, when I signed for the closing no mention was made of an advance, nor of any funds I still owed, nor did they provide me with paperwork to document this error. At the time of my signing the paperwork for the closing the account was settled in full. Unfortunately, I cannot be responsible for Calabrese Law's error, which should have been corrected before the final paperwork was signed. I never received any bills from them until this one, almost three years after the event! I am sorry for their recent, tragedy of a flood, but that does not mean they can take advantage of me as a former customer by trying to charge me an extra $500 attorney fee several years later. This attempt is inappropriate and unprofessional and I believe The New York State bar association will agree, if it comes to that, I will have no choice but to file a complaint regarding what I consider unprofessional behavior.
Regards,
[redacted] Hi [redacted], I hope you are getting settled in your new home by now.  We are looking to close out our file however we need the balance of your funds in order to do so.  If you would please forward the check $339.41 made payable to our firm as we advanced this money for  you .  Thank you in advance and again I hope all is well. [redacted]Calabrese Law, PLLCSaratoga Abstract, LLC57 Railroad PlaceSaratoga Springs, New York 12866###-###-#######-###-####[redacted]@nycap.rr.com
