I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted]. Please add your rejection comments below. 
[I was very sad and offended to read Mr [redacted]'s totally untrue statements.Generally I was highly disappointed in all the work done by Mr [redacted] on my property at [redacted], MA. This work consisted of: replacing the fence along the back yard and driveway (22 sections), the fence between the front and back yards (3 sections), also repairing the retaining wall and painting 4 windows from the outside - - all for $ 3,850. In good faith I paid him in full as he agreed to return and finish up which included staining the fence. As I said before, the old dowel fence was made out of 0.75" cedar wood and Mr. [redacted]'s estimate and our agreement was based on his replicating the old fence in material, size and quality. Mr. [redacted] gave an estimate in March of 2012, and we agreed to start the job on September-October of 2012 .He brought his workers on October 1, 2012. On that day all the old fencing was removed. The next day he brought DISCOUNTED 0.33" pine fence sections with a lot of visual defects and immediately started installing the sections despite me not approving the wood's quality. He told me this was the only material he could find at [redacted] [redacted] and if stained the pine wood would be as good as cedar and it would last as long.Mr. [redacted] NEVER talked to me about shortage of posts or cedar fencing material PRIOR to starting the job. His statement about informing me on the wood change and storing pine fence sections on my driveway for 7-10 days is absolutely false. I would never let Mr [redacted] to remove our old fence if I had seen before those discounted 'new' sections. There was no emergency or rush to replace the fence and I could easily have waited until the next spring if told that the needed cedar dowel fence was out of stock. Why would I voluntarily agree on fencing that was of a very bad quality and would not last when I paid for much better?My house is located on a hill, and the back yard has a 10 feet high retaining wall that abuts our neighbor's property and a 5 feet tall wall that abuts our driveway. With the old fence removed the back yard was an open space where the neighboring children when playing outdoors could have fallen on the rocks and been badly hurt. With this safety concern in mind and the fact that Mr. [redacted] promised to stain the fence first thing the next spring, I didn't stop Mr [redacted] from installing the new fence.I did however ask Mr [redacted]'s workers to put the fence close to the ground so animals could not crawl under it. The workers didnt advise me otherwise as they should have if they were professionals. In fact, it appeared that Mr. [redacted]'s workers didn't know what they were doing as Mr. [redacted] yelled at them every time he'd come to check on the progress of their work, making me wonder about their construction's knowledge and training if any.So, on October 7, 2012, when the fence was up I paid Mr. [redacted] in full with the understanding he would return the following week, in October2012, to fix/correct the many things that werent done properly:** to secure all the poles that were crooked, unstable that made the whole fence uneven, shaken, dangerous and ready to fall** to replace up to 20 broken pickets ** to re-attach 5 loose sections ** to re-install improperly installed 4 sections above the cement wall ** to fix the front of the retaining wall ** the fence between the front and back yards was incorrectly measured and installed, thus the left side of the fence had a 4" gap with the ground level. Instead of redoing all this fence the worker attached one picket horizontally to the bottom of the fence to close the gap, which looks very bad and totally unprofessional.If necessary I can provide pictures to support my complaints.In the early spring of 2013 I noticed that one backyard fence section was broken in half. Because the quality of the wood was so bad and fragile from the beginning, I assumed it had broken by itself and so I called Mr [redacted]. He came by but refused to fix it saying the damage might be due to the city snow removal work. I called the [redacted], they came out and fixed that section of fence in July 2013, placing a new one standard 0.33" pine section which is of much better quality than the rest of the fence on my property.The cost of staining was not on the written contract as it was verbally agreed to after the pine fence was installed. Mr. [redacted] promised to stain the fence in 2 layers for $300, with cost of the stain included. I even provided him with the desired color - cabot. However, despite my numerous attempts to contact Mr [redacted] since the spring of 2013 , he never fulfilled his promise. At first he stated he was very busy with other jobs but would call me later, then he just ignored my calls and letters. I still insist that it is only just and right that Mr. [redacted] reimburse me for the difference in product as it was in violation of our agreement Mr [redacted] purchased and installed much cheaper and poorer quality fencing and broke his promise to compensate me for that by staining the fence with the discount.I will not pursue Mr [redacted] anymore to stain the fence. I already contracted someone else.Please note, I found similar complaints about Mr [redacted] on [redacted]

To Whom It May Concern:I reiterate everything that I said on the first response. All statements were true. I do not know any customer that I met for the first time that would pay me in full without finishing a job. Her complaint is one lie after another. I do not know any contractor that will paint 166 feet of fence, 2 coats, both sides and pay for the paint. I have been in business for many years because I do not lose money when I lose a job. To paint her fence for that is crazy. I told her I would put one coat and she had to buy all the material. Also, a lot of the fence was damaged by city plows. In her response it shows that the city plows pushed snow against her fence. The first estimate was on 3/19/12. The first deposit was on 9/9/12. When I notified her that the original fence that she wanted because [redacted] does not carry it that late in the season I told her that I could get the fence installed only. I brought all the sections there and left them for about a week before we started to install. If she was not happy with the fence, I would have returned the fence and her deposit. If she was not happy she would not have paid me in full on 10/7/12. You would have to be crazy to pay someone in full if you are dissatisfied.

To whom it may concern:The description of the fence the customer is saying is never on the contract. My contract was destroyed in a fire on Jan 27th, 2013. The customer wanted a post and dowel fence. After I received my deposit, I told her that [redacted] had no more post and dowel fence for the...

season. She asked me what they had and I informed her they had fence that they had fence that attached to 4X4's, not post and dowel. She said fine. I brought the sections and left them in her driveway and left them in her driveway 7 to 10 days before we installed them. So the day we started installing the fence, I instructed my guys where the fence would go and there were 3 different types of fence to install. I came back and check my workers, they were burying the fence in the ground. The owner told my guys to do that. I informed the owner that by doing that, the fence would rot. So we unburied the fence that was buried and put it level to the ground. We finished all the fence and repairing of the retaining wall. The customer was satisfied and made the final payment.The spring of 2014, she called me saying the fence was falling down. I went and looked at it , one section was split in half and 4 other sections were loose. These sections are adjacent to a street and the plow people pushed snow into the fence causing these problems. I tightened the sections that were loose. I refused to fix the broken one. The city came out to repair the broken section. I told the customer I would spray the fence for $400 with her purchasing all the materials. She would only pay $300 and I said I would not do it. That work was not on the contract. [SUMMARY:ISSUE: Quality and COST difference between cedar fence and pine fence ~ $800 .Without my knowledge and consensus Mr [redacted] purchased the discounted pine material in lieu of the standard quality cedar, as we initially agreed upon. When I brought this to his attention he stated he would stain the fence, including the cost of the stain, for $300 and this would make the pine as long lasting as the cedar. DESIRED RESOLUTION: Mr. [redacted] should reimburse me $800 for the difference in fence material. UNDESIRED RESOLUTION: If Mr. [redacted] refuses to pay me the $800 I will file a complaint with small claims court, post review on [redacted] List toalert potential customers of Mr. [redacted]'s poor work and business practice.1. As I said before, the original estimate and contract that was agreed upon was replicating 0.75" Cedar fence, that is the same material, size and quality. In [redacted] each cedar section costs ~ $60 and up, cost for all 22 sections could be ~ $1,320. Instead Mr [redacted] installed 2.5 times thinner, 3 times cheaper untreated discounted pine sections, cost for each section ~ $20. The difference between the cedar fencing and the pine fencing is ~ $800.2. Initially I didn’t realized the huge $$ difference in the cost and quality of the substituted material so I accepted Mr. [redacted] offer to purchase and stain the fence at a discounted price of $300 which he stated he would do the next spring. I kept calling him since then to take care of the staining.3. For the stand alone project the price in $400 to stain the fence - might be an average price . However, $300 cost plus stain was offered to me by Mr [redacted] as compensation for using different material and was not added to the existing contract, but meant to be additional project/ cost in the spring.4. I paid in full $ 3,850 the contract price, which was to install fences, fix the cement wall and paint 4 windows, though the quality  of all the work was mediocre. Mr [redacted] had to come back for numerous fixes after 'work' was finished and fully paid for. 5. Only one section of fence was broken by the city plow and it was replaced by the city PWD. I can provide proof of this by obtaing a document from the city hall. Replacing that section of fence has nothing to do with Mr. [redacted] substituting pine for cedar. I have nothing to hide, make up or exaggerate. If an independent expert-contractor would come, he could see the crooked fence, poor quality fence with knots, cracks, holes, uneven cement wall on our property. I have kept a few pickets from the old cedar fence to present for comparison. There was a complaint against Mr. [redacted] on the Revdex.com website and when I mentioned this to him he assured me it was not his fault, but the customer's. Mr. [redacted] has NOT been honest. He gives contractors a bad name. I deserve to be reimbursed $800 for the substitution in material.]
