of Central California and Inland Empire Counties. Following receipt of your submission from the Department, I immediately investigated the concerns with regard to a payday loan taken out by the Complainant's husband (the "Borrower").
After speaking with the company's Regional Manager over the branch that issued the loan, who reviewed this incident with both the Area and Branch Managers, I believe this was a misunderstanding by the Complainant on the depositing of checks.
In the complaint, it is stated that the loan was not paid back on January 22, 2016. Further, the complaint stated that "o attempts to cash this check were ever made when funds were available." It goes on to state that "n April 21, 2016 California budget finance generated their "own" ACH debit check using check information that was hand written in. January 2016 form a personal check..:" During the investigation into California Budget Finance's actions, I discovered that the personal check.Written and dated for January 22, 2016, was, in fact, deposited and returned for "Not Sufficient Funds." Enclosed with this response is a copy of the returned check. Follo.Mng the return of the check, California Budget FinanCe represented the check via RCK (an electronic representment of a physical check using the ACH system), as authorized in the loan agreement executed by the Borrower (enclosed).
Specifically, the contract provides:
"The Check and Our Electronic Check Conversion and Re-Presentment Policies. The Check is payment for your obligations under this Contract. When you provide the check as payment, you authorize us either to use information from the Check to make a one-time electronic fund transfer from your account or to process the payment as a check transaction. For inquiries please call X-(XXX)XXX-XXXX. If the Check is returned unpaid for insufficient or uncollected funds, we may re-present it electronically."
The since this complaint was submitted, our Area Manager has spoken to the complainant accepted this proposal and stated she would close the complaint with your office. Regardless, we felt it appropriate to respond in full to your request.
