[redacted] Desired Outcome: Permission to sit for and take their CCBMA Examination due to their wide-spread recognition Background Information: I am qualified to take a Medical Assistant certifying examination according to CCBMA's FAQ page on their website. However, I am not being allowed to because I have too much experience as well as there being an unrealistic and unsubstantiated concern that I may not be able to follow directions. The role of CCBMA is to prepare and administer a Medical Assistant examination. The company does NOT have any statutory investigative nor enforcement role and as such, the company is acting outside their purview. Prayer: I'd like to settle a disagreement between myself and the El Dorado County, Northern California based corporation because they are refusing to grant me permission to take their Medical Assistant certifying examination. I meet the requisite qualifications to take their test as listed on their website; however, I was declined for the following reason; "... we suspect it is difficult to restrict your clinical activities given your medical background ...". This was the official statement I received from the President of the corporation last month, Ms. [redacted]. The California Certifying Board for Medical Assistants, Inc. is not a governmental body nor an administrative agency of the California Department of Consumer Affairs. Rather, the California Certifying Board for Medical Assistants, Inc. is a public corporation. Although the CCBMA is not in compliance with the California state Professional and Business nor Health and Safety Codes, they are not required to follow the laws (as explained to me by the Medical Board of California) since the company is not held to the same standard as a governmental body. I am being discriminated against, not because I don't meet the requisite qualifications, but rather because of fallacious reasoning the aforementioned persons somehow feel, without justification, the breadth and depth of my experiences might, without any level of evidence whatsoever, create an occupational environment wherein I would defer on following instructions and opt not to follow and abide by the medical assistant scope of practice as elucidated in the California Business and Professions and Health and Safety Codes. My not being granted permission to have the reasonable opportunity to take the CCMA examination is as unfair as a professional race car driver being prohibited from obtaining a driver license because of fear that the operator may traverse public thoroughfares too fast! Again, it is bad faith as well as it being outside common logic and reasoning. My application with payment was submitted to them a couple of months ago and my written appeal for reconsideration was submitted several weeks ago. I would like see the California Certifying Board for Medical Assistants, Inc. approve my request for the examination in good faith. Response:

CCBMA received Mr. [redacted]'s application on June 6, 2015 to sit for the California Certifying Board for Medical Assistants. Mr. [redacted] has also contacted our office several times prior to receiving his application by phone and email. His application was denied on 7/6/15. Mr. [redacted] is a medical doctor that surrendered his licence. CCBMA had to contact the Medical Board of California determine if he was banned in the medical capacity. We have followed our internal policy and procedures. CCBMA received his appeal on 7/14/15. I informed Mr. [redacted] on July 16, 2015 that the appeal process can take up to 120 days. CCBMA is still reviewing his appeal. CCBMA has a board meeting scheduled for 10/24/15 (well within the 120 day time frame). CCBMA has not at this time granted permission to sit for the certification examination.

Response:

I am formally rejecting the response from the California Board of Medical Assistants. I believe it is unreasonable to wait four (4) months for an approval to take an examination since my application should have been rightfully approved long before this writing.I am not "banned in the medical capacity" by an authority, government or otherwise, nor is there any reliable information that would support that conclusion. The contrary is true. I am statutorily permitted and eligible under the Business and Professions Code to move forward with any chosen and rightfully earned credential, medical ( 2221(b) & 2307) or otherwise.It would be both reasonable and germane for the California Certifying Board for Medical Assistants to release their internal policy and procedures as it relates to my specific matter and complaint.I was initially and unjustly refused permission to take their examination for the following fallacious reason, " ... we suspect it is difficult to restrict your clinical activities given your medical background...".[redacted], CCMA(National Healthcare Assocation, # [redacted])Windsor, CA 95492-0168
