On August 10, 2015, a local business in the complex where my business is also located, handed me a piece of mail addressed to my businessUpon opening the mail, it stated that you have attempted to contact me with regard to a complaint by *** ***Please note that Calvert CrossFit conducts business in a complex at the address listed on your letter, however, the business does not receive any mail via USPS at the complexAll mail for the business is sent to and received at the following address:*** *** *** **North Beach, MD If you can please update your records that would be appreciatedAs to the complaint by *** ***, please note the following:
On August 2, 2014, Ms *** came to Calvert CrossFit looking to joinAt that time, she was given a tour of the facility as well as provided with necessary information concerning the facility and its programsShe decided to join the facilityEvery person who comes to either try the facility as a guest or join the facility has to complete the appropriate paperworkOn that date Ms*** completed forms that included personal information, health assessment, a liability waiver, and a contract for Calvert CrossFitThe liability waiver and the contract for Calvert CrossFit, were both emailed to Ms *** at ***the email address provided by Ms*** at that timeMs*** first paid $for “Foundations”, a preliminary course that must be successfully completed prior to commencing trainingAfter successfully completing Foundations, Ms*** contracted for a one (1) month membership on August 28, and paid $US CurrencyThe one month membership was to begin on September and end on September 30, participating an unlimited times a month of SeptemberMs*** attended CrossFit seven (7) times during the month of September, On October, 2, Ms***, contracted for a three (3) month membershipAt that time, an employee explained that the billing cycle begins the first of each month for all contractsSince Ms*** contracted on the 2nd of the month, the month of October would be prorated from the second of the month to the end of the monthTherefore, Ms*** would not be charged for Oct.1, The first full month of membership would begin on November 1, The three month contract would therefore end on January 31, Ms*** has not returned to CrossFit since October 2, On November 17, 2014, I sent *** an email, again to the above listed email address she provided, indicating that according to our records she had not attended CrossFit in daysMs*** did not respond or submit any correspondence to me until January 5, At that time, Ms*** sent me an email stating that she was in an accident in October and that was the reason why she had not returned to the facilityShe stated that she enjoys CrossFit, but she could not keep up with itShe inquired if she could receive a refundOn January 27, I sent Ms*** a message stating that I confirmed with my employee that she was told about the pro-rated month and the billing cycle for the term of the contractIt should be noted that Ms*** never attempted to freeze her contract pursuant to paragraph number of the contract and never attempted to cancel her contract pursuant to paragraph number of the contractAlthough Ms*** is liable for the entire amount of the contract and while not obligated to do so, represented to her that I would refund half of her money, that being $57.50, representing half the cost of her pro-rated month of October when she said she was injuredI did not ask for a doctor's note to substantiate her claimSee, paragraph number of contractI took her at her word and assumed it was true even though she did not give me any particular information concerning her claim of injuryI have not heard from Ms*** sincePlease see the attached documents consisting of the relevant month contract in question and the Waiver and Release of Liability formRegards,
