We have been in contact with Mr. [redacted] concerning the possibilty of a pool leak. The deck challenge was sent to the contractor who will be in touch with Mr. [redacted]. Ed K[redacted] (Construction Manager) has spoken to Mr. [redacted] and told him we would be out to pressure test the plumbing lines and try...

to find if the pool is leaking. We have already been out to the site this past Thursday (8/13/15) and started the leak check. Please note that the work we performed on Mr. [redacted]'s pool was for repairs, Blue Haven Pools did not construct this pool. However we will assist mr. [redacted] with the finding of the leak. If we locate a leak we will then be able to determine who is responsible and charges may apply. Mr. [redacted] has been notified and is in agreement with this plan.

June 29, 2015Dear [redacted]
Blue Haven at no time has shirked its responsibilities for the renovation work done to the [redacted] pool. The Blue Haven representative was contacted by [redacted] after the work was originally completed to help her with algae in her pool. The salesperson, Dominic, even went to [redacted] Pools and bought the supplies for [redacted] and cleared up the algae problem even though this had nothing to do with the pool renovation work done by Blue Haven. Dominic later assisted again to help with a sand filter issue which work was also not part of the renovation work. Dominic went to [redacted]’s Pool Supplies and purchased the chemicals and took care of the issue at no charge to the homeowner. Once those issues were resolved the [redacted] swam in their pool after the renovation work was completed and we believe had their pool winterized at the end of the pool season.
After the renovation was completed and all during the summer there were no complaints made to Blue Haven regarding any leaking pipes or any other issues from the [redacted]. The complaint the homeowner is making now appears to be related to the winterization of the pool. Blue Haven was not hired to winterize the pool. If the pool was not properly winterized and water is not properly flushed out of the system, pipes can freeze and cause damage which can cause leaks similar to the complaints being made by the [redacted]. This complaint is unrelated to the renovation of the Novello swimming pool by Blue Haven but appears to be related to the winterization of the pool which was not performed by Blue Haven Pools.The contract between the parties provides if the [redacted] want to request a service call they first need to follow the procedures of contacting Blue Haven Pools, providing a credit card and Blue Haven Pools will then come out and diagnose the problem. If the problem is unrelated to Blue Haven's renovation work there is a charge for the inspection. [redacted] has refused to follow this process and procedure. Not only has Blue Haven stood behind its product, but the Salesperson went out on his own time and without charge to the [redacted] to assist in clearing up algae in the pool which is very common with pool owners over the summer months and to assist with a sand filter issue. Blue Haven has gone above and beyond its responsibilities with regard to this project and it is the homeowner who has failed to follow the procedures provided under the contract agreed to by the parties. Quite frankly it sounds like there was a failure to properly winterize the pool which caused a leak in the plumbing for the pool which would not be covered by the warranty under the Blue Haven contract for obvious reasons, but would be the responsibility of the company that winterized the pool. Blue Haven remains ready, willing and able to respond to a warranty call and diagnose the problem although it would appear the homeowner should be contacting the winterizing company directly.If you should require any further information please feel free to contact me.

In response to the claim filed by [redacted] any and all additional footage above the contract is the responsibility of the buyer to pay as per the signed contract terms. The landscaping was not the only reason for additional footage. The pool equipment was moved by the buyer the day of the...

I am rejecting this response because:
The response that Mr. Calvitti wrote focuses on the pool algae and a problem with the sand filter which have nothing to do with my complaint. To clarify what Mr. Calvitti is talking about I will explain that I ordered the pool to be filled with water the day that the pool was plastered as per the instructions of my salesman, Dominick. After plastering, the pool must be filled within a few hours. This of course costs close to another $1000.00 I ordered the water to be delivered from the water company that they told me to order from and when the pool was full of the water that was delivered it was totally green. I told Dominick and he said he would bring chemicals to fix it which he told me I would have to pay for. He brought the chemicals, charged me $100. and the water was still green. He said I had to wait till the chemicals took effect but the pool remained green. So he told me to take water samples to the local pool store and ask them what the pool needed. So I had to, since they clearly were leaving me with a green pool. The pool store ended up telling me the water had phosphates and that I needed other chemicals, for which I paid another $100. and that fixed that problem. As far as the sand filter problem Mr. Calvitti talks about, was when Dominick forgot to write on the contract that part of the job was to install a new filter box and timer. Since it was not on the contract he knew from experience that they would not send an electrician to put in the new timer so he said he would do it himself which he did. But when he did the job he caused a leak in the attaching pipe to the filter, which he then came to fix since he caused it. Apparently, he knew his company would not stand by what he had promised because he had forgotten to put it in the contract but he knew he had promised it to me so he tried to make good on his promise. 
Both of those issues have nothing to do with the current problem which was a leak in a different pipe by the regular filter, not the sand filter. It is clear that the plumbing that was done by the [redacted] sub contractor did not make a proper seal on the attaching pipe to the filter. And I do believe that if Mr. Calvitti had sent this plumber, their subcontractor that that plumber would have made good on correcting the seal on the pipe which I don't think would have taken a plumber very long to do.  THis had absolutely nothing to do with winterizing the pool. If [redacted] had any pride in their name or product they would have sent someone out here to LOOK at it which they never did. When I called to say there was a leak, the only person I got to talk to is the woman who says she just answers phones. No one from the company other that Dominick, my saleman would even talk to me. Dominick told me to call the company but they will not talk to you. The woman who answered the phone said I had to fill out a warranty form which says on it that I have to pay for my own warranty work. After spending $30,000. on a pool renovation, one would think that the company would at least want to see what the problem is. They made it clear that they will not take ownership of this in any way, not even to talk to me about it or to look at what the problem is without me giving them my credit card first. Anyone looking for a reliable company should stay clear because once they get your deposit, they will demand a certified pre-payment check BEFORE ANY WORK IS DONE and they will not even come to your  house without that PREPAYMENT. No one ever came to the house to see that the pool was done correctly other than the saleman who is a saleman, not a technical person so whatever issues you have when they say they are done with the job is on you.

Review: During June of this year, we hired Blue Haven Pools to replace the tiles and the cement decking for $17,After the work was completed, large cement pavers were broken, one corner of the decking was completed improperly, an electrical line was cut, a inch deep foot wide foot trench was left where equipment had run carrying the old decking to a dumpster (the ground is so compacted that it holds water which then stagnates), the dumpster left divots (inches by foot) on the driveway, and a foot section of the edge of the driveway was broken offWe had been told that wood would be placed on the driveway to support the dumpster and on a path from the driveway to the pool to protect the yard from damageNo protective effort was made to prevent the trench, the pavers, or the driveway damageIn addition, a fencepost was taken down unnecessarily and a foot long section of copper wiring is extending from the cement into the airOnce we started using the pool, we found pieces of concrete were breaking off and falling into the pool and seams that were not finished that are causing what looks like rust spots
We are currently getting estimates to repair the fence, driveway, pavers, and fill in the trenchLast week we faxed a page letter to the main office with not responseAt one point the owner, **Calvitti, answered one of our phone calls and promised to take action and he would call the foreman of the job and get back to usOf course he did notBase on their A+ rating with the Revdex.com, we are very disappointed with their lack of response
The electrical line was fixed and the fencepost was re-installedHowever, after several phone calls while the work was going on and afterwards, the other damage was never fixedThey had promised to fix the corner of the decking, but have notRegarding the driveway and the pavers, we were told that that was damageRegarding the trench, we were told that that was landscaping which they did not do
We were warned that there would be damage to the lawn, but we never expected the extent of the damage.Desired Settlement: We would like the pool corner completed correctly, the driveway fixed (we will supply estimate), the pavers replaced (we will supply estimate), the copper wire made safe, the trench filled in (we will supply estimate), and the broken concrete and seams fixed

Blue Haven Pools was contracted to renovate the pool for the [redacted]'sThe scope of work was to remove and replace the tiling and concrete deck surrounding the poolA section offence was removed as needed for access to the pool work areaThe fence was re- installed once the new concrete was poured and the area was dry enough to concrete a post in the groundThe [redacted]'s were informed on the day the work started that the section of fence would be removed and re-installed after the work was completeThere was no issue with this at the timeA dumpster was placed on the driveway on boards as is standardHowever, on the day the dumpster was retrieved it was raining and the boards were wet and the heavy dumpster slid off the boards a caused divots to the driveway
On the day the work began 6/7/2013, a skid loader and jack hammers were on site for the concrete removalHeavy rains came at the half day point and the work had to be stoppedThe pool is elevated approxfeet above the specified access way to the pool and the property slopes to the access way at the lowest point in the yardThis area quickly became impassable for men and equipment to load broken concrete into the dumpster on the drivewayThe [redacted]'s were contacted and informed that the foreman on site recommends a day dry out period based on the site conditions and rain
On the first day of the dry out period [redacted][redacted] phoned in upset and verbally abusive to the scheduling staff, calling her stupid on occasions and hanging up the phone during conversation[redacted][redacted] stated that [redacted] Calvitti had been out to say the site was fine and we should continue the work[redacted] Calvitti had not been there to inspect the site and did not have a conversation as she stated since renovation scheduling was handling the communication to the [redacted]'s while the work was in processAs a result of their impatience and insistence that the yard/site was dry enough for us to return, we arrived a day earlier then recommendedSince the rains continued sporadic thru the dry out period the property was still wetThe work went on and the project was completed on 6/22/
Once the work was completed **[redacted] called to mention the damage to the lawn, driveway and paversHe also mentioned a corner of the concrete he was not happy with how it was formed and finished as well as an electric conduit for outdoor lighting had been cut during the concrete removal adjacent to the deckI met with both **and [redacted][redacted] on 6/21/a day prior to completionI promised to fix the electric and the concrete cornerThe electric was repaired as well as the concrete as promisedThe copper wire was not mentioned in our meetingIt has been reconnectedTheir letter states "Pieces of concrete was breaking off into the pool and seams that were not finished and causing what looks like rust spots" was unfounded on site visit of 7/17/and turned out to be shrinkage cracks at edge of the concrete and were sealedOn this day **[redacted] stated he was satisfied with all corrections and promised he would send a letter of satisfaction for the issues that were corrected
Regarding the driveway, lawn and paversThe agreement entered into by both parties stated under item #under the heading:
"access to poor
"Customer agrees to provide adequate access to the pool area and defined as ft on each of its sides and outside deck
Customer is solely responsible for all site preparations including and not limited to, removing trees, stumps, power lines, underground gutter drains, footer drains, sump pump lines, etc
Customer is solely responsible for damage to improvements and appurtenances located in or reasonably adjacent to the access routes or the pool site including but not limited to such items as lawns, shrubbery, trees, curbs, sidewalks, driveways, sprinklers, etcor to any real or personal property caused by moving equipment to and from the pool within the access way or around the pool
**[redacted] and I have discussed this portion in a site meeting where he stated we would have to agree to disagree on these points but was otherwise satisfied

I am rejecting this response because:Blue Haven's response contains many untruths
As
any consumer in this day and age, planning a big renovation to your home needs
careful consideration and thorough investigation as to the most reliable and
honest companies to do the workWe got a flyer from Blue Haven Pools and
we immediately checked with the Revdex.com and found that BHP has
an A+ rating with Revdex.com and we saw the motto of the Revdex.com was Start with Trust
We were confident with this rating that BHP would do a job to be proud
ofOne of our mistakes was we should have checked their website to see
the numerous complaints about the service and their refusal to take any responsibility
for their part in things that went wrongAs we read over the complaints,
we find that they did the same thing to usWe believed what [redacted] Calvitti
assured us when he came to our home to find out what we wanted and give us a
contract and a ton of empty promisesHe told us about his new baby and
you need to have good moral values in today’s society in order to raise a
family and have a reliable companyHe told us he was only part owner but
he represented his uncles who only wanted the best work done under their name
As we spoke what we had planned on doing to the pool (retiling) he showed
us how that was not the best thing and to make the pool safe and look good we
would need other things...new coping, new cemement and a few more items
By the time he was through telling us what was needed to really make the
pool presentable it came to approx$17,This was way more than we anticipated
and really were comfortable withHe assured us that it would be worth it
because BHP did the best job anywhereHe warned us that there could
possibly be some damage to the underground wires when they removed the cement
but he assured us that they would fix anything they damagedAt first [redacted]
said that some damaged like the cut underground wires would not be covered but
because of the extent of the renovation he gave us his word that things would
be fixed and that the only thing we needed to fix would be possible dead grass
coming from the large wood they were putting down to bring the equipment from
the driveway to the back yardThat was reasonable to us and we planned to
reseed and bring the grass back[redacted] was at our home for hours that night
measuring the pool and going over the plans for the new cementMy
husband was with him and asked if we could adjust the size of the cement so the
back portion would be a little narrower and the extra space would be put at the
end of the pool near the steps to have room for chairsHe said that was
fine and was a good idea but he was going to have a man come out to actually
map out the shape of the cementWhere the extra cement was put was supposed
to be rounded to match the rest of the outline of the poolHe certainly was
the salesperson they neededHe convinced us that the extra money we
would spend would be worth it and we would end up with something to be proud
ofHe assured us that that was the attitude of the senior owners
Now
to respond to the many untruths stated in their response:
The
dumpster in the driveway:
Not on boards as they
state...if there was wood underneath it was hidden from sightWhen
removing the dumpster, there was no care taken...If they thought that their boards
(?) were wet why did they move the dumpster? I am sure this is not the first
time that had to bring in and take out a large dumpsterIt had been dry
for several days long enough for the supposed wood to dryWe watched the
dumpster be moved and it just cut four holes in the driveway as they dragged it
(8” x 1’ 10” x 1” deep, 4” x 10” x ½” deep, 3” x 9” x ½” deep, 3” x 8” x ½”)
Also the side of the driveway near the garage where they took their
equipment in and out they repeatedly drove over the edge of the driveway and it
kept cracking and the broken section was getting bigger (7’ 10” long x 1’ 3”
wide)I would like to repeat: [redacted] Calvitti assured us that there would
be boards put down to run the equipment back and forthThis was even
before the rain when we first spoke to him about how the demolition would
be doneThe word that made us laugh was 'divots'By definition a divot
is usually a golf term when a piece of turf is cut from the ground by the head
of a golf club, a small piece of grass cut out of a lawn and in Ireland a piece
of grass used to cover cottagesWe could not find any definition of
a large heavy dumpster being dragged along a macadam driveway causing 1-1/
foot hole and a few other odd holes deep enough to hold waterWe do
have pictures of the drive as they left it
The Fence: This fence was built to have the gates open into
the yardWe put movable panels to accommodate the large professional
mower that was used by the grass service we usedThere was not any
problem thenWhen they asked us if they could move the next section of
fence to accommodate their equipment if they needed to and we said yes but
reminded them that we have dogs and that the fence must be secure before they
left each day
We
took the dogs out front on leashes during the day when the fence was downWe
have pictures of how careless they were when they leftThey just laid
the section of fence against the standing piecesThey were not gone 1/
hour when the fence blew downWhen they were finished going in and out
we had to call every day to ask them to come back and put the fence back
togetherOf course our phone calls to [redacted] went unanswered but finally he
called back time and told us to call the office and [redacted] would make sure someone
would come back to fix the fence which by this time was in piecesA
gentleman finally came and did repair the damage they did for which we were grateful
and assumed that the rest of the damage done would be repaired
The Rain: yes there were days of rain and each day we
would get an e-mail giving us new dates when the work would be started
When the ground was dry, yes I called [redacted] to ask why there was so long a
gap after the ground was dryI was told that it was not the wet ground but
they had other jobs to complete before they got to usOf course it was
upsetting to find out we were low on their priority list and I was annoyed with
[redacted] because we were told that she would be the one to help us but all
she did was repeat that they had other jobs before usOf course we
called our salesman and left messages asking what was going on and why our
$17,job was such a low priority but he never returned our call after the
time he told us to deal with [redacted] only and that was getting us nowhere fast
They
said I called on the first day of the dry out period and that is trueI
wanted to know how long after the dry out period would the work begin
Again I was told by [redacted] that there were other jobs ahead of ours and she
would e-mail us a new start date and she didIt sounds so horrible that
I was verbally abusive to the "scheduling staff” which was [redacted] but that
is not trueYes, I wanted answers and could not get them from [redacted], she
just gave me a run-around and I know there was nothing to do because [redacted]
Calviti would not return our callsI was NOT abusive and anyone who
knows me would confirm that[redacted] did not have answers to my questions
and got annoyedAt that point I said goodbye and hung upIn that conversation
I did not hang up on her but I was totally disappointed in the service and work
from BHPI NEVER told anyone that [redacted] came out to see the property because he
did NOT...he would not even return our calls let alone come out here
Where that statement came from is a mystery to me but it does sound good
for [redacted] to say that.it lets the office off the hookWow from their
response we have way more power than we thoughtCan you believe that we
forced them to come out when it was not safe to work because of the rain?
All we wanted was to have the pool done properly as we were promised
The completion:
When the work was
(Completed?) **[redacted] did come out after numerous phone callsWe
showed him the major flaws in the workmanship and the cut wires from the pool
to the pool apparatus, the corner of the pool that was supposed to be rounded
to match the lines of the pool that work was complete on the corner it was
horribly inferiorIt was just chiseled out to make that square round
It was not smoothed out like the other corners and it had many sharp
edges which were dangerousAfter numerous calls someone came and
smoothed out the edge When **[redacted] states that we were not happy with
the edgeThis was not an afterthought on our part, it was rounded in the original
designHe was not doing us a favor as he implied but he was correcting a
mistake made by BHPIt was a nice covbut not true**
[redacted] states that the copper wire was not stated by us but as we walked
around the pool the wire was laying on top of the grass in a pileAt
that point we did not know that it was a ground wire and it was dangerous
We were told that by the townshipWhen **[redacted] sent people to
fix the incomplete work, he choose to fix the copper wiring even though he
states we did not mention itHe knew how dangerous it was
The Pool inspection:
There is a contradiction
in **[redacted]’ statementHe stated that our observations of rust
spots and pieces of the concrete falling into the pool were "unfounded"
We have the pieces of cement saved and more and more each day are breaking off
into the poolIt sometimes interferes
with the running of the “Dolphin” which cleans the poolAlso, each edge is
unfinished to make it smoothIt is a
very sloppy lookOn our street there
are many pools so when we were having the renovation done they would stop to
see what we were having done and when they saw the destruction done they were
shockedThe piece that holds the tiles
on which we told **[redacted] had rust marks .he stated that was not rustIt was the finishBUT he did tell [redacted] that that piece was
not???Waterproof???? He advised us to not let the water get above that point it
would undermine the deckingWe would
not fill the pool that much but what about a heavy rainfall which is out of our
control what do we do? What kind of
material for a swimming pool is ‘not
waterproof’? And why would they use that and take a chance of “undermining” the
work they put inA lot of the comments
from their website stated that they did not follow up with legitimate
complaints about their workThey had their money so they did not bother to
answer the clients
The Final Day….Completion?
On
6-22-they stated that the job was completedWhat they
failed to mention was that the last phase of the project was to be done after
we paid $1,I had an emergency early
in the morning and I told [redacted] I would be home in hour and he told me
nothing would be done until they got the $1,final paymentI got a call from the neighbor that there was
a man sitting on the diving board for hours talking on his cell phoneAt that
point I was terribly upset with BHP so I called [redacted] and explained our
situation and I wanted to just stop everything until we could get things worked
outThe response I got from [redacted] that if we interfered with the finish of the
job we would be FINEDI told her the
concerns we had about the damage done to our property, she said the same thing
over and over that no way we were we getting nothing done without the moneyAt that point in total frustration I said the
conversation was stupid I NEVER called her stupidAnd I hung upWe decided that if BHP had no integrity, that
we didI called [redacted] and told him
his check was in the mailboxIt was
picked up but nothing was doneThe
worker left and did not power wash the pool
We did it ourselves and there was still some cement left on the tiles
Everything
in this response is true and many of the statements have pictures to prove our
responseWe would be happy to supply
these pictures if necessaryWe are
sorry that our response is so long but we needed to address the lies put out by
BHPIt is sad that a company operates
with no integrity or work ethicsI
repeat that I spoke to the older **.Calvitti and he assured me he would make
things rightIf he was given wrong
information he could not make the promise to do the best job for usTo say the
least we feel used and scammedThis may
not be true but it proves the true facts
Here
is what we are left with: broken
round stepping stone pavers; a trench 80’
x 3’ x 1’ where the ground is so compressed that nothing will grow there and
water lays there and becomes rancid; and a driveway with numerous holes and deep scrapes that need to be repaired and/or refinished
Edges of the pool pavers that were not completed with the cement
We
never expected to have to spend thousands of dollars in repairs over and above
the $17,for the pool renovationsIf
[redacted] Calvitti or anyone had given us a true indication of the damage that was
possible, we would never have signed the contractThis is where the omissions of the truth
began and where we were duped**
[redacted] also told us that if when the cement men were there, they would have
poured new 3’x3’ cement pieces since their equipment cracked them both in half
These were part of the walkway from the fence gate door leading to the patioHe
said it was too late since the job was doneThere were some very nice workman that were
here but no one from BHP came to check on themWith all the obvious damage,
the house will not be able to be put on the market which puts us in a monetary
crisesWe really need to sell this
house but thanks to BHP we cannot
We
are so thankful to your organization for all you do to help the consumerWe don’t know what we would have done without
you, I suppose just be another victim of a scam and an injustice brought on by
a company with no pride in their work and no integrity to back it upWe are
sad that the response to you had Very Little Truth in it and even that was
distorted
