Complaint: [redacted] I am rejecting this response because: The fence is not built according to the specifications given the contractor It is not my fault that even with two attempts the fence is not correct I may have to replace the fence because the current [redacted] HOA Board is strict Within the last two years, others have had to replace the fence because the drawings were not followed Although some other fences are such that they have not followed the HOA specifications, they are grandfathered in , approved by other previous Boards The current Board is different At this time I would like a reimbursement of $1,from Camden Creek for materials paid on the second attempt to build the correct fence The agreement for the funds which I did not have to pay because of the poor job done on the first attempt was a good faith offering based on Camden Creeks promise they would build the fence correctly the second time Camden Creek said they fired the crew that build the first fence Pickets were crooked and rails not level along with picket spacing 4.5-inches when the spec called for 4" OC The second time the fence was built the picket spacing is to inches when the spec called for inches OC In addition I would like $to replace the East gate because it is not correct and a sloppy job If I have to replace the fence because the HOA does not approve in the spring I will file a small claims for the cost of replacing the fence and the $1,additional materials for a breach of agreement on the second fence attempt.Sincerely, [redacted]

Camden Creek built a fence for the homeowner finished originally on 03/21/2016.  During the completion of the work, the homeowner made some valid observations as to issues with the fence.  As per email (attachment page 1) from homeowner sent 03/21, The homeowner stated that he had not...

given my worker a check, and that a section of fence was "skewed" or "twisted" on the East side of his home, and it needed to be fixed before he handed over the check that was "written and ready to go".  He asked if we could complete it that day, and that "otherwise, everything is great." I agreed to fix it, and we did, along with other items that the homeowner did not request, but we felt it the right thing to do to make the fence look as good as possible:  Replaced brackets on corner sections with custom built angled brackets instead of straight ones, used custom matched paint to his powder coating for touch-up (usually we use a generic brand that matches fairly closely). 
As per email sent 03/24/2016 (attachment page 2), Homeowner stated that the rework looked good. He then requested more items to be repaired, and again that we needed to fix some posts that were out of alignment before he would pay us the final amount.  I agreed to repair the item, and that I was sorry that I did not notice it when I was at his property on the prior visit.  
On 03/26/2016, Homeowner sent another email (attachment page 3 and 4) stating that his dogs had gotten out through the fence, and demanded that we rebuild the fence to match the HOA specs.  He stated that the vertical pickets were spaced 4.5 to 4.75" apart instead of 4", and that the HOA was going to make him take down the entire fence and redo it.  He also demanded that we re-set the posts on each side of his property to make them in line with his neighbor’s fences, otherwise we were to give him a refund.  As a normal practice, open metal panels are welded to a TYPICAL spec.  This is shown on most any blueprint drawings, but if not, it is known in the industry that spacing is close to the actual measurement but can vary slightly.  This was explained to the homeowner during a walkthrough just before we re-built the fence.  It was also explained that we would go the extra mile and even make the spacing on the vertical pickets slightly smaller than the maximum allowed to ensure that they were all within the expected spacing by the HOA.  The homeowner agreed to this and seemed very happy with the fact that we would do this since he was worried about his dogs being able to get out of his yard.  I explained that the reason that the posts were not in line with the neighbors fences was because the neighbors fences were built offset from the property line (on to their side), and that lining up the posts may put the posts on the neighbor’s property.  Upon further inspection of this I realized that this was not entirely correct on one side (West), so I agreed that the posts needed to be moved. We also agreed to make the posts on the right side straighter.
Attachment Page 4 and 5- 03/26/2016:  I agreed to rebuild the fence to match these requests, and admitted that it was possible that our fabrication process had failed and gone outside the guidelines of the normal variances in spacing.  I told him that we would prefer to redo the fence but we welcomed his choice to find another contractor if he would prefer.  I again apologized for the mix up, and assured him that we would do everything we could to satisfy his HAO.  The homeowner agreed that he would like us to take care of it, and admitted that the fences around him were not to the same specification as they were grandfathered in.  He then stated that he would first check with the HOA to see if they would accept the fence as is. I responded stating that we would definitely take care of him, and would wait to hear from him.
Attachment page 6- 03/28/2016:  Homeowner states that “The fence is acceptable to [redacted] HOA. Consequently, the fence is okay by (homeowner) & I”.  However he then asked us to straighten another post on the East side of the home, and touch up some paint that may have been missed.  Once done, he would pay me. I did the repair and the homeowner paid the remaining portion of the balance. Upon resuming the requested repairs, I noticed that the gate on the East side of the home was not straight.  I informed the homeowner of this and offered to rebuild the gate in order to fix this.  The gate was out of alignment by approximately 1”, so I did not feel right leaving it that way.  This was part of the miss fabrication discussed before.  I did this as a token of good faith that we wanted to do the best work possible.
Attachment page 7- 04/14/2016:  Homeowner states that one of his neighbors complained to the HOA board.  He demanded for us to now rebuild the fence with spacing on pickets “no greater than 4” o.c. (3.5”spacing)”.  He agreed that since he approved the fence he would be willing to pay materials costs only to redo the project (no profit).  This is curious since, if the HOA had in fact approved the original fence (as homeowner stated in email attachment page 6), they would not be asking for the fence to be redone.  Knowing this, I still agreed to his terms in order to attempt to make him a happy customer.  I confirmed that we would build them with no greater than 4” on center, and would in fact favor the spacing even smaller to ensure that none of them were less.  He agreed and we commenced re-fabricating the panels, as well as moving posts to be more in line with the neighbor’s fences as per his request, even though he had approved prior that is was acceptable to him, again to go above and beyond for the homeowner.
05/27/2016: We completed the redo of the fence as quickly as manufacturing and powder coating would allow. We felt homeowners were very happy with the outcome.  Homeowner even asked us to do additional work for him attaching a screen to the older portions of his fence that still have larger spacing that his dogs could get through.  We completed that item, and customer agreed that everything was acceptable. Upon picking up the check I again apologized for the mix up and let him know that we were glad we could work something out.  Homeowner acknowledged that the job looked good and was glad it all worked out (paraphrase).
Attachment page 8- 07/19/2016: Homeowner requested that we drop off a post cap to him as one was missing.  He later noted that it was not one that we had installed but rather on of the caps on the existing fence.  He thought he had overpaid his bill by $10.00, so he figured I could drop one off.  I was not aware of any overpayment, but I told him I would drop of a cap as soon as possible. 
Attachment page 8 and 9- 07/23/2016- Customer sent email saying we had not dropped off cap yet.  We had not, because we had just simply not been able to get one there yet.  I had scheduled to have a guy drop it the following week when we were in the area, thus the response that we would get one to him ASAP.  Homeowner demanded that we drop it off Monday 7/25, without checking as to whether or not that would be convenient to our schedule.  He then proceeded to demand that we re-build his gate for now a 3rd time, stating that it was never straight to begin with.  This is incorrect, as we did a walkthrough prior to him paying me for the work, and he accepted it as satisfactory.  I replied and explained that I had no problem giving him and extra post cap, but I just could not rebuild his gate a 4th time.  I offered to adjust the gate if it was not latching properly, as that was definitely covered under warranty.  I explained that he was important to me as a customer, but I had to draw a line and could no longer replace things, especially since he had agreed that it looked good. 
Attachment page 10- 07/26/2016- Homeowner responded by demanding “GET THE CAP HERE THIS WEEK”.  Later that day he typed a longer response now demanding that I return ALL of the money for his project.  He stated that the spacing was still wrong, even though we had both agreed before that I would make the spacing slightly smaller to ensure it was “no greater than 4” o.c. (3.5” spacing) as per his request.  We had also both agreed that we would favor the spacing smaller to ensure it was well within these parameters.  Homeowner continued to threaten that he was a retired attorney and would sue me in Ada County court if I did not heed to his demands. 
07/29/2016 and 07/30/2016- We delivered his cap as he demanded and without charge. We also took a picture of the gate in question.  We confirmed that it was sagging slightly due to common gravity, just as I had explained to him in my response to his demand to rebuild gate.  It is a simple fix and does NOT require rebuilding the entire gate once again.  He went on to insult me as a disorganized contractor (despite our obvious attempt to do any and everything possible to make him happy), and stated that it wasn’t worth his time to pursue it any further.  (Attachment page 11)
October 2016: We received this complaint, even though we DID offer to adjust the gate as per our email on 07/25/216.  He is now stating that it does not matter what we do, even if we try to resolve this through the Revdex.com He states that he will be complaining to the contractor’s board, and suing me.  He threatened this before, then said he changed his mind. Now is threatening again.  We have done all we can to attempt to make homeowner happy. We did NOT walk away from warranty, in fact we offered to come adjust the gate for him, despite his claims as proven in attachment page 9-07/25/2016. He refused to allow this to be the resolution but demanded we replace the entire gate anyway, or reimburse him the entire amount of his job.  This is not reasonable.  Adjusting the gate is a reasonable and honest resolution to the problem.  If it is determined that gate is out of adjustment due to neglect or outside sources, homeowner will be responsible for costs to fix it.  The gate is not in need of being replaced.  We are still at this point offering to adjust the gate, but not to rebuild it.
We have omitted all names, phone numbers, and address to protect homeowner’s identity.  We have searched for a reasonable resolution to this problem and hope that this is a means to an end.  We fear that the homeowner described above has malice towards us however, and we do not feel as though he will accept this reasonable resolution.

At this time I would like a reimbursement of $1,250 from Camden Creek for materials paid on the second attempt to build the correct fence.  The agreement for the funds which I did not have to pay because of the poor job done on the first attempt was a good faith offering based on Camden Creeks promise they would build the fence correctly the second time.  Camden Creek said they fired the crew that build the first fence.  Pickets were crooked and rails not level along with picket spacing 4.5-3.75 inches when the spec called for 4" OC.  The second time the fence was built the picket spacing is 3.25 to 3.5 inches when the spec called for 4 inches OC.  In addition I would like $250 to replace the East gate because it is not correct and a sloppy job.
If I have to replace the fence because the HOA does not approve in the spring I will file a small claims for the cost of replacing the fence and the $1,000 additional materials for a breach of agreement on the second fence attempt.Sincerely,[redacted]
