The complainant states that per the lease agreement we failed to comply with them filing an inspection report
Our lease does not require such inspection report be filed by either party; it only states that resident can accompany us on a
move out inspection walkWe are more than happy to conduct a move out inspection with a resident should they schedule this with the appropriate team member which in this case was not done due to the residents not properly scheduling this with our teamThe resident called our office at the end of the day on 5/29/without prior notification and we did not have a qualified team member available at that timeLater that same day as the Community was closing the resident stopped by the office insisting on a walk through so our Leasing team member, as a courtesy, walked the apartment with the residentOur team member clearly communicated to the resident that he was not trained to perform an official move out inspection nor was he able to determine any final damage charges at that time
The complainant states that pulling back the carpet was not included in the lease
The actual process we use to determine damage is not defined in the lease and is not required to be included in a lease agreementIt was determined that the carpet had been damaged by pet urine on 6/1/when a qualified team member performed a detailed inspection which did include pulling the carpet back to identify were the smell of urine was coming fromRegardless of what process was used the fact is that the resident did indeed damage brand new carpet of which they were the first to occupy their apartment and therefore are 100% responsiblePhotos are attached to show the urine stains on the back of the carpet
The complainant is not asking for any resolution regarding his pet being deemed aggressive therefore this issue is considered resolved at this timeFor reference however the residents were never*** with eviction, they were instead asked that they keep their pet away from other resident's pets to avoid any further issues

Our lease states that the resident shall accompany the owner on an inspection of the unit to verify the physical condition of the unit and to assist the owner in completing a unit inspection reportWe called the leasing office at 4:on 05/29/to schedule an inspection and they stated that no one was available but when I went down to the office, there was staff thereWe also asked to come back on the day that they were going to inspect our unit but they stated that there was no way that could happen per*** (leasing agent), so there was no way for us to verify the damage to the carpet or to verify that was even our unit that the pictures were taken in since we were denied the opportunity to inspect the unit with the owner
Also the fact that our unit was trashed by construction or maintenance when we moved inThere were holes in the wall, food and drinks left around the unit and marks on the walls
The owner states that we are 100% responsible for the damage our dog did, however, living there for months not once did my dog urinate inside our unit, which makes it impossible to smell urineAs a precaution, we also had the carpets and hardwood professionally cleaned to avoid the owner from retaliating against us stating that our unit was not clean
We do not accept the owners response due to the fact that we made every effort to inspect the unit with the owner to verify any damage, yet we were denied, so we were unable to verify that, that is our unit photos were taken in
Also upon move in, we were not able to pull back the carpet to verify there was no prior damage, and with the condition our unit was in upon move in makes it more probable than not, that the damage to the carpet was already there, if in fact that was our unit that the photos were taken in
With the issue with our pet being attacked, we called *** and she stated that if we were to bring up the issue any further we would be asked to move outNever did they once ask us to keep our pet away from other pets
During our day notice we stated that the reason for terminating our lease was because we were*** with eviction, and *** by *** staffOn the official move out letter prepared by one ***, it states that our move out reason was Management requestWe were never asked by management to leave, which makes *** report and invalid for the sole purpose of withholding a bad review

The rebuttal states that we denied them the opportunity to inspect the apartment with the owner
Our *** Resident Move Out Instructions state that the Final Inspection of the Apartment Home will be made only after the resident has completely moved outIt also states that if you would like to schedule a walk-through of the Apartment Home, please contact a member of the office staffOur lease states that In any event, Resident agrees to vacate the Unit before 5:p.mon the last day of the term of this Lease, or any extensions or renewalsThe resident called our office on their scheduled move out date 5/29/at approximately 4:p.mwithout any prior notification to request a final walk throughThere was not a qualified team member available to complete the walk through at that timeThe resident came into the office later that day at approximately 6:p.mrequesting a walk through again and to turn in keysA Leasing team member walked the apartment as a courtesy to the resident and clearly communicated to the resident that he was not trained to perform an official move out inspection nor was he able to determine any final damage charges at that time
The resident states that the unit was trashed by construction or maintenance when they moved in
Upon move in the resident was provided with an Inventory and Condition Form documenting any damage to the unit, equipment or appliances in the unitThe resident completed and signed this form noting only minor items such as chips or scratches throughout the unitFor the record this was a brand new apartment that had never been lived in beforeMany of the items listed were taken care of by maintenance once the resident granted us permission to enter the apartment
As stated before the complaint is not asking for any resolution regarding his pet being deemed aggressive therefore this issue is considered resolved at this time

screening. To complete the online application he would have had to agree to the following. "If the applicant is required to pay a deposit and finds it necessary to cancel this Application prior to signing a Lease Contract, the deposit will be refunded, regardless of approval status. Application and administrative fees are to be paid at time of rental application and are non-refundable. Application fees are charged per applicant." This is stated online and the applicant is not able to move forward with applying without agreeing to this. Tell us why here...
