This weekend Mrs [redacted] took to social media posting pictures of me slandering me taking this to a different level. I had already spoke to my lawyer prior to all this I can assure you that I will be at his office tomorrow and Mrs [redacted] will receive notfications from him. I will also forward all information ie his response to her as soon as he gives it to me.

I first would like to respond that over the last 25 years of being in business this is a first having a compliant filed against me with the Revdex.com. Next I would like to address all of Mrs [redacted]s compliants one by one in numerical order.1) Yes Mrs [redacted] did hire me in late August to do repairs to...

her home that had been caused by an renter. When I accepted the job we spoke and she did ask how long the repairs would take I did tell her 5-6 weeks. But at this time one I was told that there was no hurry they had to sell the house they where in so really there was no time line. Next the job scope grew to removing fireplaces, walls, and various other items so with that the time line grew. In late November before Thanksgiving I was contacted by the [redacted]s asking for when I thought we would finish up. When I met with the clients I told them that I was not pushing the job to get done that I did not realize that there was a time line but with holidays and all I would try to get it complete by the first of the year. She is very correct in saying this time was not met either but what is failed to be mentioned is that I have messages saying how good things where moving and how good the work we where doing looked. At the beginning of January I was again asked when I would finish I gave a date of 1-25-16 which I believe reachable. During this time the temps dropped to sometimes below freezing with no heat in the house I contacted the client and told her I would fix the heat and needed to run it because paint wasnt drying the drywall mud was not drying and my guys refused to work in freezing cold temps. So no the house was not complete on the due date but again I have messages saved stating how the progress was moving along alot better just a week before I was informed that I was not to complete the job. I do not believe especially with three simple facts laid out that I was anyway in the wrong on the time taken 1)At first no real time line set 2) The scope changed greatly during the job 3) Unhealthy working conditions with freezing cold temps.2)Money that was given to me. Yes the amount of money that was given to me was $18000. But this job was though an insurance claim that the [redacted]s had submitted due to damage by a renter so let me see if I can explain how this worked out. In the early stages of bidding this job I was asked to come out and give an estimate on repairing the house I gave a verbal bid of 8-10000 based on what I was shown. Later I was contacted saying that the insurance company gave them $25000 to complete repairs. I met the the clients again at the house and the repairs plus installing windows a new hvac system remolding the bathroom and a few other items where added I told them I believed that we could do the job and stay in the budget it may go up to $30000 which they agreed to. I received an draw of $8000 to start the job with the agreement being that as I completed percentages of the job I would get draws. When the second draw come due I was then informed that a bank rep would have to come out and see if we where at the stage to get a draw but the bank would release $5000 which they did. We continued to work waiting for the inspections when the inspector finally showed up after several times of the client telling me that he would be there and me making special trips costing me time and money I finally got my inspection only to find out what the bank was looking for was not what my job scope was and had to get there scope of work to where they wanted it to receive a draw.(another cause for delay of work) we reached that point the inspector came and checked and another check was issued. So with all that being said when a check is issued for a draw it is because that level of work had been completed and that was being paid for. Next all the that the bank/insurance company has paid was 1099 to me so taxes on this money is paid by me that apox. amount $4500. 3) Receipts, the client has asked for receipts on the job and this is very true I have not gave any the reason is this job was as a lump bid the orginal scope to be completed for $25000-30000 not materials plus labor. What I pay for material and the labor to complete the job is not what the customer is going to pay if it was I could not make any money this goes the same for any company if I paid GM only what they paid to build my car then they would go out of business.

Complaint: [redacted]
I am rejecting this response because:
1. The scope of the project only grew because after we were told to "wait on deciding about the fireplace until the kitchen and bathroom were completed" the crew from CMM removed the existing fireplace the next day before a final decision had been made. It was also Mr. [redacted]'s decision to remove the wall that surrounded said fireplace. The other wall in the home that was removed was on the original estimate. Yes, when the crew from CMM would actually show up and work, we would use positive reinforcement hoping that it would increase productivity so that we could move into the home, unfortunately this did not work either.
2. We have no control over the inspectors. They were sent by the bank and outsourced to another company. You were told the same thing we were as to when they would be there. We can not control the fact that they cancelled appointments.
3. We are aware that we were paying for material and labor for a job. To date, we have still received NO information on where ANY of our funds have been spent. There is no information provided to show what funds remain due to any expenditures and Mr. [redacted] is still holding our unused funds. At this point, walls are still unfinished, windows unfinished, no flooring, no bathroom, no kitchen, and other issues. Even if this was a "lump sum job" there should still be funds left out of the $18,000 given to CMM. And yes, a $30,000 was mentioned, but we also have in writing where we did not want to go over $25,000 unless absolutely needed for something such as an HVAC. There is no way that all of this could be completed, including the labor, for what is left in the bank so I can not accept that there is no money left in our funds already given.
4. We have also requested from Mr. C[redacted] the name of individuals that were outsourced to do work such as the electrician who moved our electral box and fixed some wiring, as well as the name of the individual that he had to come check the structural integrity of a wall he removed. We have yet to be provided with the names of these individuals as asked.
5. There is still a HUGE pile of debris in the back yard. A debris bin was supposed to have arrived at the beginning of the job. It never did show up, nor was the debris removed from our property. We were told time and time again that the bin was coming, then that it wasn't, then that they were going to load it on a trailer to remove it.
6. There are also cost issues that Mr. [redacted] is failing to mention, that we had to make decisions to go with a lower quality product because he failed to inform us before there was no turning back. Mr. [redacted] said he could remove our kitchen windows (multiple windows behind the sink) and make one large unobstructed window. We agreed as we thought it would open the room. Only AFTER removing the windows and frames did he say "I forgot when I pulled these windows that a pane of glass this large will have to be tempered. That's going to be around $800. We can do that, or we can just install plexiglass." We decided on plexiglass to stay withing budget. May I add, that my kitchen window was removed a month before terminating Mr. [redacted]....I still have no kitchen window.

[redacted]
