We got into a contract with the consumer to build a three season roomIn the contract we had $electrical allowance which covered running wire outside, lighting and a plug in insideConsumer went and added plugs and lights in the garage and taking the light to be ran outside and added 6- plug ins and moved things aroundHe is welcome to make those changes however he has an allowance and would be responsible for anything above the allowanceWhen he changed how the lights were ran on the outside corners they were not wired to the power right and he blamed the electriciansWe were all done with the job and tried to collectWe sat with him at the kitchen table and I gave him the final bill and I took off the $for electricalI explained I would not negotiate with the electrical contractors for the additional work and changes Consumer said he would hold onto final payment until electrical was figured outA few months later he sent me the final paymentWhen I received the final payment I figured everything was settledA few months later a bill from the attorney came for the electricians and the consumer tried to negotiate with the electricians stating that they charged him too much for the extrasThe electrical company has taken the consumer to court and received a judgement and the consumer owes them money I believe the consumer has taken care of this with the electrical company

I am rejecting this response because:Notes 16Nov2016 Revdex.com Complaint # *** *** Response to Can Do Construction (Mr James R***) Rebuttal I have grouped comments by topic to reduce redundancy and shorten this response. The full, line-by-line rebuttal is attached. All text messages are addressed in another attachment. Please note the text message provided by Mr R*** contain personal information and phone numbers.The plumber did good work and was licensed. He did work on unrelated projects, one being the hall bath. The plumber left a broken tile in the hall bathroom unset. Mr R*** offered to set this single tile in the hall bath. I did not ask. He volunteered and he did set it.On the remodel for the shower, the plumber closed the left-hand water lines, removed the valve and shower fixture and re-plumbed the right-hand shower for a new valve and fixture, fixing leaks in both places.I had a problem with plumber's bill with being charged an undisclosed $re-stocking fee; and the plumber taking call after call while standing in my kitchen, telling me: 'I have to take this. It's from a customer.' The plumber was paid and was still talking on the phone when I closed the door behind him. He also brought the wrong fixture for the remodel shower. I did not check this before he left.I did not call Mr R*** about my negative plumber encounter. He called me about it, as the plumber did not understand why I would be upset. Mr R*** volunteered to talk with the plumber to see if he would swap the fixture for the correct style and install the new valve. The plumber refused. I took it back to the place of purchase and got it changed, a couple of weeks later.There are photos Mr R*** submitted, showing the shower drain during his demolition. All photos show either the original (30+ year-old) gray-colored, shower liner or pieces of the original shower liner left in place around the drain and the original drain. The photos I submitted show the shower liner put in by Mr R*** with the same 30+ year old drain. Mr R*** did install a new liner and it was a bit beat up by the demolitionMy photos show the issues with the liner and drain: differing heights of liner; screws through the liner into studs; liner not adhered to floor; drain not replaced (as is evidenced by the rust and style of drain); area around drain would allow water to leak under the house, and parts of the drain are missing. (R*** photos ending in 113531, & & *** photos ending in 0557, 0558, 0559, through 0572, and 0576).I have to ask: Why would a person spend thousands of dollars to remodel a shower with a leaking drain only to not have it replaced when it is easily accessed? I can purchase this part at Home Depot for $13. I did have the water line leaks repaired by a licensed plumber.Of all the issues with workmanship, the drain and liner are the most egregious, as it was hidden beneath the tile Mr R*** set. Water damage could have gone on for years causing structural and health issues due to mold formation. It was the demolition of the work Mr R*** performed that literally uncovered this problem. All texts have been addressed in a separate document Mr R*** had questions about the tile layout. I asked Mr R*** to clarify the design with the saleswoman as she designed the layout. To the best of my knowledge, he visited her or times for my project. One of these visits was to pick up the tile that he did not pick up. I felt the saleswoman would be able to explain the design first-hand, since I had never seen it other than on paper. The original drawing came from the tile saleswoman. I did not create the tile layout design. I saw no reason to play middle person and increase the chance of misunderstandingOn 16Sep2016, I did not know if Mr R*** was coming to work. I had expected the saleswoman from the tile store to come to my home at 6:am, on her way to work. We were going to layout some tiles so Mr R*** would have a visual of the slight slant to be used on the side walls. She was unable to make it; and I was unable to reach her by phone. I needed a day to handle personal matters. I canceled all appointments. I own this one day delay.On Monday, 19Sepin the late afternoon, I went to the tile store and the saleswoman showed me how the side-wall tile would look by arranging actual tile on a table to show to Mr R***. I did, on this same day, ask if he might be independently wealthy as the wealthy can afford to not work.Although Mr R*** attributes this beautiful design to me, it was created by the saleswoman at the tile store. The first time I saw it on a wall was when my shower was completed, on 07OctOn 23Sep2016, I was in the shower. He entered, or at least unlocked the door, because I had checked both locks to make sure both were locked just before I entered the shower as the shower is off the main hall, close to the entry door. When I went to open the door for Mr R***, the bottom lock was unlocked.Comments about how I looked are not relevant. I opened the garage door. There was no conversation. I asked, as he was getting into his truck, if he was going to work that day and he said no.Popularity is not relevant to this complaint. The complaint is about quality of workWe modified the Can Do Construction contract at time of signing. I bought mortar to be used because of the size of the tile. Sealer was included in the grout I purchased. This can be seen in the photos. Mr R*** did not offer reimbursement for these.Although tile arrived mid August, I had full-sized samples of the wall (12xinch) and floor (2xinch) tiles at the house. All wall tile samples were porcelain, large format, 12xinches. These samples were placed just outside the entry to the master bath and could have been examined at any time. Mr R*** had seen all the tile samples and made excellent recommendations as to size, color and composition. These samples were at the house during mold remediation, before any durock was installed. Experienced tile setters know to face the durock, rough side out, and to use mortar for large format tiles.I am not privy to the accounting practices of any contractor. Many small construction contractors use simple receiptsThe nico relocation was a recommendation from the new contractor. Just as I accepted many of Mr R***'s recommendations, I accepted this one.I was hopeful when I first complained directly to Mr R*** on 25Sep2016, requesting a response by 24Oct2016. I did not know, at that time, of the problems with the drain and liner.I filed my complaint with the Revdex.com on 25OctI received a request for photos from the Revdex.com and sent them on 26OctMr R*** stated he had received my complaint 28Sepasking for a response by 24Oct2016. He had just under weeks to respond and chose to mail his check to me on Friday, 21Oct2016.I have a PO Box so I do not have to pick up mail daily. His response arrive after I filed my complaint with the Revdex.com, on 25Oct2016.Mr R*** has not addressed all the issues I originally complained about: hump in floor higher than curb; large grout joints; gaps in durock; broken bathroom floor tile; new liner not placed properly; screws through new liner into studs; new liner not adhered to floor; drain pieces not glued together; area surrounding drain not filled in; missing drain pieces; 30-plus-year-old drain not replaced, and wasted tile.I acted in good faith. I paid Mr R*** $up front. I waited more than weeks for him to finish the job. When I attempted to get information about completion, he walked off the job.In addition to the $Mr R*** received, I have laid out an additional $for the new contractor($2280), durock ($76), liner ($42), new tile ($31), wasted tile ($60) and small miscellaneous supplies ($12). If all had gone as planned, Mr R*** would have received an additional $at completion of the job.I have requested a refund of $due to the poor quality of work, work that had to be redone, and materials that had to be repurchased to finish the remodel. This would still compensate Mr R*** $for the original demolition of the shower, haul-off of debris and mold remediation.The new contractors completed the job in days

On July 13, 2016, as you can see from the contract that Ms*** has submitted to you with the agreed work to be done to her bathroomAs I started the project Ms*** informed me that she had ***, the plumber, doing repairs to the plumbing in the showerI advised Ms*** that I knew
*** and that he does good workFrom the time I started demoing the above-said shower, photos were taken that are now sent to you enabling you to view where the water leak was from the existing double sided shower plumbing (corrected by ***)The reason I point this out is that Ms*** has stated that I did not replace a year old drain that water could go past the pipe and cause damage knowing that she had water damage to the outside wall of the above-said shower caused from the water lines leaking, as shown in photos to be attachedMs*** had *** the plumber doing other repairs to the hall bathroom shower which were not completedMs*** in time had problems dealing with *** the plumber and as *** said she finally slammed the door on himFrom that point Ms*** had me calling *** to find out information about replacement of parts that he had purchased for replacement in the showersThe drama seemed to be getting out of handI will be attaching all texts between Ms*** and myself which show that any time that Ms*** had a concern, I made sure to address it as well as the texts will show that as per Ms*** I was going back and forth with *** from Hacienda Carpet and Tile trying to figure out how the two ladies came up with the tile design and tile that I was to installMs*** had me go several times to talk with *** to get it resolved as can be seen in the texts and anytime I would go and talk to *** she would assure me that Ms*** was the one that came up with the design of the tile to be installed*** assured me everytime that Ms*** is the one who came up with the design and should have been able to show me how she wanted it installed, as opposed to running back and forthMy stress level and the drama seemed to increase to the point where on 9/16/*** and I received a text from Ms*** once again instructing us to get together and figure out how to install the tile design and not to show up at her house and that she was turning off her phoneOn 9/20/I responded to Ms***'s question on a text in full detail and reassured her in the text that I would be there on Friday 9/23/On 9/20/when talking with *** at Hacienda, *** informed me that Ms*** had been in there and asked *** if I was independently wealthyOn 9/23/I showed up again to Ms***'s home, knocked on the door and rang the bell and there was no answerI then texted Ms*** (texts will corroborate what I'm saying)Finally Ms*** came to the door with a very displeasing lookI greeted her and asked if she could open the garage door where my tools wereAt that point I had all the stress that I was willing to take as I explained to ***, every visit I had with her as she reciprocated the same feeling that she was dealing with from Ms***On 9/28/I received a certified letter from Ms*** stating that everything had to be redoneShe had added up the costs of the work that I had done and requested to please send a check in the amount of $to the above PO Box by 24Oct2016, which as you can see from the attached check sent by certified mail that I have cooperated with Ms*** so that as she said "I am hopeful that we can resolve this without escalationBest of Luck, *** *** *** (Ms)"I have gone over the pictures and the information that Ms*** has provided to the Revdex.com with her attached documentsI find it par for the course that the copy of our contract that she sent to you has written changes as well as according to the contract there was nothing wrong with the way the durarock was installed or the mastic that I was going to use on the tileOne important fact to clear this matter up is that the tile had not even been decided on or ordered from Ms*** until after the durarock had been installed, but yet Ms*** would like to say that everything was done wrongAs I said she attached a copy of the contract between her and myself detailing line by line the work to be done whereas her attached copy of the bill she paid to the other contractor shows nothing more than demo and install shower, with no tax charged or any other informationAlso attached you will find two drawings that were given to me by Ms*** of her design and size and layout of the tile, which again you can see by the second rendering with the added information in red and yellow questioning the amount of material and if the right material was sentSeeing as how I did not order this, I could not answer her, but once again she instructed me to go confer with ***The pictures that she sent you all posted on 10/26/all are time-stamped from 5:a.mI have followed what Ms*** requested as to the reimbursement and believe that because she had not received the check by 10/24/she took it upon herself to wake up on 10/25/with a mission to "escalate" this situationI say this because she has the information that she requested for reimbursement figuring in her "losses", as she put itAs I have talked with *** from the Revdex.com, I confirmed that the certified letter I sent with the check was received to the PO Box she requested on 10/25/and the certified mail receipt that I received showed that Ms*** picked up the letter days after thatOne other note, I am glad to see the final shower picture Ms*** sent which actually shows once again how she has changed her design of the nicho from the drawing I was given to the final completed showerI acted in good faith to resolve thisI'm sad that this has gone so
