the clear understanding that the home would be removed off the market and held exclusively for him. He did pay the remainder of the deposit on 1/28/16. It was clearly explained to Mr [redacted] that if he did not move in his deposit would be forfeited because we took the house off the market. We turned away multiple email inquiries and phone inquiries on the house because Mr [redacted] had made the arrangements to rent the home by 2/12/16. Mr. Burrs actions has caused the owner and my company a loss of potential income from potential renters we turned away because he asked us to hold the home for him.

It was not stated to me that if we did not move in our deposit would not be refunded if that was told to us we would not have rented the house in the first place no one told us that if we did not move in we wouldn't get our deposit back or we would not have done it

This is Her she's fiance. I was with him when we first turned in our applications and I was the one replying to most of the text messages between the owner and not once did he say that neither the [redacted] or any of her staff. If they had told us that we never would have agreed to give them the deposit also they failed to tell us that the house was two buildings down from a men's homeless shelter which is a big concern sense we have a 6 year old child living with us I would rather her not end up kidnapped and found dead. We will be taking them to small claims court. [redacted] stated in the voice mail first that it is a security deposit then changes her words and says holding deposit. It was never a holding deposit also my fiance [redacted] has looked it is that a security deposit is refundable a holding deposit is not there for sense we paid a security deposit we should get it back it. I would also like to see it in writing where we agreed that we knew we would not get it back sense such things should be out in writing!
