Complaint: [redacted] I am rejecting this response because: Bella Sposa has not addressed my concern at allMy sisters current size and the dress not fitting is not my complaintMy complaint lies with Bella Sposa going against the sizing recommendation of [redacted] (I have included the sizing chart as an attachment Her original measurements are listed in my original complaint) and denying her access to her size before purchaseBella Sposa ordered a size too small for the measurements taken at the time of purchase (which were taken by a Bella Sposa employee and written on her receipt) They continually ignores my concern and focuses on body shaming my sister I would like the *ordering [redacted] error to be addressed They went against the ordering recommendations set forth by [redacted] Regards, [redacted]

Our experience with the *** line has led us to determine that this was the best size choice for her measurements at the time that the order was placedUnfortunately, by the time the group order had arrived (months later), the customers measurements had changed and she no longer fit into the
size from the original orderAs our contract states ”Measurements are taken at the time of order and a size is determined based on the manufacturer size chartBella Sposa is not responsible for weight loss/gain during the time period from order to delivery“Each bullet point is read to the customer before they signAs of 8/6/2016, the customer had now increased 3.5” in her bust, 4” in her waist and 3” in her hips.Bella Sposa offered two options for solution to the customer (1) We would pay the cost of the $rush so that a replacement dress could arrive in time for the wear date and (2) to let out the original dress as much as possible to either meet or exceed the waist measurement noted on the receipt at the time of order.The customer rejected option Option was successfully performed by Bella Sposa at no cost

I am rejecting this response because:Although Renee V***r (Store Owner) indicates that the complaint is already handled, that is not true. I asked for a
refund multiple times since she ruined the dress with alterations, in which she refused. So I went through my two banks (I paid for the dress on two separate cards) and filed disputes. I was issued temporary credits until the bank could reach out to the merchant. Renee fought back with the bank and provided documentation of the contract. Because there was a contract the bank will be crediting her account on 1/4/2016. Please see attached document. Since it is a bank they cannot get into the details of what occurred.Once she receives the money back from the bank, or before they issue a credit, I request that a refund be given to me. This is for the one charge of $737.50. My other bank is a smaller bank, so they have not yet sent me documentation on their decision for the other $737.50.The right thing to do is for the owner of Bella Sposa Bridal to refund the money for the dress. Statutory rights state: "if you have bought something on the basis of the seller’s description or a sample, you should expect the item to conform exactly to that description or sampleIf it does not, you have the right to reject the goods, demand a full refund and possibly claim damagesThis is still the case even where you have selected or examined the items for yourself before buying them”.
