Review: Cannondale hasn't fulfilled their obligations under both the terms of the contract, and what was agreed to via phone (verbal agreement). They sold us a generator and assured us that every part of the process would be managed by them (this included trenches needed, town approvals, gas lines run, electric run, etc.) They also assured us any damage done to our wall while installing electrical generator panel would be repaired. They also assured us the unit would be installed within a month. When the contract came, it was over $2,000 of what they agreed to verbally (I did not sign it but they had already started the process based on what they told me via phone, which was different than the contract that arrived subsequent to our conversation). 75% of a $12,000+ invoice has been sent. They dug the trench and left it open. They didn't finish. They promised to handle ALL propane related activities but they rescinded after 75% had been paid and said it was up to [redacted] (even though we specifically agreed NOT to include [redacted]). Once it was clear they weren't taking care of the issue in a timely way, we called in favors at [redacted] and got them to run the line for us. Cannondale then said they had to wait for town approval, even though they never requested town inspection as promised. So WE called in favors with the town and had the lines inspected. We then told Cannondale the lines were inspected and to turn on the generator and backfill the trench, but they are refusing to come until "next week" (even though there's a nor'easter storm coming and it is very likely we will lose power). We have demanded they backfill the trench as it's a major hazard (we have 2 young toddlers under age 4 and a dog who use the property) but they are ignoring our demands. They have ignored our demands to revise the amount owed on the contract since WE took care of the propane and town approvals on our own, and this was supposed to be included in contract. They also have not repaired the wall they damaged.Desired Settlement: IF they finish the job from here, I propose we do not owe Cannondale the remaining 25% on the unsigned contract and they can keep the 75% ($9,000+) we have already paid. We have done most of their leg work...with the gas company, the town, etc.IF we lose power and don't have working generator, I propose we pay only for the unit at wholesale and get refunded the remainder of our payment.IF someone gets hurt with open trench and open electrical and gas lines, I propose we get 10x damages.

Mrs. [redacted] was very angry that we did not coordinate her Propane installation. It very clearly indicated in her proposal that NO propane work was included. Despite this, she was insistent that it was our responsibility to arrange that work. While we tried to offer the services of our sub-contractor, Mrs. [redacted] was able to get her Gas company to do the work for her instead. She filed this complaint thinking that we would not be able to finish the installation before Thanksgiving. Although no such deadline was ever promised, we re-arranged previously scheduled work, brought out a tent to start the unit in a downpour, and finished the work before the Holiday. Mrs. [redacted] emailed me on 12/9/13 to say she was withdrawing the complaint.
