To whom it may concern:                I am writing to you in response to the complaint filed by Mr. [redacted] against our company.  We do not dispute the cause of his loss.  Our driver failed to properly secure his vehicle and it did roll into...

Mr. [redacted]’s boat and trailer, causing them damage.  However, we do dispute virtually all of the rest of his statement.                First, this loss did not occur in April.  It occurred in May.  Second, we promptly reported this to our insurance carrier for them to handle.  Third, in his complaint, he states that “Aside from the employee who viewed the damage, there has been no communication”.  This statement is blatantly incorrect.  Not only did the insurance carrier, Commerce, have someone go out and view the damage to his boat, they have also advised us that they have had numerous communications with Mr. [redacted], both verbally over the phone and in writing via email.  In addition, we have had several phone and email communications back and forth with Mr. [redacted], despite the fact that he should be dealing directly with our insurer.                And my understanding is that the reason that his claim has not yet been settled is for two reasons:  1) Commerce has offered him a settlement on the boat and trailer that is slightly less than the estimate of damages that his boat yard presented, primarily due to some depreciation that they applied; and 2) after making the offer for the repairs of the boat and trailer, Mr. [redacted] stated that there was also damage to some landscaping and lawn furniture that he had not previously presented.                In his letter, he states that his damages are $16,500.  My understanding is that the insurance carrier’s settlement offer is within $1,000 of this amount.  And not only is that amount out of my control, but whether or not he accepts it is also.                Should you have any questions on this, please feel free to contact us.  Thank you.  [redacted]President/Owner[redacted]Cape Cod Oil Company[redacted]
