Initial Business Response /* (1000, 10, 2016/09/12) */
Contact Name and Title: *** ***, Owner

Contact Email: ***@stewprop.com
Thanks for the chance to respond to this very inaccurate postingTo begin with, Mr*** life was never "in danger." He is
referring to a small fire that broke out in a apartment unit near his that was quickly extinguished by the fire departmentWe immediately sent in cleanup crews to remove any remaining smoke remainsAnd we did fix the roofs, a job that was planned as part of our regular preventative maintenance programs, but no worker ever started until after am
What most upsets Mr*** is that we are asking him to live up to the terms of his lease agreementHe has had a recent job re-location, and and threatened, in two separate emails on (July and August 14) that if we didn't let him out of his lease with no penalty, he would report this minor situation to review sites and the Revdex.com in a very negative light
The buyout clause he wants waived is very standard in apartment leases, and is part of our lease, which is written by and distributed by the Illinois Board of Realtors/National Apartment AssociationWaiving this clause for any one resident could result in a violation of the United States Department of Housing Fair Housing Act, and we could be subject to stiff civil penalties
In conclusion, while this small fire was a minor convenience to Mr***, and we are sorry, we don't appreciate his grossly distorted version of the events that happened in retaliation for his desire to have his termination fee waived, even though he signed a lease clearly agreeing to it
Initial Consumer Rebuttal /* (3000, 12, 2016/09/21) */
(The consumer indicated he/she DID NOT accept the response from the business.)
To update, in addition to everything stated, the owner appears to be refusing to return the full security deposit we paid presumably out of retribution for my review aboveHe is withholding a large chunk of our deposit for carpet cleaning even though we were promised a free carpet cleaning with our lease renewal and were told we wouldn't be chargedAnd I dispute what the owner has writtenNo fire alarms were heard in my upstairs unit during the fire (what good does an alarm going off in a downstairs unit that is burning up do when I am upstairs?) I left the building coughing and breathing in a ton of smoke, and the smoke lingered for days in the unitThe roofing *** came later, disturbing our lives for a week and most certainly started before 8AM as I was subjected to it - the owner was NOTOur life at these apartments turned into a nightmare and I asked the owner for -some- sort of allowance to end our lease early for all reasons statedIn addition, the obscurely written lease renewal agreement left us with no clue that we would be socked with a massive nearly $4,early move-out penaltyHe showed the same indifference to us as with the fire and roofing above and now appears to be holding our security deposit hostage as we have tried in vain to contact the management nearly a dozen times over the last two weeks and appear to be getting ignored
Final Business Response /* (4000, 14, 2016/10/03) */
A few comments: We are not withholding "a large chunk" of Mr*** security deposit, in fact we returned all but $of it that he agreed in his lease to be used for carpet cleaning upon move-out(a copy of his lease is attached.) The lease also is very clearly worded, (approved by ILL Board of Realtors as to what it costs to break a lease in the middle of it.) Again, this was a very small fire, and he tried to use this to get us to waive his early termination fee...and threatened if we didn't he would give us bad reviews, etcAlso our roofers never started before 8amWe also have regularly communicated with himPlease dismiss this inaccurate complaint
