A refund check that was issued by this business was returned by the bank for insufficient funds.My wife and I had contracted to purchase a boat and we had paid a $9000.00 deposit on the boat. When we had the boat surveyed, it was over powered by 100 horsepower so we decided to cancel the purchase. We were given a check to cover our deposit. The check was returned by the bank for insufficient funds.Desired SettlementI would like a certified check in the amount of$9000.00 plus the cost that the bank is charging us for the returned check fee!

Complaint[redacted], Owner/Broker, Cape Lookout Yacht Sales&Charters, has failed to refund deposit on [redacted] Yacht after purchase declined.On 12/5/14 I gave Mr. [redacted] a 10% check deposit of $2,925 on a 30'[redacted] Yacht. On 12/8/14 the boat was surveyed. The results of that survey caused me to decline the purchase. I notified Mr. [redacted] by phone that evening of my decision not to purchase. The morning of 12/9/14 Mr. [redacted] called and offered to pay the surveyor, transport truck, and boatyard out of my deposit and return the remainder to me. He said he knew I needed to get on the road back to Mount Pleasant. I accepted that offer in good faith.On 12/15/14 I wrote Mr. [redacted] a letter confirming my decision not to purchase the vessel as required by the terms of the contract.Since then I have spoken to Mr. [redacted] once on 1/6/15. At that time he said "he would take care of it". I called again on 1/16/15 and 1/19/15 leaving messages but have not received return calls. Since then I have called several times but am unable to leave a message because his mailbox is full.Desired SettlementI am seeking immediate refund of the balance of my deposit after expenses as per our contract. Business Response Contact Name and Title: [redacted] OwnerContact Phone: [redacted]Contact Email: [redacted] had put a refundable deposit down on a [redacted] boat we had in our brokerage, in the offer to purchase agreement it states that in the event the buyer does not buy the boat all expenses incurred by the purchaser against the vessel after sea trial & survey shall be paid out of the deposit. After the survey [redacted] declined buying the boat and left for home, before he left he told me to pay all the expenses that were due..boat yard, surveyor and transport company.During the survey [redacted] took it upon himself without permission to remove expensive stainless steel hardware from the stern of the boat and put the hardware in a dock box in the cockpit of the boat, because the hardware was no longer fastened to the boat someone climbed on the boat and stole the hardware before we could re-install it. The hardware that was stolen was vintage from the 1980's and new would have cost him more then what was left from his deposit, so we had to search for used hardware that would replace what was stolen.Because of the delay in finding the hardware it resulted in a delay of sending him out the remaining deposit after deductions. We recently found the hardware used and have just recently installed it on the boat so we will be mailing out his remainder of the deposit. He is lucky we found some used parts and saved him money but some people don't appreciate anything. He should have his money by Monday April 6th. Note: Because he removed without owners permission permanently affixed hardware on the vessel we could have retained his entire deposit!!! but we didn't. Consumer Response First I will address Mr. [redacted] remarks regarding the "vintage hardware" he claims was stolen from the dock box located in the cockpit of the boat. During the survey I did remove the Cam Cleats in question because they were loose and rain was causing water damage to the stern of the boat. I made sure that the bolt holes were properly taped to avoid further damage, thinking I was doing the owner a favor. Mr. [redacted] had assured me that no one bothered anything in his yard, so I had no reason to think it unsafe. It should be noted that far more valuable equipment, such as a bronze prop, was stored in the same dock box. Other valuable items, electronics etc., were in plain view of any thief in the unlocked cabin of the boat. The Cam Cleats in question can be easily replaced with new, top of the line, [redacted] for approximately $65.00 each. Obtaining this information only required a five minute [redacted] search leading to [redacted] website. Why Mr. [redacted] had difficulties I cannot explain, but I would have been glad to order them for him had I known.The need for my report to the Revdex.com could have easily been avoided with a simple return phone call or a response to my Registered letter of January 26 for which he signed. If Mr. [redacted] will contact me we can attempt to work out any problems. If not, I anticipate the return of the funds owed me by April 6th. Until I am in recipe of the funds I consider this Complaint still valid.

In June of this year, my husband, [redacted], forwarded an offer to purchase for a US Registered Vessel "[redacted], representing Cape Lookout Yacht Yacht Charters Inc. of Oriental N.C. Mr. [redacted] is a broker from Carolina Beach. His phone number is [redacted]. In order to "hold" this boat until my husband could personally inspect it, he wired $1900.00 U.S. (10% of the purchase price, as required) on June 11, 2015, to [redacted] to the credit of Cape Lookout Yacht Charters Inc. Account No. [redacted]. This offer was subject to inspection of the boat by my husband (which occurred on or about June 20, 2015). Clause 8 of the broker's Offer to Purchase and Sales Agreement states that "Should this offer to purchase not be accepted and consummated as outlined, the deposit will be returned". Upon inspection of the boat, my husband found it was in no way acceptable as represented by the Broker, [redacted], on behalf of Cape Lookout Yacht Sales. My husband would never have wasted the time (2 days) to drive 1000 miles to see the boat if he had known its true condition. There were soft spots on the bow of the boat which had been shoddily repaired in order to sell the boat. The deck was blistering and the lamination on the interior veneer showed water damage in the cabin. The inside of the cabin smelled of mold. Mr. [redacted] had personally assured both me and my husband on the phone before my husband made the trip that the inside of the boat was "pristine". It was anything but that. My husband advised Mr. [redacted] that he would NOT be completing the purchase of the boat and requested the return of his deposit. As the deposit had been sent to Cape Lookout Yacht Charters Inc., Mr. [redacted] advised my husband that he would have to advise the company and have the deposit returned by mail to us. He had assured my husband on many occasions that the deposit was being held in escrow pending completion of the sale.During the months of July and August, 2015, my husband had numerous conversations by e-mail and telephone with Mr. [redacted] and with [redacted], the owner of Cape Lookout Yacht Charters Inc. He also had conversations with [redacted] of[redacted], which company had advertised the boat on behalf of Cape Lookout Yacht Sales. Mr. [redacted] contacted [redacted] and advised him that his membership would be called into question if he didn't return the deposit immediately to my husband. After this, Mr. [redacted] contacted my husband and advised him that he would provide a proposal to repay this deposit by the end of business August 22, 2015. My husband heard nothing further from Mr. [redacted], although he continued to leave him messages. Mr. [redacted] did contact my husband on Sept. 1 to see if he had heard anything further. As my husband had heard nothing from Mr. [redacted], on September 9 Mr. [redacted] notified my husband that the membership with their company ([redacted]) had been terminated and apologized for the negative experience he was having./////Desired SettlementReturn of the deposit /////
