We do everything possible to announce vehicles accurately in our auction, window placards on every car, buyers guides on every car, and a catalogue accurately describing every carWe additionally inform bidders at the auction that they are responsible to pay for all purchases made, in agreement with the bidders agreement that each bidder signs prior to bidding

I am rejecting this response because: I did notify capital auctions 3 days after I drove off the lot. [redacted] the finance manager gave me excuses for 3 days before finally I had to take the vehicle into a repair shop and pay for it myself. The  exact miles I put on the vehicle were 277 not several hundred. Yes we did resolve with a 500 dollar buyout so we both do not end up in court.

I am rejecting this response because:
They had me under the assumption that I was already pre approved for a vehicle. A young gentleman told me as long as I bid on something under $7,000.00 and under 75,000 miles I would be go to go. Had they told me I was not approved I would have never bid on a vehicle.
            Also I got to the auction at 8am and signed all necessary paperwork for financing way before the auction started. The finance person never put the paper work through for the Dodge Charger. That was a red flag right there. Then when I did bid on the Pontiac Grand Prix while it was going through for bidding they did not specify that a car with True Miles Unknown (TMU) could not be financed. Every time a vehicle that was salvage title passed through they made sure to mention it over the speaker and they said it a few times. With the Pontiac Grand Prix they never said anything.
            I feel I should not be responsible for the restocking fee when they did not specify certain details about the vehicle. I was at the auction from 8am to 5pm trying to get a vehicle. This trip was a waste of time and money.
            When they said they would call me they never did. I had to call them every day for a week constantly to find out what was going on. They offered to help me get into another vehicle but why would I want to do business with someone who can’t inform their customers of the processes and what is going on. If I was never under the assumption that I was already pre approved I would have never bid any vehicle. They made me think I was going home with a car that day but that was not the case.

Review: Won a car at the auction put 700 dollars down and was going to get financed for the rest because they have signs saying they have guaranteed financing. They couldn't finance me and told me that they would send a check for 700 dollars. A week later I texted the owner his name is Kenton and asked if they sent it they said they did. Gave them another week and told them they have 48 hours to give me my money or I'll call my lawyer and the owner told me to have my lawyer call him and refused to give me the money. In the end I called my bank and told them it was a fraudulent charge because I didn't receive the car or the money and got it back.Desired Settlement: I would like my money back that's all. But if thats not the case please look into this business please they can't continue to do this to the average person I am not made of money

Auction held November 7th 2015 – Saturday, I purchased a Subaru 2001 FWD, picked up Nov-9th 2015, Monday drove it to Oakland – after checking oil, lights, gas up. November 12th car wouldn’t start, paid for a jump, then service light, air bag light, security light – came on. Got the car home very slow/car would tremble at 40 miles, all of the sudden: I got home called C.A. left messages – 16/17th – Kenton finally called me back I asked him what could we do to resolve this matterDesired Settlement: I’m out 1500.00 dollars for junk, he asked me if I had any more money to purchase another car I told him no what about my 1500.00$ he says I spent it on the Subaru,/ so after conversating with him for a while he tells me well if you can get the car back here I’ll give you 100.00$ dollars cause that’s all the junk yard will give him, so he purposely sold me junk, I opened the car door – 18th Nov. the security alarm sounded around 10 minutes before we could get it turned off, then I had to go purchase a remote, 89.00$ - in hopes that I can even get my belongings out of the car; - I was going to take it to Subaru to have them check it out, but for one I don’t have the money. Plus to many things went wrong to quickly: I feel like they (auction), [redacted] – knew this vehicle was junk and just had it to get off the lot. The steering column had been previously taken off probably by them, to get the key out, and disarm that security system, because when the car stopped the 1st time the key was stuck, and I couldn’t pull it out, so yeah I’m sure the Auction was aware of those problems, and what really gets me is he ([redacted]) told me not to blame him. Blame myself for coming to his auction, so is this what they do burn people I told him I’d just saved up that money to get a car he says & you have one, I told him its junk he says well you bought it. He says if I take him to court I will lose:

Review: Very unprofessional. We were interested in purchasing truck from them. We filled out the credit application on-line and we called them and let them know that we had filled it out. We received confirmation at 10:00 a.m. that they had received the credit application and would be in touch soon. The entire day passed by and we kept trying to find out the status as we had taken the day off to take care of this issue. Finally, around 4:30 pm; a salesman called back and said that they could not find the application and asked me if I would just give our social security numbers over the phone please. The salesman kept calling me "bro" even though I told him it was inappropriate. Very poor manners. I emailed them for the fifth time and told thm that we had stayed home all day to take care of this and right at 5:00 pm they called to asked for our social security numbers again over the phone. It is now the next day and they still are saying that "when the finance manger gets here, he will call us. It is 24 hours after we submitted the application. Justr seems like they do not have their act together there.

It is going to be very difficult to make this right as we wasted an entire day yesterday and we will never recover the money we lost. I am a truck driver (owner operator) and I explained that I was turning down loads and staying home to try to get this done. Perhaps you can simply let them know that a complaint was filed against their business and maybe they will start running it like a business

Review: On 02/08/2016 I purchased a used 2006 Chrysler Pacifica for $5800. They sold me this vehicle without disclosing all the facts. No buyers guide was posted on the vehicle so all I had was the salespersons word,promise and guarantee. He said they just got it in and it was a great vehicle with NO problems or issues. So I decided it was good deal and bought it. It was to be fully serviced and detailed and ready for pickup in the next 3 hours. I Called 3 hours later and told it was not ready it would be ready by 10am the next day. It was not ready,the finance manager [redacted] said it was going through a 160 point inspection and they had to change the rotors and breaks because they couldn't let me drive an unsafe vehicle. On the afternoon of the 10th 2 days later I talked to [redacted] again and said it would be ready by 5pm and assured me it was like a new car. I called at 5and low and behold it was reading to go. I picked it up.now the problems begi! First there was no gas at all in the tank. And I noticed a shaking from the front end thought I was driving on fumes so didn't pay it too much concern. Gassed up and made it home. Every speaker in the car was blown the tires were 11 years old. The next morning I had a flat and had to replace all 4 tires. The vehicle was never serviced and the breaks and rotors never changed. The detailing looked ok though. But the shaking never stopped. I contacted [redacted] he said he would get me in to see the dealer mechanic he never called me back. The next day I called and [redacted] was off. So I took the car to Midas and got it inspected and they diagnosed the shaking as a bad [redacted]. Then I took it to [redacted] and auto who agreed my [redacted] was shot and would cost $2800 to repair. I got it fixed.I talked to [redacted] the [redacted] about how to resolve this, he offered me $400 to settle this matter but that's unacceptable. He was offering to trade me straight across for a mini van which I declined. I have a good car now.Desired Settlement: I would like the full amount for the repair $2800

Review: salesman/owner failed to disclose serious mechanical problem broken transfer case at time of sale.

On advice from friends and relatives I recently bought a 2005 Nissan Murano from [redacted] dba KM Motors, Capital Auctions, Inc. for my granddaughter. His offices are located at 4400 Salida Blvd., Salida, Ca. The vehicle smelled of oil burning from Day One, but we were assured it was a cleaning fluid or some such innocuous thing and that it would go away. The smell persisted;we complained some more and were told the same thing:"Nothing to worry about". When it finally snowed near our residence and the all wheel drive was called upon to function, it did not. That's when we learned that the transfer case which should have switched the drive train to all wheel drive, was dry and the necessary gears sheared off; in fact, the transfer case housing was cracked and had been fixed with a glue called JB Weld, a repair unknown to us, and one which we certainly had not made. The cost to repair the transfer case problem ran about $3,500 in addition to the $16,400 we had already paid for the car. So our $20,000 Murano, which we believe [redacted] bought at auction for under $10,000, was an ill-advised purchase. Muranos often have these problems and it would seem as though [redacted] should have known of this fact, inspected the vehicle and disclosed the problem rather than selling us the vehicle in disrepair at a price well above retail. He had promised to supply a Navigational CD, which he has not done. He also offered to pay toward the necessary repairs, another thing he hasn't done. Our experience with this dealer and his operation was a major disappointment and an expensive lesson; we thought we were dealing with a friend's trusted relative. Evidently [redacted] is interested solely in his own profit, rather than in providing a good product to his customer. Buyer Beware: You might want to check the Stanislaus County Civil Court Records where his name appears as a Defendant in Fraud and Small Claims Actions.

Business' Initial Response

The vehicle was sold to Mr. [redacted]'s granddaughter and Mr. [redacted] was not present at the time of the sale. He did however pay for the vehicle. At the time of sale there were no issues with the car. There was a smell that [redacted] (the buyer) and I both smelled at the time of purchase. We determined at that time that the smell was a clear spray that was put on the engine in the detailing process. I told her it should go away by the time she got home.

I did not hear from Mr. [redacted] or [redacted] for over two months after the day they purchased the car. (I even made a couple of phone calls to them because they left the car they drove here at my store and I was wondering if they were going to come and get it.) Once I was notified of a problem I discovered that the vehicle had been driven over 4000 miles since the day it was purchased and had been driven in the snow, slid off the road and had to be towed.

Though vehicles do occasionally break and we need to work with our customers to settle issues, in this case I felt that after two months, 4000 miles and an off road accident, I should not be held responsible. If the problems existed at the time of purchase one should have called us or brought the car back.

While I had no issues with the actual buyer, Mr. [redacted] insisted that I had sold them a bad car and knew it. He insisted that if I did not take care of the repairs he would write bad reviews, issue complaints online and ruin my good reputation.

There was an issue at the time of sale- a smell was noticed by both the buyer, [redacted], and the seller [redacted] of Capital Auctions. The buyer was assured that the smell was due to detailing fluid and that it would soon go away. [redacted], who lives in Oakhurst, and holding traveled 4x a week to Fresno for medical treatment in addition to attending school classes and holding a new job. During these drives the smell didn't go away but [redacted] was again reassured by phone that the problem was not serious, but most likely from oil drippings and would soon burn off.

The car was purchased primarily to have 4 wheel drive capacity but in the first attempt to use 4 wheel drive in the snow it couldn't move up a slight hill on the highway. The car was moved to the side of the road and left for the next day. The car was never towed.

When taken to Eagle Quik Lube for oil change [redacted] was told that a repair had been done to the transfer case using EZ weld and that the case was leaking oil. This was the cause of the burning oil smell from the very first day of the sale.

Mr. [redacted] offered to share in repair costs at first- but when the repair bill was presented he never responded. Before submitting a claim to Revdex.com I tried for weeks to reach them by fax, phone, email and regular mail-all to no avail.

I'm EAGER to pursue this case further.

Review: I went to this car auction on Saturday May 17th, 2014. I get there and look at cars that were for sale but not going up for auction. I see a Dodge Charger I really liked. So my uncle and I go into the office and sign paper work to try and get financed for it. We then leave the office to go look at vehicle up for auction. This young white male in his early 20s with glasses comes out and says the charger could not be financed because it has to many miles on it. He also said if you bid on a car thats under 7k and under 150k miles it can be financed. This led my uncle and I under the assumption that the finance person named [redacted] put the paper work through and that I was already financed for a car under 7k. We bid on a 2000 Pontiac Grand Prix and won it for 3500 because I was under the assumption I was already financed for a vehicle I went into the office paid a $250.00 fee and also put $250.00 down on the loan. I go into the office and spook with [redacted] and he informed me that cars with true miles unknown can not be financed. While the auction was taking place, the auctioneer never specified this. When certain cars went through with salvage titles they made sure to inform the people that were biding on the cars. When the Pontiac Grand Prix went through they didnt say anything. Pontiac Grand Prix. So the finance manger [redacted] was trying to get me into the charger but at first they said they couldnt because it was over 150k miles. For the last week since the auction they held my $500 in total and had not contacted me or informed me if I was financed or not. I had to contact them everyday until May 23, 2014 to get information on what was going on (bad customer service). Finally [redacted] told me I could not be financed and that a refund check will be issued. I asked if my full $500 would be refunded he said no due to a restocking fee. Here is my issue when I bid on the Grand Prix I didnt know it could not be financed [redacted] would not even put the paper work through for the Grand Prix. In the beginning when we got there he wouldnt put the paper work through for the charger. I feel I should not have to pay the restock fee because they did not properly inform us that a car with true miles unknown (TMU) could not be financed. I have always had to call them for information on the vehicle for the last week and it does not take 6 days for them to say I could not be financed. When I spoke with the owner he was really rude and made it seem like it was my mistake and not his. I was in tears because he was so rude and I dont have $250 to waste.Desired Settlement: I would like my $250 restocking fee I should not have to pay that if I wasnt properly informed
