Our Response/sequence of events
The client applied for financing for vehicle which was for sale via Capital Auto on :
(11/12/4:45:PM)
The Client was approved for financing by associated financing company
Client was fully aware of the financing approval and agreed to continue
with financing by financing company and purchase of vehicle from Capital Auto
A down payment of was requested by financing company and was given to capital auto by client, the down payment is part of the total price of vehicle, the down payment is non refundable
On 12/15/a $dollar down payment was given by client, and was taken via debit machine and on 12/29/another $dollar down payment was given by client, and was taken via debit machine (receipts can be provided.)
The client assured at the beginning of the application process that he could afford the vehicle and was starting a new job, a job letter and banking statement was provided by client as criteria requested by financing company, Finance company called employer to verify employment, which helped the client with approval
Dates were set by financing company to take out vehicle loan payments
The Client signed the contract to finance and buy the vehicle in question on 12/28/ (the client may request another copy of that contract if the client would like another copy, and Capital Auto will kindly email a copy of the contract to the client.)
Agreed apon repair work and installation of GPS was done to the vehicle by garage to prepare for the eventual delivery of the vehicle to this client
Work was finished and representatives of Capital Auto contacted client and requested that the client to come and pick up clients agreed apon fully financed vehicle
On 01/11/the client cancels the Deal via email and requests the non refundable down payment to be refunded
Client was told by Capital Auto Representative there would be no refund
The client then makes complaint to Revdex.com on 01/18/
The client broke the agreed apon contract and forfeit his down payment
In regards to a solution the only solution is for the client to prepare small claims court documents, The client broke the contract with capital Auto and also with the financing company, Capital Auto is under no obligation to refund customer’s down payment on vehicle due to clients own unforeseeable reason not to go through with the contractDown Payment is non refundable by Capital Auto
