I reviewed the response by CDC & *** ***, it is fair to say he covered each part of the complaint and offered his account of the eventsUnfortunately *** *** has chosen to embellish on his version of the truth, and in fact has done a poor job at that I have documented text and emails between myself & *** *** to prove contrary to what he provided in his responseIronically *** *** suggested I demand the draftsman pay for the improperly ordered trusses, or threaten him with a civil suit through small claims court*** *** never offered to pay for the new trusses, or new materials to build a rafter style roof I also have detailed emails from the drafting service on this issueNext, CDC/*** *** conveniently leaves out how he cashed a certified check to him for $10,He was terminated early in the project, so how can he keep this sum of money & feel that this is not an illegal act? *** ***s request for mediation is an attempt to try to talk his way out of the issues & cover the illegal acts he has committed I request that the Revdex.com of Upstate New York grant this case an arbitration, where an arbitrator can listen to both sides, review ALL of the facts and documentation and make a final decision & determination

Upon notice of complaint, contacted homeowner We are in the process of scheduling workers to rectify the problem per our contract and warranty agreement

In response to this complaint:1. Delays - C.D.C. communicated in writing with the homeowner in regard to any delays.
2. Trusses The same day I discovered incorrect size trusses were ordered, I contacted my outside sales rep at [redacted] and had the correct trusses delivered...

within 3 days. The cost of these trusses was to be paid by C.D.C., however, when they were delivered C.D.C. was no longer on the job. (See supporting documents below.) 3. Dumpsters C.D.C. was coordinating the rental of dumpsters, however due to the Thanksgiving holiday the company we deal with did not have anything readily available, which is documented by [redacted] The homeowner took it upon himself to rent dumpsters from another company through the subcontractor. The contract is between CDC and the homeowner the subcontractor should not be involved.
4. Shingles - The Tameo shingles for the project had been approved in writing by the homeowner and ordered. As the roof was to be started, the homeowner had a conversation with the subcontractor and then questioned the shingle brand. This led to him questioning my integrity. I relayed to [redacted] that the subcontractor was undermining my authority and expertise. CDC was the general contractor on the project and as such decisions were to be made between the homeowner and CDC, not the homeowner and the subcontractor.
5. Settlement - The contract between [redacted] and Capital District Contractors was breached by [redacted] fired CDC from the project. CDC had fully intended to finish the project to the contract specifications as we do all of our contracted projects. This is now a legal matter. CDC is suggesting mediation to resolve this matter and determine what monies are owed to either party.

This company took NO down payment, but took $250 for an engineers stamp for a permit for a 10x12 second story deck. Contract signed end of June 2013. Permit picked up end of July 2013. Never heard from them again. Several phone calls and e-mails never answered. Met owner in grocery store and he laughed and said he was so busy. This was in January 2014. It is now the end of June 2014....and guess what? STILL HAVE NEVER HEARD FROM HIM!!! We finally had a REPUTABLE company come in and do our deck. Guess we'll never see our $250 again.

The company is weighing the option of processing with arbitration and is waiting a response from his attorney at this time.

Obviously, [redacted] is not man enough to admit that they
made several mistakes, that communication was extremely poor, that they are inconsistent, and that his foreman is
incompetent.  He needs to acknowledge—to himself
as much as to others—that his company needs to work on these issues.  Even the workmen who came to my house
commented on how inconsistently and badly this company operates.  I have no respect for this man.He says that I am at fault for not buying the necessary
items, but who told me to buy them? 
Workmen would show up at the house and ask where the materials
were!  I didn’t even know they were
coming!  My definition of a professional
is one who does not need me leaning over his shoulder telling him what, when,
and how to do the job in his field of expertise.  [redacted] is not professional in any sense
of the word.
That said, and even though the workmanship in my kitchen is
far below par (drawers are crooked, cabinet doors do not open smoothly, tile is
placed so irregularly that there is a gap showing the concrete), he has fulfilled
what I asked him to do—two weeks after I sent my original complaint to the
Revdex.com.  I do not want to see him again nor
will I let him or any of his workers into my house again.   As far as I am concerned, this complaint is
satisfied.  I do hope, however, that the
Revdex.com will keep my letter on file so that others may beware.  Caveat emptor.
