Good Afternoon-
After review of the file, it was determined that that the Itemized Disposition of Security Deposit (IDSD) was mailed on September 9, 2016, to the forwarding address of 1*** *** *** *** *** *** *** ** *** The date of Move-out was August 22, 2016, which means the IDSD was mailed within the days
The original IDSD indicated there was an amount due to the owner in the amount of $for damages and rent after the security deposit was applied There was a total of $in damages to the apartment unit $was for apartment cleaning and $was to prime and remove the cigarettes stains from the walls in the unit
While reviewing the file per the complaint we discovered a payment had been incorrectly applied for rent and a Revised IDSD was mailed to *** *** on December 15, 2016, which included a refund of $Please find attached copies of both the original IDSD and Revised IDSD explaining the charges
Attached please find the original IDSD that was mailed with receipts from the damage and the revised IDSD tha was mailed

from those businesses with full details of any work claimed performed on
the specific apartment unit which I vacated on August 20, I am also unable to respond to this communication and send them a copy
of the envelope they claim was mailed on September 9, 2016, per their request.

I provided the requested documentation in my last response for you to review I have attached them again, you will find all the documentation including receipts for the repairs that you have been charged for
Our records indicate that the original IDSD was mailed with in the day time frameWe do not have the ability to manipulate our postage machine to change the mailing date I will need you to please provide me a copy of the original envelope you received, which you are stating was postmarked on September 21, I will need that copy in order to verify that our records are incorrect on the date we mailed out the original IDSD Without that proof we can not revise and issue any additional refunds

Good Afternoon- After review of the file, it was determined that that the Itemized Disposition of Security Deposit (IDSD)  was mailed on September 9, 2016, to the forwarding address of 1[redacted]  The date of Move-out was August 22, 2016, which means the IDSD was mailed within the 21 days. The original IDSD indicated there was an amount due to the owner in the amount of $275.00 for damages and rent after the security deposit was applied.  There was a total of $715.00 in damages to the apartment unit.  $125.00 was for apartment cleaning and $590.00 was to prime and remove the cigarettes stains from the walls in the unit. While reviewing the file per the complaint we discovered a payment had been incorrectly applied for rent and a Revised IDSD was mailed to [redacted] on December 15, 2016, which included a refund of $50.00.Please find attached copies of both the original IDSD and Revised IDSD explaining the charges.   Attached please find the original IDSD that was mailed with receipts from the damage and the revised IDSD tha was mailed.

This response would be laughable if it were not such a professional embarrassment to this business as follows:1.  Capital Growth Properties, Inc has previously acknowledged in writing that my official move out date was August 20, 20162.    2.  I have repeatedly requested detailed and itemized receipts showing all legally required information with no response.3.  The original IDSD was rife with errors, misspellings and other unacceptable mistakes of which they have been previously notified with no efforts made on their part to make any corrections. 4.  Capital Growth Properties, Inc claims they timely "processed" their original IDSD on September 9, 2016.  They even went so faras to set their company postage meter to that date.  Unfortunately for them, the actual US Post Office official time and date stamp onthat mailing proves it was not mailed to me until September 21, 2016 as they have been previously advised.  5.  Mailing me this refund which is again in error, does not relieve them of their legal obligations under California Civil Code 1950.5.6.  For the third time, I request an immediate full and complete refund of my security deposit.
