Good Afternoon ~ I believe this complaint has been resolved The resident called in a service request on Wednesday for moisture and mold in a closet that was adjacent to her HVAC closet that had previously had a leakWhen the leak had been fixed by the service team her adjacent
closet was so full that they did not feel comfortable pulling out all her belongings to make sure there was no additional damage to address This apartment was walked by both the manager and service manager today and appropriate measures were taken to make sure the closet was dry and mold free I'd attached the service request It is my understanding that the manager has been in contact with the resident today and that she is happy

I have attached a copy of my email conversation with the property managerI explicitly requested photos of the damages and they stated multiple times that there were noneNow that I have filed a formal complaint they magically have photosI believe there was no stain or damage caused by me and the emails show that they had no photos of any such damagesI believe the damages were done after my move out and they wrongfully deducted from an over payment that they charged me, not a prepaymentIf you look at payment records from the business, it clearly shows they charged me for an extra month of rent at the end of my termInstead of returning the overpayment, they decided to deduct for a new carpet, which I was not responsible forI am willing to settle for a partial repayment to end the matter, but now they are lying about photos and prolonging the issue

In response to the Revdex.com complaint made on 9/6/regarding
the residents security deposit in questionThis resident was the first and
only person to stay in this brand new unitThe carpet was damaged to the point
that management decided it needed to be replacedThe Resident had

prepaid a month’s rent along with a security depositWhen the damaged to the
carpet was recognized the resident had been refunded their security deposit and
the carpet replacement cost was taken out of the prepaid rent amountThis
resident was provided the invoice for the carpet replacementManagement has

In regards to complaint [redacted] the Resident signed a 16 month lease and is only 90 days into his current contract. His lease document clearly states that we don't have to allow him to terminate his lease however we are allowing him. To terminate his lease he is required to give a 60 day written...

notice and pay the termination fee of $5,940.00. Whether the property is highly desired has nothing to do with the fact that he signed a  contract that he is terminating and by doing so has to pay termination fees. No difference than signing any other contract with any other company. He has spoken to the community manager and the VP of Operation and has been told his requirements. He signed the lease and agreed to the terms of the lease when he signed it. We treat all out residents equal and fairly and if we let him out of his lease agreement and lower his fees then we would have to do the same for everyone else. This is our position and while he may not agree we are not willing to lower our fees or his obligations to the lease.

I have reattached my original email chain with CIG. There were no photos attached to any of the messages and they repeatedly told me there were no photos of the damages. Even during my conversation with the VP of Ops there, she stated there were no photos. They violated their own lease agreement when they charged me for the damages, which I never took blame for. They never sent me an itemized list of deductions, which is required if there are any. They also sent me my full deposit back instead of absorbing that and billing me for additional charges, which is also required. They chose to charge me for an additional month of rent and just take what they felt was owed out of that. This whole ordeal has been extremely unethical. If there are photos, please send them to me like I asked back on 7/16 and 7/17 of this year. I absolutely reject the business' response and will keep doing so until this matter is resolved.

Good Morning ~ I have spoken with this resident both in person and in writing at length.   This resident signed an 18 month lease and 3 months into the lease decided to purchase a home.  Per the terms of the agreement, which he signed, we do not even have to allow him to terminate his lease.  In our generosity we have agreed to let him do so however he is responsible for full terminate fees.  What he is responsible for is clearly written, in writing, and if he chooses not to pay it we will turn him over for collections.  He does not get to negotiate the terms of his signed and executed agreement.  We have no further response on this matter and will not continue to go back and forth.Thank you,Stacy W[redacted]VP Operations

Good Morning ~ We'll not continue to go back and forth with this previous resident.  The carpet was damaged by himself and it had to be replaced.  As previously stated, he was the first and only person to reside in that apartment with Brand New Carpet and it would not have been replaced if it did not need it.  We were fortunate enough for him to have over paid his account so we were able to recoup the damage costs which clearly from his responses he would not have paid even with the proof that it was new and a receipt for charges incurred.   This saved us time the in turning him over for collections, which we would have done.  That is our stance on the situation and we will not be refunding any dollars.

Response to complaint [redacted]: This community was brand new at the time the resident moved in and the carpet had never been walked on or lived in. We would not have replaced brand new carpet and incurred the initial expenditure if we didn't deem it necessary. He has has spoken with the community manager and the VP of Operations and he is responsible for the damage. We will not be refunding those dollars to him. The community has always had photos and they were offered to him. As far as we are concerned this matter is closed.
