Attached please find a PDF file with scans of the
contract as well as photos to support my complaintIn response to the
company’s message:
The message says: “Revdex.com spoke with the business
who advised that this job was completed fully and satisfactorily
Consumer signed off on work job was paid for.”
My response: I provided full payment to the
business, I consider it good citizenshipI did not sign the contract as
you can see in the attached file (photo 1)The second photo shows the specific
parts of the contract with the company's obligation to backfill, grade and
reseed the yard to specifications.
Next, the company argues: “A few weeks later
consumer contacted business upset over appearance of the area due to the clay
shrinking.”
My response: When the workers completed their
work they spread grass seeds and covered the yard with strawThey instructed
us to keep the straw cover and to water regularly for a couple of weeksAfter
the grass had grown in, we removed the straw only to realize then that the yard
was completely uneven, with a dip in the area where they had replaced the pipe,
running from front to back (see attached photos, 3-5)We were not able to see
this earlier due to the straw cover on the groundI then called Justin who
said that due to the rain they were not able to properly level and compact the
soil before they leftHe said he would come by in a few days to top up the
soilBoth my husband and I called three more times, always getting the
same response and yet he never showed upAt that point I filed the
complaint.
The above are the simple facts of my
complaint as they pertain to the company’s responseBeyond these facts please
note that the company also did not fill our flower bed and did not replant a
bush they had removedRather, they simply placed it on top of the ground and
we had to purchase several bags of soil to rescue the plant (notice the middle
plant in the attached photos and the different soil color)This was done by us
and NOT by the companyYou can also see our broken concrete walkway
caused by negligence of the heavy machinery operatorAll in all I believe that
my complaint has merit and proof, unlike the company’s response
I would like to add that a few days ago I
received an angry and threatening phone call from the owner (Justin) about this
complaintI consider this highly unethical and unprofessional

upon arriving at ***'s for the estimate, I wasn't able to be into the back yardthis was because of dogs in the yardthe area that he wanted concrete poured, was over grown and had brush next to the fenceand a septic tank in the middle of the proposed areawith these conditions I couldn't get
an accurate measurement.*** said he wanted Aprox a by 30slab, he expressed that he wanted the biggest square pad that I could pour in that areathis area was to be for the dogs to be housedhe wanted a concrete pad so he could wash the concrete down after the dogs had gone to the bathroomso the dogs that he was breeding, wouldn't get sick from the fecal matter I sent *** a follow upe mail with the quotehe had said that after he cleared the areahe noticed that there was a large decline on the side of yard next to the fenceand asked about base stoneat this time, I gave *** a price to bring out a bobcat, grade the areaget loads of stone, and grade the stonefollowed by compactionhe said he would like my opinion when I saw it cleared. *** had asked me about a warranty, I explained that we were not going below the frost levelwith this climate in upstate ny,and being poured on topof an accessible septic tank I notified him that I could not warranty a 4" surface slab. *** then agreed to the price and set a start date. the day that we startedafter seeing the area bare for the first timewe realized that *** would need the base stonehe agreed with me and we proceededas I was waiting for stone to be deliveredI ordered the concrete for the following day at amI notified *** of the early start and he was fine with it*** told me that he was feeling funny from a novicane shot he had gotten the day beforeso he was going to the emergency room to get checked out. after installing stone and compactingwe found that the "largest square pad "that we could form was by this was due to a tree trunk, a set of existing stairs into housea fence separating us from the dogs that he breedsand a garage so taking his direction on the largest square pad, we formed the area and installed steel 6"x6" wire reinforcement mattsafter finishing for the dayI didn't see *** aroundI sent an e mail, to keep him updatedI told him that it was all formed and would be poured as scheduledhe replied to me , letting me know that his wife would be present for the pour. in the morning I spoke to ***'s wifeshe said that the area looked good so we poured the slab with the slab being so bigthis presented me with twosmall corners that I wouldn't be able to finish trowelwith the information about only being concerned about being able to wash the fecal matter away, I knew this was not going to pose an issue. the following day I went alone to ***'s house to strip the forms*** was present, so I went over the details with himexplaining that the by was the largest square area possiblehe had some concern about dogs eating rocksbut as I already explained, with the existing fixed objectsthis was as large as it could behe had no issue , and looked over the rest of the jobhe was satisfied with the jobbut questioning about an old plastic end tablehe thought that it had been broken by the company that brought the stone I looked at the table, it wasn't brokenI only had to push it back together to open it back up all the way(it was an old plastic 18" round folding table) after I got it fixedhe had agreed to pay me the balance of the jobbefore I left, I notified *** that he needed to purchase , or build a cap for his access square for the septic coverthe septic cover was old and was not a tight fitso I offered to build him a cover if he had the woodhe assured me that he was handy, and would build the cover himself. for months, I didn't hear anything from himbut I got an e mail from home advisora 3rd party that has paired my company up with *** for the work he wanted completedthe email stated that we had a negative review from *** after getting In touch with ***I agreed to inspect his concerns of blistering and crumbling concrete we set a day and timeunfortunately, I was stuck on a job and had to reschedulethe day I rescheduled, I double booked the time slotthe day of the inspection I realized my mistake and sent an e mail to ***to give him a heads up that I would be coming out earlyhe told me prior to this e mail that he wasn't holding me to an exact hourjust a rough time was goodso I didn't think coming early would pose an issue. upon my arrival I witnessed that ***'s truck was home, another green suburu was therethe garage door was open, and the dogs were out in their kennels I rang the front bell and knockedno answerrang the bell a few more times with no resultI went to the side door and repeated thisno answerso I walked around to the back and inspected the slabthere was no blistering or crumblingonly a hairline crack over the septic tank accessthis was because *** had never built a coverso the base stone was washing into the septic tank every time it rained and or when he washed the fecal matter off the slab with no one answering the doorsI sent the finding to him via e mailwith attached pictures. he then e mailed later, that I never showed upI called *** to clear things up and he told me that he couldn't hear me several timesand there was a rumbling on the phoneso talking loud enough for him to hear meI told him what I did when I got therethe vehicles, about the dogs, and the garage door*** then told me that he saw my truck in his neighbors driveway . I explained that I never was in his neighbors driveway, but if had seen my truck I didn't understand why he did not come out sidebeing minutes away from my houseI am not able to just keep driving out there*** then told me that the people from home advisor misunderstood him and wrote the wrong thing. to my knowledge , everything was fine after this conversationtwo days later, I received this e mail from Revdex.comas soon as I read it, I called inthe man I spoke with asked a few questionsthen asked about a warrantyI explained that there was no warrantyand both party's understood the reasoning for no warrantyprior to the execution of the contract The Revdex.com associate had told me to send in the info I hadand he would look into it. I have tried to call *** since, and have gotten no responseI feel that this is an extremely unfair complaint against my companythe concerns that I expressed to *** prior to the job, are the only issues with this jobso for a family company that takes pride in their work, this is a low blowhe is upset with his decisions that he made , but we had given him our professional opinion based on experience*** decided that he wanted to go with his plan anywaysthis is not an issue with workmanshipthis is a problem with a customer not taking a suggestion from a contractor that has experience. please keep me posted on the status of this complaint

Justin already looked at this project and told the customer that there was no issues at all with the concrete that was poured. The customer is stating that he has no issue with the size and now just wants us to reassure him there is nothing wrong with the concrete work. This has already been done there are no further steps we need to take!

business offer to bring some soil and spread out this was not included in the contract it was additional that the business offer to the consumer in goodwill.  Consumer was not given a time frame for this and extenuating circumstance have prevent the business for completing such at this time.
