 Complaint: [redacted]
I am rejecting this response because:
October 30, 2014
The following is in regards to the response issued by George T[redacted] of Capitol Painting Co. to complaint #[redacted] dated (9/18/14). While further actions are being investigated pertaining to the statements made by Mr. T[redacted] in his response, for the time being I will simply reply with the following.
At no time have lever threatened another human being in any way, to indicate otherwise is completely absurd.
What Mr. T[redacted] does not seem to understand is that as a home owner I am a member of the Homeowner’s Association. It is with the homeowners' approval that the HOA's board members enter into contracts directly with businesses on their behalf. The same is true of the Property managers. Comsource Property management is also contracted and employed by the homeowners association. As a contracted employee, Comsource acts solely at the behest of the board and has not been empowered to make determinations on whom does and does not have authority on our property.
I believe this is where Mr. T[redacted] confusion has led him to feel as if he can behave in the manner indicated in the original complaint. It seems as if he isn't even aware with whom he is under contract with.
It has been established in the terms of the Contract that Mr. T[redacted] is responsible for having proper supervision on site at all times. Since on the date in question there was no supervisor present, I contacted the management of Capitol Painting to discuss the serious concerns that have been brought to my attention my fellow property owners. There was no contact whatsoever with the individual workers present. As a courtesy, Mr. T[redacted] was given an opportunity to make corrections to his workmanship prior to continuing to do further damage to our property. Instead he chose to be confrontational.
The issues indicated in the complaint are specifically regarding poor workmanship and Mr. T[redacted] inappropriate behavior. In the coming weeks there will be an independent assessment of the work done on the property and all damages and workmanship not contract compliant, that is, “within industry standards” will be documented and the appropriate steps will be taken. I would happy to share these results with the Revdex.com. Contacting this agency is the first step in what seems may be a long process. In the meantime however, I'm sure Mr. T[redacted] will have no problems providing the Revdex.com with the “homeowners testimony” and “photographic evidence” he claims to have in his possession.Regards,
[redacted]

Dear [redacted],
This letter is in response to a complaint ID#[redacted] is totally lying about the above matter. We are hired by [redacted] HOA to do the painting for the Association. Without having the authority he showed up and started...

screaming at our workers on the job, I immediately went to the job site and met with him.He showed me some holes in the siding of the building, that apparently according to several testimonies they were there a long time; however, he claimed that it was our damage. I nicely tried to explain to him that we have picture documentation of all of this that were taken prior to us starting the work.
He then proceeded to show Inc. Some paint spills in the trash enclosure and paint cans with paint inside them inside the trash enclosures. The paint spills must have been there a very long time and again we have testimony from the homeowners attesting to this. Also the paint was [redacted] interior paint that apparently was spilled and dropped there by some homeowner. I kindly explained to him that we DO NOT use [redacted] paint and that the spill he was showing me was at least 2-3 months old and could not in any way be ours.
Then he pointed out to me at the downspouts which we had to remove and reinstall in order to replace the rotten trim behind them. He complained that the screws were 2 different colors. We showed him on the spot that we were only using the screws we removed to reinstall the gutters. So apparently whoever did the work on the gutters/downspouts did not use the same color screws throughout; he mixed them. I also proceeded to show him the buildings which had not worked on yet that had several issues with the gutters/downspout work that was done by someone else including, but not limited to, different colored screws, holes in the new downspouts, missing straps and trash in the work area. The above was pointed out to him on the buildings we had not started working on.
He refused to listen to my response and he was screaming and yelling and threatening that he would call the police to have us removed from the premises, etc.
Not knowing who this individual was of what was his capacity, I seeked the advice of the Management Company. The response from the management company was that this individual has not authority whatsoever and that my contract is with the HOA and the Management Company; and those are the ones who are responsible for inspecting my work and bring to my attention any issues they may have. I was further instructed that if he comes near my crew or myself and make any additional threats or acquisitions that I am to call the police.
I did further investigation with my crews that were working on the same Association last year to find out if they encountered any contact with this individual in the past. They report to me that a year ago while we were doing 4 different buildings for the Association he started an argument with them as well. A year ago we had a specific list of which balcony railings to replace. His balcony was not part of our list. He came out asked the foreman whether or not his balcony railing would be replaced. The foreman kindly explained to him that we arc only replacing the balcony railings that are rotten and they specifically noted on our list of repairs and his was not part of the list, because it was not rotten. He then proceeded at the foreman, went inside his unit got a jigsaw and started cutting off the railings on his balcony, In order to avoid any further conflict my crew moved away from this unit at that time.
As I mentioned above the Association through the Management (the people I work for) that this individual has no authority to order or demand things to be done because he wants to.
In any event on 9/18/2014 when I met with him and he made the acquisitions that I mentioned earlier, his behavior was not anywhere near the normal. His comments were insulting and racists and he was constantly threatening me and my crews. At no time did we threaten him, we just kindly asked him that if he had any complaints he needed to bring them to the attention of the Association and/or Management and once we hear from them we would be more than happy to address them.
He did not want to hear what we had to say, he continued with his threats, screaming, yelling; and honestly he gave me the picture of a mental unstable person.
Finally, I have pictures and witnesses proving that the problems he mentioned on 9/18/2014 were there before we started the job. Please feel free to call me if you have any questions.Yours truly,
George T

November 10, 2014Dear [redacted],This letter is a follow-up response to a letter from [redacted] dated 10:30/14 (Complaint ID#[redacted]),Although [redacted] indicated to me that he is a civil engineer and he owns 4 units at [redacted] he had absolutely no jurisdiction or authority to be inspecting my work and harassing my foreman and crew on the job site. Despite that fact, as a courtesy to a homeowner, I gave him the benefit of the doubt and decided to meet with him.
At that meeting [redacted] pointed out to me some pre-existing conditions on the buildings, such as the holes in the aluminum siding, spilled paint in the trash enclosure, and the different colors of screws on the downspouts. I clearly explained to [redacted] that those are pre-existing condition that were caused by others and that under no circumstances would I be taking the blame for it.I also explained to him that I have provided the management with photographic evidence of all the pre-existing conditions on the building via email prior to the work beginning. If he wanted such evidence he should contact his management company, ComSource Management.Instead of listening to what I had to say; [redacted] proceeded to conduct himself in a totally unacceptable manner by screaming, yelling, pointing his fist, making racist remarks and being vocal. And threatening to “call the police to have me thrown off of the job”.After Seeing that, I indicated to [redacted] that if he has any problems with our work, or if he needs any evidence of the pre-existing conditions, he could contact his management ????????, ???Source ????gement.I made it clear to him that he has no authority or jurisdiction to harass my foreman, or my crew or disturb the progress of my work. Any issues he has, he needs to contact ComSource Management. Those are the facts for which I have both witnesses and photographic evidence to whom it may concern. However, [redacted] chose to manufacture the facts his own way and get in touch with the Revdex.com,If this does not cease to exist immediately, and since it has the potential to damage the stellar reputation of my company, I am left with no choice but to hire an attorney to look into this matter.
Furthermore, if the Revdex.com decides to post this I would strongly suggest that you investigate the truth before allowing [redacted]’s manufactured acquisitions to be available to anyone else; as I will take any and all necessary actions to protect the reputation of my business and to protect against any potential damages from this.
Again, this individual was not appointed by anybody nor authorized by anyone to be my “inspector”; nor can l confirm that he owns 4 units or he is a civil engineer. Regardless I do not want to have any further contact with this individual, ANY FURTHER CONTACT SHOULD BE DONE THROUGH MY ATTORNEY.
Please feel free to call me if you have any questions.Yours truly,George T

Review: This company was hired by my HOA. On the behest of 3-4 other homeowners I complained to the owner of the company about the paint spills, damages to our gutter downspouts, etc. The owner first denied having anything to do with the damages and then when I showed him a video of his workers he actually threatened me.He began screaming at the top of his lungs that "you're a nobody", "get out of here before you regret it" etc. I am now in discussions with my HOA and and after having them removed I felt their actions needed to be reported.Desired Settlement: 100% refund of all but the first 1/3 payment
