After conferring again with my staff with the several conversations between Mr*** and my staff, I feel comfortable that the information that was communicated to Mr*** was not misleading nor a bait and switchIt is not my practice now or has it been in the past to mislead anyoneI regret that Mr*** was unsatisfied with my responseMr*** feels insulted by response as I do with his accusations that I misled him and did a bait and switchI am willing to provide a $gift card as a final peace offering. I am rejecting this response because:
To whom it may concern:Maureen, that's great that you informed your employee's via an internal email of the price structure for the Serrano Apartments, however you neglected to mention this change in your call to me, of the removal of the $gift cardI also had several conversations with your employees between submitting the application and signing the lease, that included the reduction in rent and "all of the leasing incentives and conditions would be met" being confirmedIn essence this entire process was not clearly communicated and the goal posts were moved each time I pushed forward with the leasing agreementThe lack of clear communication concerning the leasing incentives, the agreed upon rental rate, utilities fee, and move in date was never done in a way to illustrate your company's real world actionsMy wife and I only became aware of what your actual offer included after, we signed the leasing agreement.The reason we included the Revdex.com in this matter is because we believe you and your company could do much much better in communicating the actual intent of your incentives and leasing agreementsIf you can't do something, say so! At every juncture in my dealings with you and your company, I have clearly communicated my understanding of the agreement and what was, and what was not, acceptableI have also completed in full, everything I have promised and agreed to do with you and your staffYou and your company have not granted us the same cutesyIncluding the Revdex.com, is to place this issue directly in your viewing to illustrate a place where your company can easily do so, so, much better.It's true I have rented from your management company in the past, but I did so through a friend that worked within your organization and I never dealt directly with the "musical chairs" of representative that my wife and I have met concerning this lease.Maureen, you have the chance to make this process rightSend us the $gift card as agreed upon in all of our dealings with you and your companyYour offer of the $gift card without the reduction in rent, is asking us to give you an additional $7.50/month over the course of the yearAsking us to give you more money is an insult to our intelligence. So, NO! We will not be give you additional rent after you have mislead us concerning the leasing agreementThat offer is an insult in offering, and you should have avoided the temptation to try to pull one over on usThis process by you and your company has been a "bait and switch," the very definition of the practice.To the Revdex.com, we are unsatisfied with the response from Capital Property Management concerning this issuePlease advise

As the Owner of Capital Property Management Services, Inc. and the person that originally showed Mr. [redacted] the apartment, I have read the complaint and can offering the following facts.February 14th after the showing, I was allowed by the Owner of the property to reduce the rent AND offer the gift...

card IF Mr. [redacted] applied that day which I relayed to him. I did not nor did my agents relay to him that the gift certificate was good through the month of February. Our leasing incentives change weekly and often times daily when an Owner  of the development chooses to make those changes. Late in the day on the 14th, the Owner authorized me to drop all the rents at the building BUT it would not include a $750 gift card. (please see the attached email that was sent to all my leasing team at 3:30PM notify them of the changes) We could do one or the other but not both. Mr. [redacted] rescinded his application when he was told about our 2 week policy, which stipulates that a Resident commences payment of the unit within 2 weeks of the approved application. On February 16th Mr. [redacted] rescinded his application and indicated he would check back within a couple of weeks when the timing for his move in date would coincide with our 2 week move in policy.We dropped all incentives EXCEPT the $199 security deposit and were approved to offer lower rent rates in lieu of the gift card incentive. There were no promises made to Mr. [redacted] of a $750 gift card upon re-submission of his application. As Owner of this company managing properties for 27 years, I am confident of my business practices evidenced by a solid reputation in my industry of being fair and transparent. Additionally, Mr. [redacted] was  a previous Resident of ours some years ago and certainly would not return if he was not treated fairly or believed we were not ethical in our business dealings.At this juncture, I would offer the following to Mr. [redacted]: Pay the higher rental rate of $1395 retroactive to the move in date for the apartment and I am happy to provide the gift certificate for $750.  Sincerely, Maureen M[redacted]

I have read your query and will address it as follows:
 
On September 8th, 2015, I inspected the apartment. Upon entry of the apartment, I first noticed a strong , what I would call pet urine odor. Continuing on the inspection, I noticed the carpet had stains that...

are indicative of pet stains. To be certain, I had my maintenance team pull the caret back to look on the back side of the carpet to see if there was evidence of this and there were several. I believe you have copies of the photos that accompanied your reconciliation. You indicated in your complaint that "we decided to replace the carpet" at your expense which is not the case. The carpet was replaced with a depreciated life measured by a professional in the industry because of the damage caused while you resided in the apartment. If you did not have a pet, the damage was caused by some other substance that was not there prior to your taking occupancy. I noted the bleach stains as well but assure you that had nothing to do with the need to replace the carpet. 
As a good faith gesture, I am willing to forgo the balance of $198.44 that remains owing to Capital.
