As the Owner of Capital Property Management Services, Incand the person that originally showed Mr [redacted] the apartment, I have read the complaint and can offering the following facts.February 14th after the showing, I was allowed by the Owner of the property to reduce the rent AND offer the gift card IF Mr [redacted] applied that day which I relayed to himI did not nor did my agents relay to him that the gift certificate was good through the month of FebruaryOur leasing incentives change weekly and often times daily when an Owner of the development chooses to make those changesLate in the day on the 14th, the Owner authorized me to drop all the rents at the building BUT it would not include a $gift card(please see the attached email that was sent to all my leasing team at 3:30PM notify them of the changes) We could do one or the other but not bothMr [redacted] rescinded his application when he was told about our week policy, which stipulates that a Resident commences payment of the unit within weeks of the approved applicationOn February 16th Mr [redacted] rescinded his application and indicated he would check back within a couple of weeks when the timing for his move in date would coincide with our week move in policy.We dropped all incentives EXCEPT the $security deposit and were approved to offer lower rent rates in lieu of the gift card incentiveThere were no promises made to Mr [redacted] of a $gift card upon re-submission of his applicationAs Owner of this company managing properties for years, I am confident of my business practices evidenced by a solid reputation in my industry of being fair and transparentAdditionally, Mr [redacted] was a previous Resident of ours some years ago and certainly would not return if he was not treated fairly or believed we were not ethical in our business dealings.At this juncture, I would offer the following to Mr [redacted] : Pay the higher rental rate of $retroactive to the move in date for the apartment and I am happy to provide the gift certificate for $ Sincerely, Maureen M [redacted]

DrMr [redacted] , I have read your query and will address it as follows: On September 8th, 2015, I inspected the apartmentUpon entry of the apartment, I first noticed a strong , what I would call pet urine odorContinuing on the inspection, I noticed the carpet had stains that are indicative of pet stainsTo be certain, I had my maintenance team pull the caret back to look on the back side of the carpet to see if there was evidence of this and there were severalI believe you have copies of the photos that accompanied your reconciliationYou indicated in your complaint that "we decided to replace the carpet" at your expense which is not the caseThe carpet was replaced with a depreciated life measured by a professional in the industry because of the damage caused while you resided in the apartmentIf you did not have a pet, the damage was caused by some other substance that was not there prior to your taking occupancyI noted the bleach stains as well but assure you that had nothing to do with the need to replace the carpet As a good faith gesture, I am willing to forgo the balance of $that remains owing to Capital Sincerely, Maureen TM [redacted] President/Property Manager
