Mrs [redacted] was indeed approved for a car, a BMW with $2,down which she advised she hadShe put down $initially which stated non refundable and in return took the vehicle off the marketShe was supposed to bring in the rest within a weekMrs [redacted] found out that her license was suspended and she could not get insurance without paying her fines totaling at approximately $Because Mrs [redacted] was on a budget, we got her approved through another bank with a down payment of only $1,which would allow her to afford to pay her fineShe came in and put the remaining balance down which also stated deposit non refundableAFTER putting down her entire down payment, completeing two weeks worth of paperwork through MULTIPLE banks, Mrs [redacted] decides she did not want to pay those fines and would rather put the vehicle in her mothers nameAlthough we got her mother approved, the mother changed her mind and did not want the loan in her nameBecause of this, Mrs [redacted] asked to cancel the entire deal and get her deposit back which as stated multiple times was non refundable unless we could not get you approved for a loanThe attorney general published an article about consumers purchasing used vehicles which is attachedOn the second page, it clearly states under "refunds of deposits" "there is no right to cancel a contract unless the dealer fails to conspicuously post the refund policyIf the dealer assists you in arranging for financing and you have not picked up the vehicle, you may cancel at any time PRIOR to signing a finance agreement." Not only did Mrs [redacted] sign a document that clearly displayed "deposit non refundable", but she also filled out ALL of her finance paperwork which is also attachedWhile we had absolutely no legal obligation to refund Mrs [redacted] ANY of her deposit, we advised her that we would keep 10% of the price of the vehicle for multiple weeks of paperwork, taking the vehicle off of the market and denying other interested parties & refunding her the restMrs [redacted] was made aware of and had her husband sign a document which is attached that stated that she understood and was ok with the terms stated aboveMrs [redacted] made a complaint with the attorney general and DMV in which both did not require us to refund any money at allCapital Region Cars cares greatly for all of our clients and ethically we try and do the right thing even when not legally mandated to do soMrs***'s deal took two weeks of back and fourth, money mailing out contracts, and lots of paperwork and timeWhile we did NOT believe we were entitled to her entire down payment, we thought that 10% of the cost of the vehicle was more than fair and promptly refunded the rest without ANY legal requirement to do so

Customer purchased a vehicle from our dealership. We advised the vehicles battery was weak & that we were willing to replace it, but may take a couple of days to get the vehicle ready for inspection as it would reset the vehicles readiness monitors. After signing all paperwork, transferring...

ownership from us to the customer & the customer agreeing to wait for the vehicle to complete the readiness monitor cycle, she continued car shopping elsewhere. Friday afternoon at 3:30pm we were advised from the customer that they no longer were interested in the vehicle & wanted a refund as they found a "better deal" on a vehicle. (we have text messages from the customer stating "Like im the only one to ever do that")  We advised the customer that we first needed to speak with the bank and DMV. We needed to find out if the bank had already electronically filed a lien on the vehicle and we needed to double check with DMV that we could cancel a transaction after transferring ownership from us to the customer. We not only immediately called both entities, but gave their contact information to the customer as well for a faster turn around time. Because it was so late in the day & we had not heard back from DMV, we were unable to refund the customer until we had heard back from DMV monday morning. Although we did not agree with the customer paying for the car, doing all required paperwork & then finding another car & demanding her money back, we never once denied refunding the customer & did so promptly first thing Monday morning when we were advised we would legally do so. Please be advised that the individual arguing with the purchaser was not Capital Region Cars, rather someone who simply understood & agreed with Capital Region Cars point of view & the fact that it is not ok to purchase a car then change your mind later because you found something else. We do not pressure customers into purchasing cars, but once you have made up your mind, went to a bank for financing, paid the dealer, filled out all required paperwork & put insurance on a vehicle you should be required to follow through with your purchase.

She was supposed to bring in the rest within a week. Mrs. [redacted] found out that her license was suspended...

Because Mrs. [redacted] was on a budget, we got her approved through another bank with a down payment of only $1,936 which would allow her to afford to pay her fine. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
First and foremost,
please be advised that this was NOT a matter of my daughter changing her mind
about the purchase of a vehicle to purchase another one. This is matter of them
not being able to deliver what they promised, when they promised it.  This
business should be investigated for their practices. Not only were they rude
and unprofessional but I am quite sure some of their practices are illegal.
Practices that they will continue if they are not stopped. Although, I was not
the actual purchaser of the vehicle, my daughter ([redacted]) was. I was
the person who handled all of the transactions and correspondence with the
business because my daughter was in school in Syracuse. 
This was my daughters
first vehicle experience and it was a nightmare. If I had not posted this on
social media, I don't think I would have ever gotten my money back. I have
attached my post please feel free to read the post and its comments on my page
([redacted]) the post is public, it was originally posted on 3/23/18
and then they deleted it. I reposted it on 3/24/18. There several comments in
there from at least two other people who are currently suing capital region
cars.
These comments prompted
to revisit their review on google reviews. I have attached the analysis as of
3/24/18. All the comments in red are fake reviews. The same 5 stars reviews that
were the reason I went to them in the first place. They have false advertisement
on these reviews. Not sure who they paid to write them, but the stories are so elaborate
and positive Capital Region Cars can’t deny knowing they are fake. One comment
even, bashes a competitor that is down the block “tower auto”, pure slander/libel.
They cannot even claim they didn’t know they were there because they take the
time to comment on all bad reviews and even point out the fake bad reviews.
David [redacted]  (owner)has also reviewed himself
twice giving them 5 stars. (not allowed)
As, they stated the
paperwork was signed on 3/20/18 we instructed not to date it. Which in itself,
is a violation, because the mv-50 should not be signed until the vehicle has
passed inspection and is safe for title transfer by NYS DMV law. The car was
promised to be ready on Thursday 3/22/18, it was not. We were told they has 7
days per NYS DMV vehicle safety(see attached file). After speaking to them on Friday
3/24/18 in the AM, they said that is doesn’t exist. They also verified that no
lien had been place on the vehicle. In addition, they noted the car had not
passed an inspection in 2 years. At this point, we went back to them at noon
and requested a refund. The bank sent over verification stating no lien had
been filed. And they still refused. That is when I called the police. See
attached file. Then they said the vehicle would be ready Saturday. We live not
to far and watched them working on the vehicle at the shop. There is a reason the
vehicle would not pass inspection, after 3 days of trying. Something else is wrong
and it is unsafe.
Also, attached is the
audio, of them telling me to take the un-inspected vehicle and drive it to Syracuse
with their dealer plates because their own personal cars they drive with their
children in are uninspected.  Not okay because
the car still has not passed. Yet it is right back on their lot. The file was to large to send. I have sent as a reply to this email.
They also used my photo,
to promote a contest without my consent. They are luring people in with their
false advertisement on their google reviews.
