hired Capitol Bath Inc. and it's owner Len to renovate a small bathroom in my house. I provided all the materials and wrote a check separately to Capitol Bath for the tub and the drain. All they would have to provide is demo and labor. He said the job would take only 4 days and he assured me that he and his crew have been in the business for a while. He also stated that he does not use day laborers or sub-contractors. This proved to be false! I paid him 1/3 of total cost at contract signing and paid a second 1/3 of total cost at Day 1 on the job.
Day 1: He showed up with two day laborers, one spoke decent English and the other spoke no English. The demo was complete and he had a plumbing sub-contractor show up to get the shower and bath pipes correctly positioned for the bath tub, which would be installed the next day.
Day 2: Owner Len ordered the wrong tub and tried to blame me. I have the email that shows that he would order the tub we requested. So, he either can't read or didn't care. He then said the plumbers would have to come back and reposition the pipes for the tub I wanted as it would sit higher than the wrong one he ordered.
Day 3: 6 days after the start of the bathroom project and he brings over the correct tub and said I have to pay his plumbers $250 extra to fix the pipes and set the tub or they will leave. Again, this was his mistake and he should have paid for it. This is a strong arm tactic. I am stuck and want this project done so I wrote another check.
Day 4: Len shows up 5 hours late, with no communication, my wife cancelled all her business appointments as this was supposed to be the big day for completing the final prep, so the tiles can be installed on the floor and walls. My wife told him that all of that above mentioned work needs to be completed today as she can't take off tomorrow. Len blew up at her and disrespected her. (This bathroom is 30 sq. ft. and the sub floor and wall prep should take no more than half a day if you know what you're doing). Angry Len grabs his tools and utters some coarse language and leaves. I texted him that I am terminating him from my bathroom project and that he needed to bring the remainder of my money minus the demo work he did, to me today. He called me that evening and said that I would never see that money!
So, as of now I am out 2/3 of my project money I gave him in good faith minus his 4 hours of demo work. I am forced to contact the State of VA for assistance and will take Capitol Bath Inc. to small claims court to retrieve my money. This is sad that Capitol Bath and its only employee/owner treat customers this way.
