In response to the claim above, we have spoken to the client and have agreed to send a refund in the amount of $300, which has been sent out today 9/12/14.

Review: We contracted with Capitol Chimney Service on August 13, 2014 to repair damage to our chimney. Their incorrect assessment and negligence during the job has resulted in an invoice amount that we do not believe is fair and damage to our house.

Our previous deck had been bolted to the chimney so we had several holes at the chimney base into which water was coming into our house. There were also what appeared to be thermal cracks along the sides of the chimney.

Based on a ground inspection (no effort was made to climb upon the roof and examine the chimney), we were told by Roger V[redacted] that the chimney needed to be torn down and rebuilt. He also stated that we could go to a brickyard and select the brick that we would like our chimney to be rebuilt with.

On August 15, 2014, a crew of three arrived to begin demolition of the chimney and immediately ran into problems. The chimney turned out to be cement, and the crew thought the chimney was brick. Consequently, the crew left to rent equipment and returned later in the day to continue the demolition with little success. During this time, Mr. V[redacted] informed us that the demolition was substantially more complicated than the initial quote.

At the end of day August 15th, the crew dropped off the bricks we had selected. They also cut the straps holding the brick together. The crew stated that they would return on Saturday with different equipment to continue demolition on Saturday, August 16th. Later on the evening of August 15th, my husband spoke with Mr. V[redacted] and authorized the crew to continue the cutting of the chimney to make the portion of the top that had been cut even since only jagged chunks had been removed. Picture is available upon request. My husband and Mr. V[redacted] agreed that if the work necessary to make the chimney even was successful, they may consider continuing demolition. Mr. V[redacted] stated that he would be by our house either beginning or end of day on the 16th to follow up in person.

On August 16th, the crew returned with hydraulic saw and attempted to cut the top evenly. Their carelessness with the saw caused water to flood into our basement since no attempt had been made to cover up the holes at the chimney base. Consequently, my husband had ¼ inch of water that he had to clean up. Furthermore, the crew did not close the damper of the chimney during the demolition process, and as a result, the first floor of our house was covered in chimney dust. As we have a young child, my husband immediately started cleaning (including five hours steam cleaning the carpets and wiping down numerous toys and furniture items). Throughout the day, my husband tried to contact Mr. V[redacted] without any success. My husband also found that scaffolding erected by the crew was nailed directly through our shingles, necessitating their replacement. Furthermore, he found that our back gutter had been smashed by falling cement from the chimney.

Mr. V[redacted] showed up that evening. He offered to pay for a cleaning service to address the issue caused by the chimney dust, but my husband told him that it had already been addressed. They mutually agreed that the course of action was to rebuild the top of the chimney (cut off earlier that day) and parge the chimney base. Mr. V[redacted] also stated that the bricks we had selected were not returnable. He also indicated that my husband and I would be responsible for covering the cost of the unused bricks since he would not be able to use them at any other project sites, although he could reuse the cement. I contacted the brickyard, which stated that bricks were not returnable unless strapped, and the crew had cut the straps on the 15th.

On August 18th, a crew came out to rebuild the top of our chimney, parge the base, and replace the ruined shingles. We were informed that they would be back the following day to wash the roof, add a chimney cap, and provide us with a final invoice. I stayed home all day on the 19th to accommodate the schedule provided, and no one showed up. It was not until 5:45 PM that my husband received a text message from Mr. V[redacted] stating that the crew would come out on the 20th instead, which they did.

We performed a cursory roof inspection on August 25th and found a hole in our roof, which the Capitol Chimney crew covered with new shingles. Picture is available upon request. I believe this is intentional negligence that could have caused significant damage to our house if we had not proactively found it.

On August 25th, we received a final invoice from Capitol Chimney Service for the time and materials used by the crew, including several hundred dollars in bricks that were never used and not returnable because the straps were cut. In discussing with Mr. V[redacted] on multiple occasions, he stated that he was not making any profit on this job so the invoice reflected only his costs. However, these costs were incurred based on an incorrect assessment he made that our chimney needed to be demolished and rebuilt. We have since had another chimney company perform an inspection of our chimney, and they were aware that the chimney was cement and asked if/why Mr. V[redacted] did not climb on the roof for an inspection before giving us a quote.Desired Settlement: We object to the following items on the invoice:

1. We do not believe that we should pay for the unused bricks. The crew cut the straps on August 15th, before a firm decision regarding the demolition had not been made. Additionally, the brick was bought based upon Mr. V[redacted]’s incorrect assessment of the chimney demolition and rebuild.

2. Using the same logic as in point #1, we do not believe that we should cover the entire cost of the bricks used to rebuild the chimney top.

3. We do not believe that we should pay for all of the equipment rental fees. The crew and Mr. V[redacted] should have communicated more clearly after it was determined that the chimney was cement and not brick and stopped the demolition at that point. As the chimney experts, we would have expected them to make that decision.

4. We do not believe that we should pay for all the labor costs – again because a substantial portion of this labor is attributable to the incorrect assessment.

5. We believe that there should be some consideration for the time and effort my husband expended cleaning our house. While Mr. V[redacted] offered to pay for cleaning service, this offer was made hours after the damage was done and he was not reachable during the attempts to contact him during the day when the incident happened.

As an act of good faith, we are not requesting a credit for the damaged gutter, nor do we expect Capitol Chimney to cover the entire portion of labor and equipment fees. But we are asking for consideration to the invoice based upon the points listed above.

Finally, we expect any repair costs to our roof caused by the negligence of the Capitol Chimney crew to be reimbursed to us. We will provide a copy of the estimate once received.

We look forward to working with Capitol Chimney to reach an amicable decision regarding the invoice amount.
