This builder has put us through [redacted]. They are now trying to strong arm me into signing a gag order, and have basically black mailed me.We have had ongoing issues since we purchased our home. Of course what do you expect when an organization goes through people like they do??? We worked with 4 different project managers in just over a year, 3 of which are not employed with Capitol City Homes any longer. That should have been a red flag when their staff drops like flies. When we bought the house, our driveway was to have a permanent sealant concrete stain applied within 14 days of closing. It took about 3 months to even get them out to the house. When they contracted a company to come out to pressure clean and apply the stain they cracked our driveway. Their response to the crack was driveways are supposed to crack and it's not granite or marble. On top of that the product they applied failed and pealed within a few days. Their response was of course that they've never seen that happen. At that point I wanted the product that failed stripped removed. They said that wasn't possible as it would compromise the integrity of the driveway. They essentially ruined our drive-way and as a result should of replaced it right then and there. They apologized and say they will apply a product that will work and will also address the crack. Meanwhile the project manager we were working with left and we got pushed to the side which is a common thing with Capitol City Homes. Fast forward several months later and the crack of course as time goes on has gotten worse. When they applied the 2nd coat they never addressed our crack and said if they do it will look worse. Guess what, coat 2 failed as well. It was apparent to me that they were never going to take responsibility nor do the right thing which is replace our drive-way. It wasn't until a call for action was necessary and I had signs made to caution other perspective buyers from going through the same nightmare I have. Within a couple of days they replaced my drive-way only to then damage custom lighting I had installed which the damage ended up being just shy of $600. There are a few other pending issues as well that still haven't been resolved. The said they would take care of the bill for the lights as they realize they were responsible for the damage but not until I sign a waiver gag order. Basically strong arming me into something their lawyers drafted. I stopped by the Capitol City Home corporate office to meet with Andy, who said their all about happy home owners, which is complete hogwash. I told him had that been the case I would of never have had to go through the trouble of having the signs made in the first place. He was supposed to of called me back yesterday and didn't. He was tough to get a hold of today and basically said there not going to pay unless I sign their gag order releasing them from any future liabilities that should ever exist and preventing me from my amendment right. The sad part in this whole thing is Capitol City Homes didn't even reach out to me at any point. It was [redacted] with [redacted] that reached out after seeing my signs, called me and said she would talk to the owners to see what could be done. She was amazing until she washed her hands as she felt the dispute of the waiver was between me and the builder. Really and truly she went over and beyond and should of never of stepped in the first place. All Capitol City Homes is good at is apologizing. Right is right and wrong is wrong. They make it like they somehow did me a favor by replacing what they broke a year and an almost half later.Desired SettlementDue to the outstanding issues that are still unresolved at this point I'm seeking $5,000/ and or for them to pay the invoice for the damage they caused to our lights, replace our sod, replace our front door as promised, etc.Business Response Contact Name and Title: [redacted] GenCounselContact Phone: [redacted]Contact Email: [redacted]@shipmanlaw.comMr. [redacted] has time and again used threats and untruth to force his will. His subversive behavior is a problem in his neighborhood and in violation of the rules and regulations as well as the Declaration of Covenants for the community. The appropriate resolution of disputes is lost on him as one can easily surmise from the tenor of his complaint and his online rants (not to mention the signs in his yard which infringe on all his neighbors enjoyment of their homes). Capitol City Homes has always willingly communicated with Mr. [redacted] to negotiate a resolution to his issues with standard warranty repair approaches. Unfortunately, he decided to resort to defamation and threats to cover for his own bad choices with regard to his driveway and his yard. With counsel, Capitol City even still made attempts to satisfy Mr. [redacted] in exchange for industry standard mutual releases. Mr. [redacted]'s own behavior and inability to be satisfied or adhere to an agreement is what has put him in his current situation. Capitol City Homes will respond further only through counsel and Mr. [redacted], if he has valid claims, can expect to have them addressed in an impartial setting with the courts should he have further demands. Consumer Response In response to Capitol City Homes implications that I have infringed on the enjoyment of my neighbors enjoying their homes, that is simply not true. If need be I can produce other neighbors who have had similar problems with Capitol City Homes taking care of issues such as I've encountered in a timely fashion. Capitol City Homes has gone as far as to text several of my neighbors implying that my actions might possibly cause their home values to decrease in value which is just unethical for a business to behave in such a way. Capitol City Homes is also texting neighbors asking for favorable reviews from them to counter mine and others dissatisfaction with their company. All I wanted was to get my issues resolved without sacrificing my rights for possible future issues that may arise. I am willing to sign a specific waiver on these specific issues but am not willing to sign a blanket release for any possible other issues that may arise. The specific issues that have still not been resolved are the payment for the damage to the lighting, replacement of sod, and our front door that was supposed to of been replaced last Monday. Final Business Response Capitol City Homes has not engaged in any unethical behavior but has simply solicited reviews from happy customers to counter the defamatory campaign launched by Mr. [redacted]. The company is entitled to defend itself which it intends to do should Mr. [redacted] choose to pursue his unfounded claims in a court of law where the same rules, including the duty of truth, apply to everyone. We will not be responding further in this forum but welcome the opportunity for an equitable resolution as was our initial intent.

I closed on a newly built home by Capitol City Homes December 30, 2015 [redacted] subdivision NC. The drain pipe was poorly covered with grass and started to eroded by the end of January, 2016. I was told by Capitol City Homes that after closing items that needed repair should use the loose leaf book containing the names and telephone numbers of the sub contractors who worked on the house. I called the landscaping sub contractor in April asking that they come out and look at the drain pipe and landscaping around the the pipe. I was told they would get out to the house. After about 5 weeks I contacted the management company that all complaints should go through concerning Capital City Homes. The management company came to the house took pictures and passed them on the Capital City Homes. Today, July 25, 2016 I was told by the management company [redacted] P.O. Box XXXXX, Raleigh, NC 27605) that Capitol City Homes will not make any repairs due to the fact I did not water the grass. I started working with the management company the first of June, 2015 and after almost two months the management company gave me the message that Capitol City takes no responsibility for the poor workmanship. I will include photos with this complaint.Desired SettlementTo repair the landscaping and the drain pipe since the water backs up and sits after each rain storm -- it has to fixed so that water drains. The original workmanship is poor that if not repaired immediately I will have to have my driveway replaced. Business Response This issue has been resolved. Capitol City Homes added "rip rap" to the end of the driveway culvert on Friday 7/29/2016 to stop the erosion. We have pictures of the culvert before and after. If you would like a copy please let me know. Capitol City Homes considers this matter closed. Thanks Consumer Response I am not sure what a rip rap fix entails but it rained very hard over the past two days and the water runs off, the eroded sod has been removed and replaced with stones. This solution in an improvement and appears to be repaired Final Business Response It appears to me from the consumer's response that Capitol City Homes has fixed the issue. We believe no further action is required.
