Please see attached picturesAfter stopping by the customer's home to review the area in complaint, I found that the customer needed help adjusting the outdoor canopy to which he placed up on his patio areaThe pictures show that the canopy fits perfectly once it was adjusted.Please consider this
complaint resolved and close this matter

*** With regards to this complaint, the customer complains that the apron installed isn't even on both sides, but this apron was replaced as it was already existingOne side went straight down and the other went outward on an angleAs far as what any town or county plow trucks may or may

Dear ***,It’s unfortunate that Mr*** does not want to stand behind his company’s work! It would be best that he stop blaming the sealerThe ponding, raveling, and cracking issues occurred before the driveway was sealedThe cracks only became more pronounced as time went on.Every time Mr*** was scheduled to meet me at the house to go over these issues he decided not to have me presentThis created a problem, because he would downplay what my actual issues were later on the phoneIt’s now clear why Mr*** several times never met me at the house as he said he wouldI say this, because he is attempting to manipulate the facts by referring to cracks related to the sealer, when in fact they are not! How is it that the sealer decided on its own to only go where the cracks that I’m referring to are located, which are primarily in the areas that were excavated by *** Paving? Please keep in mind that the cracking is not the only issue! The rough surface from excessive raveling, and ponding issues still remain.Mr*** and I can go round and round about this, but it does not change the fact that his company is responsible to provide me with the product that was paid for!I will be forwarding additional documentation related to communications with Mr*** shortly after this email is sent.Regards,*** ***

***This was the last email I sent to Mr*** on November 25thHe never responded, so I filed my complaint with the Revdex.com.Nick,It’s unacceptable and very unprofessional that you are trying to marginalize the problems with the driveway! It’s now obvious that you’re attempting to exonerate your company from any liability related to the improper installation of this new driveway The email I sent to you on October 2nd clearly indicated all the issues with the driveway, which you were made aware of prior to the expiration of the year warranty.The cracks I have been referring to since September 1st are not surface cracks, but substantial cracks within the substrateThese cracks are mostly located along the new areas that your company excavated to widen the drivewayThe driveway was sealed by a local and reputable paving and sealing companyI used this company in part because I wanted a second opinion regarding all the issues I was havingWithout question, the experienced paving and sealing company agrees that the issues that I mentioned in my October 2nd email with the driveway are valid.A new driveway should not have this many problems, especially the severe crackingI fully expect *** paving to resolve all issues to my satisfaction.Regards,***

First of all for the record, Capozzi Paving employee(s) came on my property without my or my wife's permission to do so and I no longer want anyone from Capozzi Paving on my property againIn the picture they submitted, they had kicked in the side of the canopy to make it look like it fits. In my pictures, it shows heavy rocks to help anchor the canopy because it hangs off of the edgeI wanted to be home in order to show Tony with a tape measure that the patio that they poured was short on both the length 20' and the width 10' and show him how my canopy hangs over the edgeI had tried on multiple times to reach out to Tony (our salesman) to see what Capozzi Paving would do to resolve our complaint. I have a record of the calls I made on my cell phone. When I finally got a hold of Tony the only response I received from him was laughter and he stated " there was nothing they could do now and good luck trying to pursue anything". I was shocked at the response I received from a company that I hired to do the jobApparently this is how they treat their customers after the job is done and after the job is paid in fullThe contract CLEARLY states a 20' x 10' patio and no where on the contract does it say that it may come up short of that dimensionNot like the pictures I have attached clearly showing the patio was poured short. I also attached another picture of a drawing that Tony our salesman drew himself that CLEARLY shows a 20' x 10' picture of the patioBecause, I no longer want any Capozzi Paving employees on my property the only offer I would accept now would be a prorated refund for the job not being done to what I asked for, a 20' x 10' patio, and the inconvenience of having an outdoor canopy that needs to be anchored by heavy rocks to keep it stableOur contract is a "Legal Document" that I believe will stand up in court

old apron was uneven, one side went outward at an angle, and the other side was
straightThis was due to the fact that we had a concrete parking pad butting
up against the apron on the straight sideI discussed removal of the pad with
Nick, and we paid Capozzi to remove the broken concrete parking pad and apron
and to "install" a new apron, not to "replace" the old apronCapozzi's response to my complaint indicates that they "replaced" the existing apron. My
contract/invioce reads "install blacktop apron; add stone to base &
roll"My expectation is that they would install the apron correctly and
evenly because there was no longer any obstructionWe would not have knowingly
paid a contractor to "replace" the broken, damaged, uneven apron in the same
manner. If Capozzi's intention was to "replace" our damaged apron in kind, they should have communicated that to us on our contract, and we would not have chosen to do business with them. We paid for the installation of a new, quality apron. See attached photos of invoice and "replaced" uneven apron (IMG_3655).Capozzi's response also did not address the 4-inch section of the driveway they
completely missed on the right hand sideIf I back my car out the the driveway
straight along the right side, I run over grass because they neglected to ensure
that the apron (past the sidewalk) is aligned with the driveway on the other
side of the sidewalkSee attached photo (IMG_3656)
Finally, Capozzi took it upon themselves to extend our blacktop apron 12-
inches into the roadI certainly did not request them to do this, nor did I
pay them to do thisBut, because they did, our apron is likely to be damaged
by snow plowsWhile I agree that plow damage should not be their
responsibility, they should not have extended our apron into the roadPlease
see the attached photos of the work Capozzi did (IMG_3753(1)).Capozzi offered no concessions in their response. I do not accept

This customer has been scheduled for repairs with regards to their driveway concerns and has been advised of the repair dateThe customer has also been advised that any dates for work are ALWAYS weather permitting

They have been unreliable in the past in setting a date and then not showing or calling to let us know that they were not going to be here and when they would be able to come backThey can say they will be here Sept 3rd, weather permittingBut seeing is believing!!! I DO NOT WANT TO CLOSE THIS CASE until I see that they will actually show up and resolve this problem

*** convinced me he was going to do.He then chose another contractor to work on his driveway, which he has the option to doAfter the other contractor seals his driveway with an inferior and cheaper product he calls me and says there are all kinds of problemsI want out to his house and looked at the drivewayThe issues were very clear to me and I knew exactly what happenedHe claimed he has cracks in his drivewayHe has more than cracks now which were caused from the improper additives being installed in the sealerAll the cracks are surface cracks into the top coatI explained this to him and clearly told him that because he had another contractor work on it I will not assist in anything.Today December 10, I was in the area and stopped and looked at the driveway againThe driveway is in perfect structural conditionI wish Mr*** the best but I am not interested in doing any business with himHis choice of another less qualified contractor caused the sealer cracking.sincerely,Nick ***, president
