I am rejecting this response because:
There was never any work done by Capstone The neighbor on the effected side of the house will also attest to that I have requested any information regarding work they are stating they have done, and they have not provided me with anything Capstone's only concern is slapping up homes as quickly as possible, and after sold they ring their hands of their responsibilities There are dozens of unsatisfied homeowners in this development, and Capstone continues to shirk their duties

Mr*** is correct in stating that we were going to resolve his property concerns once the neighboring lot was sodded, which we didWe, as a builder, are bound to comply to the city engineers grading plan, and we are not permitted to make any changes to the grading planWe, in fact, are unable to
obtain a certificate of occupancy for a home in Burnsville without an as-built grading certificateWhen Mr*** purchased the home, his lot was graded per the grading planDue to the fact that the lot next door was empty, we (as a standard business practice) review the neighboring lots and do a touch up grade if wash outs had occurred or if there were silt fence failureWhen we sodded the neighbors lot, we did do the touch up gradeThe homeowner did raise concern that the swale was too wetHowever, the swale was doing exactly as it was designed to do, and again, we had met the requirement of the grading planwas the 8th wettest year in Minnesota’s history since the 1800’sCombine that with clay soil, and the fact that he and his neighbors were still watering their lawns (which no one clay in soil in Twin Cities area should have watered at last year), created over saturationMinnesota regulations state that there is no warranty on sod/landscaping, in part for this very reasonWe, as a builder, have zero control over moisture and how the yards are maintainedWe did what we as a builder are required to do, and that is to present a sold home with a yard that is compliant to the grading planAny erosion or grading changes that occur by moisture or homeowner maintenance, or changes to the lot, etc… are not covered under warrantyCapstone Homes has met all obligations regarding grading of Mr***’s lot

I am rejecting this response because:I would like Capstone to provide or address the following:1) Provide a detailed description of the pictures they attached in their response. I understand the 2nd picture is of the weep holes on a window that slides up and down but I'm not sure how water flows outside the home on a slider / side-to-side window. Also, picture 3 appears to be the exterior of the home, upside down but it is unclear.
2) Weep holes in between the screen and our glass window does not explain the issue of how flies are actually entering our closed and locked windows.3) Their explanation is that bugs are getting in through the weep holes from the outside of the house but that does not address what's happening during the winter months when we've had a few warm 40 degree days. How do they explain flies living in the walls / warmth of our window and how they're getting into the home, again, through a completely locked and sealed window?Finally, I'm not sure how their Trimpac representative could conclude that the windows aren't defective when he himself said he has the same issue with his Windsor / Trimpac windows and flies are getting in his home as well. Flies should not be able to enter into a closed and locked window if the window was installed properly and there are no gaps or holes where bugs can enter the home. We have lived in 4 different homes within the past 10 years and this is the first time we have experienced this issue with our windows. It is obvious that Capstone chose windows to save on costs but Windsor Windows did not deliver a quality product that homeowners will be satisfied with. I expect this will be an ongoing issue if they continue to purchase their windows through this supplier. I did not agree to have Windsor come and look at my windows, when they already concluded there was nothing wrong, which is why I am hoping the Revdex.com can help us come to an agreement on a solution that satisfies both parties.

Dear Mr & Mrs [redacted],   Thank you for your recent communication on your concern.  Capstone Homes has provided an inspection of your windows, October 27, 2017. The technician per the letter we received from Trimpac the supplier of the windows stated there were no defects in the...

windows causing the insects to come in. (see attached letter) We have also attached pictures showing the mechanics of the window and how a window is not completely sealed due to the weep holes. They cannot be sealed to avoid moisture sitting in the window instead of running out and away. In the email sent on 4/4/2018 we offered to have Windsor Windows come out to reinspect the windows as they are the manufacturer. We were notified of the complaint to the Revdex.com so the inspection by Windsor Windows was canceled until further notice. However please note we are willing to open the inspection ticket with Windsor Windows if you request this.

After assessing your home, we have come to the conclusion that the nail pops and taping you are having concerns with are not warrantable items.  We value you as a Capstone homeowner and we would like to offer to repair the drywall over the nail pops as a suitable outcome per your inquiry.  If this is acceptable, we’ll happily set up a time with you to get them taken care of.   Thank you, Capstone Homes

I am rejecting this response because: Builder is only giving me option to patch drywall and nailpops but not willing to fix the problem. There are 60-70 nailpops and taping issue all across the house which is a poor craftsmanship and using bad quality material. The resolution is not upto my expectation.
