I am currently pending in getting my deposit back and will not close this claim until it is returnedI have no faith in this company restoring my funds, being honest about the prior damage created in this apartment nor communicating effectively with meI have done my best in being polite, but at this point I feel Revdex.com needs to intervene to make sure that things are handled professionallyI have taken pictures of the apartment in every room and was notified via email through Jeff (the on site Cleveland property manager) that everything was okay with the exception of an issue with the front door with was resolved within 24/hours

My comments are below in red:This is a blatant LIENot only did this apartment complex recently took over this apartment building, but my lease was an extension from my past lease with a prior companyI can confirm this with the past leasing company in which we paid an additonal fee for having a dog after we were originally told we did not have to prior to moving into this building What I said is not a lie I have attached the lease agreement for everyone’s review This is the lease agreement they are operating off of as it expired 8/31/which is when they moved out So obviously, this is not an extension agreement It is a lease agreementPlease see the “Rules and Regulations” which are attached to the lease and signed by the tenant Under the section titled “Premises”, and under item titled “Tenant is prohibited from the following”, please review item “b” which reads “Having any pet or pets.” I think this is pretty clear I also do not this I am being unreasonable to ask that I have a chance to walk through this property to determine if there is any pet odor or damages caused by this pet prior to returning the deposit It is my right under section of the lease agreement and under state codeI have days to return this deposit I will be on site before then, most likely in a couple weeks from now, and I will walk the site If I determine at that time that the property is free of damages from the tenant or their illegal pet, then I will return the deposit immediately These actions are governed by the state of Ohio and I would argue that I am operating within these boundaries and that is to be considered professionalI would also add, that at closing, when I purchased this building, I was given all lease agreements, extensions and addendumsAs you can see by the attached lease agreement, this was not an extension as mentioned above, there was no additional documentations showing a pet is aloud and more monies were exchanged for this privilege, and the landlord and property management company did not give us those funds at closing leading us further to believe that this is not true This matter needs to be resolved immediatelyAs mentioned above, it will be resolved in a timely manner, within our day time limit However, now that you brought to our attention there was a pet living there illegally, I simply want to confirm personally that there is no pet OdorI do not think this is unreasonable Jeff has no control in this matterThis leasing company is fraudulent and unprofessionalOnce again, those are big claims The only unprofessional thing that has been done here is me telling [redacted] I would block his number after he called me times in under minutes while I was sitting in a paid continuing education class on a Saturday or SundayAs for the fraudulent claim above, that is a serious claim and absolutely not true If these statements continue, I will bring a suit for defamation and slanderAs I said in the prior email in which Jeff said the only issue with the apartment was the door and since that has been resolved we need to have our deposit back immediately I have had nothing but issues with this company from not responding to our complaints with us not having hot water for over days, having to get the city involved as well as the owner Bryan being completely disrespectful in threatening us not to contact him any further or else our number would be blockedAgain I can prove all of these issues via email and picturesI have answered all of these issues above but I will do so here again since you are now repeating yourself Jeff has no say in this matter You had a pet there illegally Now I have to walk through it I live in Columbus That means a hour round trip just to see if there is a bad odor from your pet I should not have to drive to Cleveland for this I should be the one placing complaints against youAbout the hot water, the gas company was the one who shut off gas We found out on a Saturday Our plumbers and the gas company don’t work weekends So we had a plumber there Monday morning at We tested all of the lines that the gas company asked us to check We fixed all of the leaks that Monday The gas company came back out Monday night and found a leak in a different line Once they informed us of that on Monday night, we send the plumber back Tuesday morning We had all lines at this time tested Even beyond what the gas company asked for We resolved those issues TuesdayThe gas company was there first thing Wednesday morning and turned gas back on I would say we reacted very quickly I would also argue that we operated professionally as we went the extra mile, did more work than was asked of us and never has a single working day lapse between each concern raised by the gas company Every time there was a concern, we has a person there the very next working day That is professionalism And you are right I did tell [redacted] I would block his number if he called me again He called times in less than minutes You do not need to provide proof because I admit to telling him if he calls again I will block his number He called times while I am in a continuing education class which was paid for and mandatory for me to be there If you miss even a few minutes of the class you will get an absent mark as though you weren’t even there On my lunch break, that Saturday or Sunday, which is not a business day, I called all of my staff and communicated to Dion That was within hours of receiving his phone callsThat is very professional I responded on a non-working day and spent my entire lunch break working to resolve this issue and it was resolve very quickly

I have simply copied her complaint and I have given responses in red:On September 29, 2016 Captivating Homes was contacted by *** *** regarding no running hot water in the apartment building specifically unit #1. September 29th, 2016 has not passed. This is confusing
to me. I believe they are referring to July 29th when our gas was shut off by the gas company due to them finding a leak at the connection of the gas line and the boilerThe tenant has running water but no hot water as the hot water tank is a gas hot water tank. So the claim above is not true. They said they had no RUNNING hot water when in fact they did have running water but no hot waterThe gas company turned the gas off on the evening of Friday July 29th. I was informed the morning of Saturday July 30th. My office, our plumbers and the gas company are closed on Saturday and Sundays. Therefore, I had my plumber at the property the first working hour of that Monday August 1st. He literally showed up at 8AM with all of the tools and materials needed to fix the issue because I had a handy man there Sunday to identify the problems and tools needed so our plumber could show up ready to fix the problems and not spend any time identifying problems or making material runs. Because of our good planning and willingness to work on Sunday, he fixed the leaks the gas company requested. The gas company came back that Monday evening to turn gas onThey found another leak in the line to the hot water tank and refused to turn on the gas once again that Monday evening. We had the plumber back on Tuesdaymorning and paid him to test ALL gas lines and plumbing lines. He identified the leak in the pipe to the hot water tank (Which was not identified on the first trip from the gas company). We fixed those leaks/connections Tuesday morning and the gas company came back Tuesday night to turn gas back on. We passed that inspection and gas was turned back on. The pilot lights were light Wednesday morning at 8AM and they had hot water within hours as it takes hours for the industrial sized hot water tank to heat up. As shown in our time lines we acted very quickly getting the right people to the job site at the first working opportunity and resolved the issue quickly. In addition, we received no notice from the gas company prior to them shutting off the gas. They just turned our gas off without warning or notice. This is operating procedure for the gas company and as landlords we had this issue resolved as fast as possible and I think we did a good job at getting itdone in a timely manner. Also, the tenant was informed every step of the way. Every time we communicated the steps as mentioned above, they would yell and scream and tell us how upset they are with us. As a result we gave them $of their August rent for the inconvenience. So not only did we act quickly but we compensated them for the inconvenience even though we were not legally required to compensate them as this was caused by the actions of the gas company. This claim should never have been posted.Since this date, Captivating homes has yet to resolve the issue. The issue was resolved as mentioned above.The owner of the company has threatened (text messages to provide proof) to block the tenants number as well as they have not provided up-to-date detailed reports of why and how the problem will be resolved. During the Saturday of July 30th, I was in a continuing education class from 8AM-5PM with a working lunch. During the morning of this day, this tenant called me times back to back while I was in class. If I stepped out I would not get credit for the class and I paid to be in this class to learn. After the 44th back to back phone call, I informed them through a text message that I would call them on my lunch break and to please stop calling and if they continued to call I would have to block their number while I was in class because it was a huge distraction. I informed them to call Jeff, who is my business partner, if they needed immediate assistance and I texted Jeff asking him to touch base with the tenant and he didI called on my lunch break as promised and Jeff already had our plumber scheduled for Monday morning. I called the plumber to confirm and ask if he could get there sooner than Monday and he could not as he was out of town. So I called another one of my workers who is a general handy man to go look the issues over, let us know what tools our plumber will need to bring and let us know what materials to bring. This allowed my plumber to show up first thing Monday and be ready to work increasing the efficiency and saving time. In addition to this current concern, the tenants (*** *** and *** ***) have received no written or documented notice of their electricity being turned off to work on the electrical lines; this has occurred 2-times all on degree temperature days in which they have an animal on the premises as well as *** *** is pregnant. This is a flat out lie. We were forced to replace all of the electric panels by the City of Cleveland Heights and our insurance company because the panel boxes were out of date and could cause a fire. We placed notices on everyone's door stating when the electrical would be off. We were forced to turn electric off times to get the electric panel boxes installed, inspected, etc. Those were installed and the permit was issued by the local city municipality. They were definitely notified. They did call our offices when we turned the electric off those two days and we told them exactly what we put in the letter we posted on their door over the phone and they still were not happy. We understand the inconvenience of having electric off but it was off for a day at a time times for reasons out of our control as we were informed that we had to make these replacements by the City and our insurance company as they were a fire hazard. The way I see it, we have spend an enormous amount of time and money and resources making this a nicer and safer place for them to live. There was a third time the electric was cut off for a day period because a tree limb during a high wind storm was blown down and took out the main power line supplying power to the building. We called the electric company immediately and they began working on our repair. Again, this tenant called our offices complaining and we informed them that this was not caused by us and is not repaired by us and that they would need to contact the electric company for details as this problem is resolved by them. We told the tenants what the electric company told us but they still were upset with us. Also, this complaint mentions that they have a pet residing on/in this premisesIn section of their lease agreement, it is very clear that they are not permitted to have a pet on this premises so they are in violation of their agreement and have lied to us about this issue. *** *** has made several attempts to contact the city of Cleveland Heights to resolve this matter as well as consulting legal aid and the Cleveland Tenants OrganizationOver the past several months in which this company has taken over the apartment building, communication has been a constant error. This is incorrect and a flat out lie. We had many communications back and forth with these particular tenants. Every time there has been an issue or a call we have responded very quickly and with professionalism They have expressed frustrations that our offices are not open on Saturday and Sundays but every single business day our offices are open they get and have received an immediate responseThere was one time they got very upset. The gas company was in the basement of our building and they found a small gas leak at the connection of the gas line and our boilerSo they turned our gas off on Friday evening and I was informed on a Saturday. That Saturday I was in a continuing education class and while in class, this tenant called me times back to back Captivating Homes refused to provide contact with the tenants on dates in which their window installation would be completed causing disruption to their daily tasks (it took months to complete the project with management refusing to intervene) as well as not providing them with updated information regarding workers that will be entering the building between the hours of 8amoften times 8pm Monday-Saturday. This is correct. We installed new windows in the entire building. Pulled city permits and passed all inspections. They told us they would be happy if we installed all new energy efficient double pane vinyl windows. I am very confused and surprised to see this as part of their complaint. They are correct about their unit taking a day longer than anticipated. There was a contractor schedule to be at their house on a specific day to install their windows. This guy did not show up. He was a sub contractor hired to do a job. Some body I did not have a previous relationship with. When I was informed that he did not show up that day, I fired him, asked him to return my deposit which he didAnd that day, I schedule another time for a different guy to go in and hang all of their windows. We booked a time and it was done. He was there to install the windows and insulate them. We had another guy coming back on the next available day to hang trip. The tenants were upset because they wanted the windows to be installed and trimmed with casing the same day. I informed them that it takes days day to install and insulate and day to trim the windows out. The another day install metal wrap on casing outside but that is a moot point because we did not need access to their unit to do this. They were upset because we had to come back a second day to do trim. But we did schedule it and installed the trim as promised. Again, we upgraded their property without increasing their rent. Therefore, they are now receiving a better, more quality and more energy efficient product for the same price. They told me they were happy about this so I am surprised they have issued a complaint about this. Their only complaint with me was that we needed access for days instead of one. Both *** and *** have attempted to work out agreements with this company regarding their concerns, but are consistently invalided and dismissed. Another lie. We have done everything we said we would do. Gave them a nicer and safer place to live. Communicated well. Solved all of the problems that were created by people other than ourselves. Acted in a timely manner. These claims are bogus and should be thrown awayWe even compensated them for an issue not caused by us. To be frank, I am offended by this complaint. In years of operating real estate businesses I have never had a complaint like this. Much of their complaint is false/lies and the rest of the issues were created by utilities companies which we solved in a timely and professional manner
