Dear Revdex.comI am writing this letter today in response to a concern filed with the Revdex.com by Ms [redacted] of AZWe had recently sold a vehicle to Ms [redacted] on 9/22/Ms [redacted] bought the vehicle from Car Cafe LLC with no warranty written or implied through Car Cafe LLCAt the time of vehicle purchase Ms [redacted] did purchase a service contract for the vehicle from [redacted] CorpUpon purchase of the vehicle, Car Cafe LLC had the vehicle undergo a rigorous inspection process and performed all recommended service work through a reputable service center amounting to over $1,in repairsThe vehicle was then driven several miles by multiple people to ensure that all repairs were done properly and that no other service work was necessaryIncluding cosmetic repairs a total of over 2,000$ was spent on the vehicle before it was inspected and purchased by Ms [redacted] Ms [redacted] flew down from AZ to personally inspect the vehicle and verify that it met her requirements before finalizing purchase on the vehicleAt the time of sale all paperwork was gone over with Ms [redacted] including forms and 3rd party service contract forms and copies of all documents to finalize purchase were given to Ms [redacted] Ms [redacted] then drove the vehicle from TX to AZ and took the vehicle to a service center and filed a claim with [redacted] Corpto have some repairs done to her vehicleMs [redacted] then reached out to us on 11/21/ and requested that we contact [redacted] Corpon her behalf as she had filed another claim and was having issues with [redacted] CorpWe reached out to a representative of [redacted] Corpto request that they re-open her claim request, and they agreedOn 11/29/Ms [redacted] reached out to us by email and stated that we needed to have the vehicle transported from AZ to TX and to issue a full refund due to "implied warranty." I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint Thank you for allowing me this late response. I would like to respond to Car Café, LLC.I understand what the Car Café is saying about the “As Is” documentHowever, it does not apply in this situationThere are some strong consumer protection laws in Texas against misrepresentation and lying This truck had been in an accident and they knew itI was told by Ben that the car had not been in an accident and he sent me a Carfax to make me think it had not been in an accidentIf I had known the truck had been in a previous accident I would never even looked at itHowever, Ben convinced me that this truck would get me home, but he lied.After some investigation and inquiries on my part, it turned out his truck had indeed been in an accident on 1/8/2017, the receipt from *** *** *** *** is attachedI called *** *** auto insurance that paid for the repair and they confirmed the truck was in a bad accident in January of The invoice was accidentally left in the truck According to Jeff at *** *** *** ***, Car Café, LLC uses this collision center frequently for their body work as they do not report accidents to CarfaxThe law states if the used car dealer has knowledge that the car was in an accident they must disclose itNo disclosure was made, in fact they made a point of lying about it, and I ended up with a fatal break down because of it The total repair cost for this repair will be $9500.00. I can offer Car Café, LLC to pay half of this repair $ I think that is fairAs you can see from the receipts attached I have already had repairs due to this accidentThey lied about the pinion bearings, they stated that it was tire noiseIt turned out to be pinion bearings as you can see on the receipt.I have discussed this with an attorney and he stated that Car Café, LLCmisrepresented and lied about the product they sold meIt is against the law to do that We will sue for full cost of the truck, plus costs such as taxes license, any costs from repairs already done, and attorney fees totaling $50K This truck has been down since 11/09/and needs to be repaired soon to prevent seals from drying out and cracking.Thank you for your help in this, please let me know what they decideI am about to sign a fee agreement with an attorney.
