The customer purchased a Nissan Altima from Car Land on
11/05/Ten days later, the customer called and stated that the vehicle was
running poorly, that it died on them and was making a loud noiseFor the
customer’s benefit, we sent one of our mechanics to the customer’s house to
pick
the vehicle upWhen he arrived, the vehicle started right away and ran
fine all the way back to the dealershipOur mechanics checked fuel pressure,
spark plugs and tire pressureNo codes appeared, and nothing wrong with the
vehicle was foundThere was no charge to the customer
The warranty that Car Land offers and that the customer
purchased is not a bumper to bumper warrantyIt is, however, a used vehicle
limited warranty that covers certain items, including the engine,
transmission/transaxle and the front/rear wheel drive for years or 24,
milesWith this warranty, Car Land pays for 100% of the total cost of the
parts and labor necessary to repair or replace the covered items, less a
deductible of $plus tax, which the customer is required to payThis
warranty and the items that were covered were explained in detail to the
customer at the time of purchaseEach repair that was made to the vehicle while
still under warranty ended up costing less than the $deductibleThus, in
the customer’s case, no warranty claim was ever made or needed to be madeSix times,
the customer’s vehicle was brought to Car Land for us to work on itEach time,
we located the problem and fixed itWe only charged the customer for the parts
at our cost and once did not even charge for labor
The customer made their payments fairly regularly for about
the first months until the customer unfortunately lost their jobFor the
customer’s benefit, we agreed to lower their payment from $per month to
$every two weeks until they could get back on their feet
The customer inquired in December about using their
taxes to pay off their accountAs of 12/26/2009, the customer’s payoff was
$7,The customer had bought the vehicle on 11/05/for $9,
This ***, combined with tax, title, and license fees came to a grand total of
$11,The payoff amount in December would have been much lower if
the customer had made their full payment of $every monthThe customer
did not pay off their account with their taxes
It is never in Car Land’s best interests to have to
repossess a vehicle, but unfortunately, we sometimes have no other choice
Though we made several attempts to try to help the customer with their account,
(lowering their payment, making arrangements with them, etc.) eventually the
account got so far behind that we had to repossess it on 04/24/We sent a
letter to the customer at *** ** *** *** in Farmington, NMThe
letter informed the customer that their present payoff, after rebating the
unearned interest, was $7,This figure included a repossession fee of
$159.56, two different repair order balances for $and $180.28, and a
certified letter fee of $The customer was informed that unless the entire
balance was paid in full within days from the date of the letter (days
longer than required by law), the vehicle would be sold, and the proceeds would
be applied toward their indebtnessThe customer was also told that they would
be held liable for a deficiency, if any existed, after the proceeds of the sale
were applied to the outstanding balance of the contract, together with the costs
of the repairs, cost of sale, storage of $per day from the date of the
letter, and other applicable charges, if anyLastly, the customer was informed
that if the money from the sale was more than they owed, they may be entitled
to the extra money
The vehicle was resold on 08/30/2010, days after it had
been repossessedThe vehicle was sold for $7,with an overallowance
traadjustment of $In addition to the fees mentioned above, the
additional allowable expenses were as follows: a storage fee of $1,
($per day), $worth of labor, $worth of parts at our cost,
$sales commission, and a $1,warrantyOnce the deductions had
been made, the remaining balance owed was $4,
Since 1999, Car Land has been a family owned business and
has strived to not only conduct business in a legal and professional manner,
but also to be a business that helps our customers in times of need to the best
of our abilityThe balance owed on this account is still $4,However,
it should be known that Car Land has no intention of going after the customer
for this deficiency
We have done extensive research in the customer’s account,
and to the best of our knowledge, everything is reporting accurately and
correctly to the three credit bureausWe always report as accurately as
possible to be fair to our customers that make their payments every month to
help build their creditIt would be unfair to our good customers to remove any
information from the bureaus that we know to be true
