As I have said, the time for any adjustment has passed.The effect on the customers credit report is unfortunate, but part of the repossession process.As we report to the credit bureaus monthly, a customer can dramatically improve their credit with on time payments...or damage it further with late payments and/or a repossession...as in this case.As I said, we would have gladly tried to work out some kind of arrangement for the repair of the vehicle at the time.We were not given that opportunity by the customer

We have tried to contact you on multiple occasions previously about this and you have not returned our emails or phone calls.I n addition, you have missed previous appointments you had scheduled so we could look at the car.The issue may be covered on the warranty for the car, and would therefore not be any charge to you.Please give our [redacted] office a call so we can schedule the vehicle for a diagnostic check and repair

The vehicle had a minor service issue which we repaired under the warranty on the vehicle.Unfortunately, [redacted] would not wait the day we needed to get the part and do the repair on the vehicle.We repeatedly attempted to contact him to pick up his repaired vehicle, which he did not.The vehicle was repaired quicklyIt was a minor repair, and if the tow or trailer bill (cost) was an issue...we would have gladly made an adjustment to keep a customer happy.The listing on his credit report will remain as it is, a repossession as per the terms of his sales and finance contract with us

I am rejecting this response because: Car Lotta Credit in formed me no matter what type of Car , Truck , or Van that they were to provide me , I would have to pay the same monthly payment of $ Car Lotta Credit already had me approved for a *** *** Van which , was for sale at the time of my approval , and after Car Lotta Credit had already had spoke to my landlord verifying all information about my residence I was refused multiple times , for my request to have my monthly payment to be closer to $ per month It 's not my fault that Car Lotta Credit , is telling me in only lived at my current address for only days , even after speaking to my landlord Car Lotta Credit time after time has messed up all my personal information I even offered to being in all my rent receipts and utility bill to prove my residency of *** *** *** *** * *** Pa .

The car was not "returned" to us, it was a repossessionAs part of this process all the information was sent to you by mail at that time.You may want to call our customer service center for a full explanation.Someone called in for information recently on your account, but we can only relay

I apologize for the inconvenience of driving down to see us.We are able to approve everyone who comes in to see usOrdinarily, we do not ask too many questions on the phone when scheduling an appointment as the most complete information both about us and athe customer comes form a face to face
meeting.I spite of this, I would like to send you a *** gas card to help repay you for the gas spent to visit us.Hopefully, in the future, you will consider us again

We can easily lower someones payment with additional money down or on a less expensive vehicle.However, not everyone is approved to purchase a vehicleAs I said, all information has to be verified to our satisfaction before we will loan someone money.We regret not being able to approve the customer as he would have likedWe do not expect to sell every customer, and apply no pressure to purchase from us whatsoever.If someone is not approved by us, or is not approved as they would like, they are welcome to try another dealer

Our credit approvals are based on the credit worthiness of each individual customer, which includes a large variety of factors.Variations in credit worthiness will cause differences in down payment required.In addition, we cannot give a definitive approval until we have all the information
and it is correctly verified.I
understand your frustration, however, we do not expect to sell every
customer and realize that some will not qualify for a vehicle or payment
that they would prefer.In that case, if they feel they can receive a better deal, they are free to pursue a purchase elsewhere.At no time do we force or apply pressure of any type for someone to purchase from us.We do our best to try to approve as many customers as we canMost are approved.We hope they do purchase from us, but that decision is ultimately the customers

First of all, I’d like to apologize as we did have
problems with this vehicle that were very difficult to resolveI deeply regret
any inconvenience to the customer
First, the oil smell and smoke was from a leak we already
fixed and there was a small amount of residual on the exhaust systemWhen we
cleaned the area we also tightened the timing chain cover (twice) and we
accidently put a small crack in the crack while doing itWe replaced the cover
entirely to cure the problem
Second, the air conditioning turned out to be a
malfunctioning compressor…which seemed to be working intermittentlyWe changed
the compressor and recharged the unitIt works well
We did pay for the towing bill and put the customer in a
rental car at no charge while we were repairing the vehicle, and did not charge
a deductible as the warranty calls for.
We did these things as we are / were trying to make good on our vehicle
The other issues were resolved.
All of our vehicles are run thru a point checklist and are
driven a minimum of miles by different techniciansIn spite of this, we
can and sometimes do miss itemsWe do make every effort to repair any problem
issues BEFORE the customer takes deliveryIt does us no good to put out a car
that has issuesWhen we do have problems, we do our best to repair them and
get the customer on the road quickly
I do not believe we were given enough time repair the
vehicle (at no charge to them), especially as they were in a rental at no
chargeFor that reason, I cannot refund their down payment on a returned
vehicle

Audrey and I called today. I gave Brian premission to talk to her. (You can check with him). In a previous response you said that you had my physical file. When we called today Brian told Audrey that it wouod have to be pulled from storage. I am still requesting a copy of everything included in my file, especially the bill of sale from when the car was sold at "auction".

The same women keeps calling us. We cannot and will not release any information to her. When she does call she is very rude and abusive, in spite of the fact our calls can be recorded as our incoming phone message clearly states.
We have yet to be able to speak with the customer.
We have all the information we need, IF the customer will phone and ask for Brian in customer service... we can then verify his identity with some questions.
Quite frankly, its starting to sound like a scam or ID theft issue. Due to that issue we will not mail any documents until we can verify and speak with the customer.

I am rejecting this response because:
Car-Lotta
makes some interesting claims.
"Minor
service issue"? When initially purchased, the [redacted] required repair. The
work was performed by a local automobile repair shop because Car-Lotta claimed
that the work was "not covered".
The vehicle
was returned to Car-Lotta on a [redacted] trailer. It was not repossessed.
Being
required to spend almost $500 to return the vehicle was no minor cost. The [redacted]
had entered shut-down mode 200 miles from home on a Friday evening. The nearest
Kia dealer was 40 miles away. To travel those 40 miles would have required
about 4 hours (at 10 mph) on a busy highway. To drive the [redacted] back to Car-Lotta
would have required 20 hours (at 10 mph). The decision to rent a trailer was
reasonable and, considering the state of the vehicle, prudent.
Making
adjustment "to keep a customer happy" is not what Car-Lotta is known
for. For example, in order to drive the vehicle safely, I needed to replace all
four tires. Car-Lotta was unwilling to replace the tires, even to make the
vehicle safe to drive.
Car-Lotta is
an overly aggressive and over bearing organization. Their motive is profit. I
can accept that. But when profit interferes with safety, then profit must take
a back seat.
I have
another comment to make but I require a copy of the original contract. All
paperwork was left in the glove compartment when the vehicle was returned.

I am rejecting this response because:
 
Car-Lotta
suggests that it is "too late" to make adjustments and that they were
not given "the chance" to make repairs. I am not asking Car-Lotta to
make any kind of adjustment or any kind of repair. I am asking Car-Lotta to
tell the truth.
To repeat,
the vehicle was a lemon. It was unreliable. It required a significant
investment on my part just to get it running safely. Car-Lotta refused to make
repairs claiming that the vehicle was no longer their responsibility. As a
result of Car-Lotta's refusal to make safety repairs, I returned the vehicle to
their lot. That is not repossession.
Regarding
the PA Lemon Law, yes that law only applies to the purchase of new vehicles.
But, the Magnusson Moss Warranty Act does not require the car to be purchased
new. Used cars are covered under the Act. The Act is a Federal law with a large
number of Pennsylvania lawyers willing to go after companies like Car-Lotta. As
I said before, I didn't want to pursue Car-Lotta legally. I thought they were
an honest and reputable firm. I appear to have been wrong.
Car-Lotta
threatens their customers with a "bad credit report". I want Car-Lotta
to remove the derogatory report from my credit report.
I would
also like a copy of the contract.
