See attached documentI appreciate the Revdex.com taking the time to research complaint ID# [redacted] Mr [redacted] claims that he was charged for services that were never rendered, that he did not authorize a charge of $195, did not sign a contract and, did not use services of our business.All four claims are incorrect.Our business is an employment agency specializing in nanny placements [redacted] was looking to hire a nanny and was referred to our business by someone he was currently doing business with and who was a colleague of mineI spoke to [redacted] by phone and then he submitted his application and contact to hire a nanny[redacted] completed the Application to Hire A Nanny online, on our website www ***.com, on April 13, I have attached the application, marked Exhibit AThe first pages of Exhibit A is the Application that [redacted] completedThe 4th page is a screen shot of the actual Application on our websiteI have highlighted (in orange) where [redacted] needed to check "I have read and agreed to the PermanentPlacement Service Contract terms and conditions, understand and agree to accept them" before beingable to submit the ApplicationPermanent Placement Service Contract is a link to our ContractPage is this ContractAgain, I have highlighted the APPLICATION FEE clause which explains that we have a non-refundable Application Fee of $to execute the Agreement.Upon receipt of the Application I contacted [redacted] to confirm receipt of the Application and ContractWe spoke by phone [redacted] gave me his credit card number over the phone, at that timeExhibit B is my email follto that conversation.On April 19th I sent an email to [redacted] to refer a candidate to himThis is marked Exhibit C[redacted] responded on April 19th saying that he didn't think the candidate fit his needs and asked to see a copy of the job description I was circulating to nannies on my rosterI marked this email Exhibit D.On April 20th I replied to [redacted] **'s request (showing him how his ad read) and also providing more information about the candidate referred since Ithought he might reconsider and meet with her [redacted] responded saying he wanted to pass on the candidate but that our "ad reads well." This is Exhibit EThe following week I was on vacationI was in a similar time zone and had wifi so I was still checking emails and working I was in correspondence with a candidate on April who wanted to apply for the [redacted] position but I told her she didn't fit their parametersThis is Exhibit E2.On May emailed [redacted] with a resume for a 2"d candidateThis is marked Exhibit F.I did not hear from [redacted] **I emailed him again on May 4th to see if he was going to contact the candidateThis js Exhibit G[redacted] did not return my email inquiryI did not hear from him again.In summary: [redacted] submitted an Application to Hire a Nanny, checked that he read our contract, provided his credit card number and then worked with our business for days before ceasing contact with our businessI heard (via grapevine) that he hired a nannyThus, he did not need our services any longer.Payment of our non-refundable $application fee is done to contract our best efforts toward referring candidates to the clientIt also provides lifetime membership with our long term and temporary placement services so that if [redacted] wants to submit an entirely new Application to Hire A Nanny at any time in the future - or multiple times - he can do so [redacted] can also utilize our on-call, temporary nanny service at any time in the futureHis $payment gives him lifetime membership to Care Givers Placement Agency.We preformed our work as agreedSince our service was contracted by [redacted] and services were rendered, we will not refund his fee

I am rejecting this response because:1. There was no signed contract.2. Charging a credit card without a signed agreement/contract is fraud.I expect a refund of $as soon as possible or otherwise I will have no choice but to pursue this matter with the Oregon Dept of Justice - Consumer Fraud Protection

The 4th page is a screen shot of the actual Application on our website. I have highlighted (in orange) where [redacted] needed to check "I have read and agreed to the PermanentPlacement Service Contract terms and conditions, understand and agree to accept them" before beingable to submit the Application. Permanent Placement Service Contract is a link to our Contract. Page 5 is this Contract. Again, I have highlighted the APPLICATION FEE clause which explains that we have a non-refundable Application  Fee of $195.00 to execute the Agreement.Upon receipt of the Application I contacted [redacted] to confirm receipt of the Application and Contract. I emailed him again on May 4th to see if he was going to contact the candidate. This js Exhibit G.[redacted] did not return my email inquiry. I did not hear from him again.In summary: [redacted] submitted an Application to Hire a Nanny, checked that he read our contract, provided his credit card number and then worked with our business for 22 days before ceasing contact with our business. I heard (via grapevine) that he hired a nanny. Thus, he did not need our services any longer.Payment of our non-refundable $195.00 application fee is done to contract our best efforts toward referring candidates to the client. It also provides lifetime membership with our long term and temporary placement services so that if [redacted] wants to submit an entirely new Application to Hire A Nanny at any time in the future - or multiple times - he can do so. [redacted] can also utilize our on-call, temporary nanny service at any time in the future. His $195 payment gives him lifetime membership to Care Givers Placement Agency.We preformed our work as agreed. Since our service was contracted by [redacted] and services were rendered, we will not refund his fee.
