Complaint: [redacted] I am rejecting this response because: [redacted] and Caribbean Blue Pools and Spas have made many statements in their response to my Revdex.com complaint.? They have also given fraudulent claims to the [redacted] County Sheriff Department regarding their theft investigation.? ? His statements can easily be proven in [redacted] County Court.? ? He has offered to sell me the pool at his "wholesale" cost of $8700.00? but when I asked him to provide proof of his purchase price, he could provide nothing to me.? The wholesale cost on this pool is most likely under $5000.00.? This also can easily be proven in a court of law.The only offer I will accept from [redacted] at this time is a full refund of our $deposit.? I am prepared to take full legal action to recover my money from this dishonest and unprofessional company.? At this point, [redacted] 's actions are not a misunderstanding or a scheduling problem.? I am rejecting this complaintThere have been no statements made to anyoneThe customer contacted the [redacted] County Sheriffs office with incorrect information regarding the signed contract he entered into with Caribbean Blue PoolsI pulled his file, pulled all documentation of the attempts made to schedule this customer, all notations were made each time all attempts were made to complete this contractI am not interested in continuing to argue over this matterThe Customer came into our establishment and was disrespectful and obnoxious in front of customers and employees and those witness statements are on handWe had to call the local police department to have him leaveEven after this incident, [redacted] answered calls and was willing to be more than generous in trying to get this customer taken care ofThe customer, [redacted] ***, wanted "options" to complete his contractHe was given those and told us he would then decide which route he wanted to goOur company does not have to allow him to break this signed contract, but decided to try and make him happyIt is quite obvious that is not his interestWe will not relinquish our price list at any pointWe are a retail company and allowing him to break his contract and continue to behave in the manner he chooses to, has caused us to be out money for the ordered product and timeWe have retained our lawyer for this matter and she is now handling this situationAny further issues and responses will be handled in legal actionAll offers or verbal discussions are now void, and the complainant will be notified by our attorneyThank you, [redacted]

I will write up a service ticket with their name address and phone number and our service tech will call next week to schedule a time to come out and fix the one leaking fittingI will waive the $charge this one time and fix it for free even though the warranty is outCustomers do not get to choose when their warranties start and stopSincerely, [redacted]

Complaint: [redacted] I am rejecting this response for several reasons:My original request was for [redacted] to refund our $deposit due to no communication and failure to install the pool in a reasonable amount of time.? He refused to refund our money.After I informed him that we would have to sue him to recover our monies, he did offer to sell us the pool at his "wholesale cost" meaning "what he paid for it".? We agreed to consider this option[redacted] told me I could buy the pool kit for $8700.? He informed us that this was what he paid for it from his wholesaler.I did my research with other established pool companies that sell similar pools and they determined that wholesale price on this pool was several thousand less than $8700.I asked [redacted] to provide me with proof of value before I bought the pool, and even offered to pay more than wholesale as a fair trade.? He said he'd get back to me, but never has.It has become clear to me that [redacted] has inflated his cost on the pool, and therefore unable to get me an accurate proof of purchase cost for the poolUnless there is valid proof of value, I will not pay $for a pool kit that may be worth only 5-6k.? ? As no work has commenced, and no materials have been exchanged even though we signed a contract months ago, we are still requesting a full refund of our $depositPlain and simpleThis should be much less hassle for all parties than going through the expensive and time consuming court process where we are sure to recover the full amount including court fees Thank you, [redacted] ***?

On 6/30/ [redacted] signed a pool contract and paid 50% (56000) for a 33ftround above ground poolOn his contract it explicitly states that we are currently on #and he is #on the install boardIt also explicitly states in dark black bold print above where he signed, "PLEASE UNDERSTAND If BAD WEATHER OCCURS, IT ALSO HAS AN AFFECT ON THE POOLS BEING INSTALLED BEFORE YOURS WHICH WILL MEAN YOUR DATE WILL BE PUSHED OUT!!!" We have had a lot of rain this past year and then we had Hurricane Harvey come through and it rained for six days straightOn 9/21/at 8: A.Mwe contacted [redacted] to let him know we were ready to dig his pool Monday morning 9/25/that we were finally catching up from all the rain [redacted] told us that he was going out of town and would call us in October when he returned and to go on to the next poolWe told [redacted] that would be fine to let us know when he got back and we would get him back in the rotation [redacted] then called the office in the middle of October and said he still wasn't ready and would let us knowWe informed [redacted] that we have to keep our guys working and we are finishing up on an in-ground pool and will be starting two other in-ground pools which take twice as long to build than an above ground poolHe said he understands and would let us know [redacted] then stop by the office on December 1, and we showed him the install board that he was next after we finish the current customer's in-ground pool that we started in October and we hoped to start the weekend of the 10th of December weather permitting an it ended up raining and were not able to finish the current customer's pool which meant we could not dig and start [redacted] ***'s poolWe document every time it rains on our calendar and make detailed notes on each customer's folder of phone calls and what was talked aboutWe have tried contacting [redacted] in December and January and we left messages to call the officeWe have not heard from [redacted] until he mailed us a letter stating he wanted his money backThe pool kit was ordered the first week of July after the three day right of rescission was overWe have tried several times to contact the customer so that his pool can be delivered and installedOur company would like to complete the pool installation and are prepared to do so pending the customer contact our office to discuss the installation dateOur goal is to complete the project and to ensure the customer is satisfiedDue to a signed contract, a partial payment made and the pool kit being purchased and stored, the customer will need to contact our store during regular business hours and we will work diligently to get this project scheduled and completedSincerely, [redacted]

I am rejecting this response because:We did contract *** *** *** to build our pool on July 25, with their Sales Manager, *** *** By accepting and cashing our checks per our contract timeline, shows *** *** *** assumed the contract We were repeatedly told by *** that *** *** *** took over the contract The contract states that final payment is due at completion and final payment was made on May 28, Given that, my request for the plumbing issue was within *** *** *** days!Per a conversation between ***, *** and myself, *** *** *** bought *** *** *** and did not pick and choose specific contracts, but took over all the accounts from *** *** ***.After various communications in August, we finally got a response on August 30, that there have been delays in starting the process “due to rain and as soon as it dries up will be hard at it again playing catch up” On September 26, we requested an update since we were told digging would start on the previous Friday or current MondayThe response was “the trac hoe guy was almost done with the commercial job he is doing He’s suppose to let Rory know a time frame when he can do it tomorrow afternoon”During this time frame of “hold ups” *** *** *** informed us that *** *** *** had closed and *** had taken over as *** *** *** In November digging finally began and check #for $was given to *** *** *** in accordance with the contract per *** *** and was cashed by *** *** *** From September thru the end of November we were given the runaround about delaysFirst it was the rain, which we understood but there were many excuses regarding insurance and transportation We repeatedly had to ask for a status I finally stated that communication is the key to customer happiness and finally started receiving some communication without begging for it.On December 7, we received a status of “The guys got the rest of the sand back filled yesterday and all the plumbing done” “Next will be back filling around the pool and doing the electrical Then we can form it up and do the rebar and have it ready to do the concrete deck.We are letting it dry so we can do the rest of the dirt work It’s just to wet right now”On December 14,we were asked for the “pre-deck payment” so we can do the concreteOn December 21, the concrete was finally poured On December 22, our fence was finally put back up On December 30, the guys were out to fix the fence, the sprinkler head, the low spot in the concrete and digging for the electrical line.On January 10, the (1st attempt) at texturing was done.On January 17, we were told the pool was not complete due to rain and they still had to put all the correct chemicals in and they need straight clear days to be able to vacuum.On January 22, we informed you the pool was losing water and there was still a low spot in the concrete and bucket marks in the deck *** responded he would have that taken care of.On January 26, *** responded with the leak was fixedIt was a cracked coupling in the electrical conduitHe said he was sending someone to do the final vacuum and set up pool school and collect the final payment Pool school was scheduled for February 6, 2017.On February 4, someone came put the hose in the pool and left The hose was not secure and sprayed more water at the spicket than in the pool He also left the gate open and the dogs got out *** said the leak was fixed but they never filled it back up We told *** the pool is still losing water and there were other issues There were sticky residue on the walls of the pool, cool spray was on the walls, and windows Also, the grounding strap wasn’t even connected The Columns had damage from when they painted On February 8, *** said the sticky residue was removed, the columns painted white, the light was fixed, and paint has been ordered to redo the entire deck.On February 18, There were still issuesThe spray paint of the deck and been re-done with different colors of paint in various spots and the pool was still leaking!Pictures were given to *** to show the various areas of different shaded cool sprayOn February 20, Pool school was scheduled We received a text from *** stating Jory called in sick and will do the pool school another day.On March 8, we send *** a text stating we haven’t heard any thing for weeksWe were told that *** (concrete contractor) was out weeks and would let *** know when he could come down.On April 7, we asked to have Pool School on the 10th We were told if it is not raining they could do it On the 10th @ 9:11am we asked what time they would be there The response was *** was calling them because they had to button down a couple of pools before the storm hits in ***When they got there they said the tail on the polaris wasn’t working correctly.On April 26, we were told that *** would be there on Friday to prep and do the concrete on Saturday *** said the final payment can be mailed to *** after he completed the deck.On May 28, we finally gave up on getting any kind of quality work and made the final payment of $made out to ***.We do have two homes but in June my husband has been staying at the house in Huntington permanently We do perform a backwash on the pool weekly! I can also show you the video we made of the whole “pool school” we were given and he never stated to backwash once a week! Also, during the contract phase with ***, we specifically asked about anything we needed to add or do as we were only there every two weeks and were told we would be fine We ended up paying someone to come explain how to operate the system correctly!I believe the fittings gave out due to poor workmanship! There was poor workmanship in every phase of this pool; construction, plumbing, electrical, concrete There was trash left everywhere, broken sprinkler heads, stolen hoses, improper replacement of fence We were given free chemicals and extras but the free chemicals were used when your service men would come and the extras are because they were never given in the first place or destroyed during the process.We were treated with no respect and feel we were put on the back burner since at the time we were not there daily Even though you accepted the contract by accepting our money we were constantly being told we were making you lose money The lack of communication does not make for a happy customerPeople do not become rude and hateful without given a reason.I posted a picture of our conversation on the *** *** facebook page and someone obviously thought it was not in thier favor, since it was removed and blocked me from the pageProof of the above accounts can be given if needed with text messages between *** and us.

I have a copy of that contract between them and “*** *** *** * ***”That being said and in regards to the current complaint the ***’s have filedTammy *** called our office saying she had a small leak at the pump and could we fix the leakI told her I would send our service guy by her house to diagnose the problem and would let her knowOn August 23, I sent the service guy first thing that morning to look and diagnose the leakI didn’t charge her for the service call which is $dollars per hourShe then texted me asking what the status was on the leak on August 23, I let her know that we did go look and it would be $to fix the leakShe then started texting me asking, “you don’t warranty your plumbing for a year?” and they didn’t take delivery of the pool till May of I responded and let her know by text that the pool was plumbed in and up and running over six months ago and it doesn’t matter when the last payment was madeI give a ninety day warranty on plumbing as a CURTISY your pool contract which is with “*** *** *** * ***” and not us DOES NOT GIVE YOU ANY WARRANTY ON PLUMBING WHAT SO EVER!!! The ***’s have two homesOne in *** this is where the pool is located and their other home in *** ***,TxThat is where Len *** works and they are at the home in *** *** the majority of the timeWe give all customers a onetime pool school at completion to show them how to operate their equipment on their poolWe ended up showing them three different times how to operate and take care of their equipmentThe reason the plumbing fitting has a slow leak is due to them not backwashing the sand filter once a week for approximately two minutesYou have to do this once a week and if you do not the pump builds up an extreme amount of pressure that’s why there is a pressure gauge on the equipment to show how high the pressure is gettingNot doing so the fittings are going to give out do to the customer’s negligenceThat is what has happened in this caseWe have gone above and beyond for these customer’s giving them free chemicals and extras for their pool after we where done with the pool and instead of them being appreciative and thanking us for building them a beautiful pool after “*** *** ***” took their money and closed and they had nothing to show for the $22,they had given “*** *** ***” they have been extremely rude and hateful throughout the entire processIN CLOSING: They have a small leak at the pump do to them not backwashing when they should and the pressure building up to highWe did not charge our standard $an hour service charge to go diagnose the problem They don’t want to pay the $to fix the leakThe price would have been $for two service calls, and the time and labor to pay my service guy to fix the leakI was giving them a discount at the $Thank you for your help in this matter? On July 25, 2016 [redacted] sign a contract with “[redacted]” and gave that company a check in the amount of $22,198.50 which was 50% of the total price of the pool totaling $44,397.00. That company ([redacted]) took the [redacted]’s money and then that...

business closed in September of 2016. [redacted] is now under over fifteen indictments for theft. The [redacted]’s contacted us [redacted] to build their pool. We started construction on November 16, 2016 and completed the pool at the beginning of March 2017. The [redacted]’s paid [redacted] a total of $22,198.50 for a fully completed pool in which we did. The [redacted]’s DO NOT have a contract with us “[redacted]” we are a new pool company and just opened on October 3, 2016. They have a contract with “[redacted]” witch took their money and provided nothing!! I have a copy of that contract between them and “[redacted]”. That being said and in regards to the current complaint the [redacted]’s have filed. Tammy [redacted] called our office saying she had a small leak at the pump and could we fix the leak. I told her I would send our service guy by her house to diagnose the problem and would let her know. On August 23, 2016 I sent the service guy first thing that morning to look and diagnose the leak. I didn’t charge her for the service call which is $85 dollars per hour. She then texted me asking what the status was on the leak on August 23, 2016. I let her know that we did go look and it would be $91.00 to fix the leak. She then started texting me asking, “you don’t warranty your plumbing for a year?” and they didn’t take delivery of the pool till May of 2016. I responded and let her know by text that the pool was plumbed in and up and running over six months ago and it doesn’t matter when the last payment was made. I give a ninety day warranty on plumbing as a CURTISY your pool contract which is with “[redacted]” and not us DOES NOT GIVE YOU ANY WARRANTY ON PLUMBING WHAT SO EVER!!! He said he was sending someone to do the final vacuum and set up pool school and collect the final payment.  Pool school was scheduled for February 6, 2017.On February 4, 2017 someone came put the hose in the pool and left.  The hose was not secure and sprayed more water at the spicket than in the pool.  He also left the gate open and the dogs got out.  [redacted] said the leak was fixed but they never filled it back up.  We told [redacted] the pool is still losing water and there were other issues.  There were sticky residue on the walls of the pool, cool spray was on the walls, and windows.  Also, the grounding strap wasn’t even connected.  The Columns had damage from when they painted.  On February 8, 2017 [redacted] said the sticky residue was removed, the columns painted white, the light was fixed, and paint has been ordered to redo the entire deck.On February 18, 2017 There were still issues. The spray paint of the deck and been re-done with 2 different colors of paint in various spots and the pool was still leaking!. Pictures were given to [redacted] to show the various areas of different shaded cool spray. On February 20, 2017 Pool school was scheduled.  We received a text from [redacted] stating Jory called in sick and will do the pool school another day.On March 8, 2017 we send [redacted] a text stating we haven’t heard any thing for 2 weeks. We were told that [redacted] (concrete contractor) was out 2 weeks and would let [redacted] know when he could come down.On April 7, 2017 we asked to have Pool School on the 10th.  We were told if it is not raining they could do it.  On the 10th @ 9:11am we asked what time they would be there.  The response was [redacted] was calling them because they had to button down a couple of pools before the storm hits in [redacted]. When they got there they said the tail on the polaris wasn’t working correctly.On April 26, 2017 we were told that [redacted] would be there on Friday to prep and do the concrete on Saturday.  [redacted] said the final payment can be mailed to [redacted] after he completed the deck.On May 28, 2017 we finally gave up on getting any kind of quality work and made the final payment of $2219.85 made out to [redacted].We do have two homes but in June my husband has been staying at the house in Huntington permanently.  We do perform a backwash on the pool weekly!  I can also show you the video we made of the whole “pool school” we were given and he never stated to backwash once a week!  Also, during the contract phase with [redacted], we specifically asked about anything we needed to add or do as we were only there every two weeks and were told we would be fine.  We ended up paying someone to come explain how to operate the system correctly!I believe the fittings gave out due to poor workmanship! There was poor workmanship in every phase of this pool; construction, plumbing, electrical, concrete.  There was trash left everywhere, broken sprinkler heads, stolen hoses, improper replacement of fence.  We were given free chemicals and extras but the free chemicals were used when your service men would come and the extras are because they were never given in the first place or destroyed during the process.We were treated with no respect and feel we were put on the back burner since at the time we were not there daily.  Even though you accepted the contract by accepting our money we were constantly being told we were making you lose money.  The lack of communication does not make for a happy customer. People do not become rude and hateful without given a reason.I posted a picture of our conversation on the [redacted] facebook page and someone obviously thought it was not in thier favor, since it was removed and blocked me from the page. Proof of the above accounts can be given if needed with text messages between [redacted] and us.

I will write up a service ticket with their name address and phone number and our service tech will call next week to schedule a time to come out and fix the one leaking fitting. I will waive the $91 charge this one time and fix it for free even though the warranty is out. Customers do not get to choose when their warranties start and stop. Sincerely, [redacted]
