To date, the church has paid 66% of the contract amount, not 80% as stated by the complaint. One bill for reimbursable expenses was paid 11 months late. Another bill was paid 70 days late. A third bill has been partially paid. The partial payment was made late. The balance for that bill remains...

unpaid 10 months later. No late fees have been assessed.There have been delays in completing the project, some our fault, some due to slow responses from others involved in the job. Most notably, the steel building company that the church selected took over one year to get completed steel drawings to us. I could not make progress on the foundation plans without their completed work.Site plan approval has been held up by changes in the location of the water service,changes in the nature of the design, and many unexpected requirements from the City water agencies and building department. The church had planned on reusing the existing water service. Approval, however, required designing a completely new service. This, additional work, was not anticipated when the contract was quoted to the church. The Rochester Water Bureau and Pure Waters have asked for more information and required more details on the plans than we have ever experienced inpast site plan reviews. This extensive and additional communication with the City water and sewer agencies has added review and drafting time.I have been working with Rochester Water Bureau for 8 months to determine the best location for the water service, not the sewer system. Only a few details are missing that they requested recently. The sprinkler system design is almost complete.The [redacted] and I went to a meeting with the building bureau on January 8. I have been working to resolve the issues since then. The construction plans are 99%complete.We understand that the church is frustrated and upset that the project isn't completely done yet. We are too. We apologize for the breakdown in communication and the delays on our end. We continue to work hard on this job,making progress each day. ·We look forward to working with this client as the planning phase draws to a close and the building construction begins.Steven [redacted], P.E.
