RE: [redacted] vPaul Luciano Builders, Inc.Dear Ms [redacted] :MrPaul Luciano has been in the home-building/construction business for over years and therefore takes very seriously any complaints about his company's workmanshipWe therefore felt obliged to respond to Mr [redacted] 's complaint and firmly believe that his claims and requests are totally unreasonable.The work that Mr [redacted] complains about occurred more than eight years agoEvery attempt to satisfy or appease Mr [redacted] by Paul Luciano Builders, Inc., has been unsuccessful because of Mr [redacted] 's unreasonable expectations and demands.I would like to quote from the premier standard for home builders, that being the National Association of Home Builders "Residential Construction Performance Guidelines." I am enclosing herewith a copy of those standards dealing with Tile, Brick, Marble, and Stone flooringSee, Section -4-2, which states:Observation: Cracks are observed in the tile grout or at thejuncture with other materials such as a bathtub.Performance Guideline: Cracks in grouting of tile jointscommonly result from shrinkage conditionsCracksresult in loose tiles or gaps in excess of 1/16lh of an inch areconsidered excessive(Emphasis added.)Corrective Measure: One time only during the warranty period,the contractor will repair grout to meet the performance guidelines(Emphasis in original.) The contractor is not responsible for color variations or discontinued colored groutThe consumer is responsible for re-grouting these joints alter the contractor's one time repair.As Mr [redacted] admits in his Customer Statement of the Problem, the home was built over eight years ago and that MrLuciano's company has re-grouted the floor on a number of occasions, i.e., more than the one occasion set forth in the above industry standard.Most importantly, however, are photographs of the alleged defective workmanship of Paul Luciano Builders, IncWe are including six numbered photographs taken last summer to demonstrate the rather petty nature of Mr [redacted] ’s complaintsIn particular, please note on Photograph the hair that is placed next to the shrinkage crackThe hair is more visible and wider than the shrinkage gapThe undersigned has come to the conclusion that Mr [redacted] has decided that the new trend in flooring (i.e., hardwood floors) is what he now desires and wishes our client to produce hardwood floors—not only hardwood floors in the area where the alleged unreasonable cracking appears (i.e., the "small hallway"), but also in the foyer and kitchen.Mr [redacted] 's unreasonable position now requires our office to become involved in this matterWe appreciate the Revdex.com's position in accepting all complaints, whether or not they have any reasonable basis, but in this case the photographic evidence and the applicable standards make it very clear that Paul Luciano Builders, Inc., has performed beyond any reasonable or acceptable housing standard and they are unwilling to provide Mr [redacted] new hardwood floors as requestedIf we can be of any further assistance to the Revdex.com, please feel free to contact the undersigned.Very truly yours,MARSH SPAEDER BAUR SPAEDER & SCHAAF, LLPBy Michael [redacted] A [redacted]

reference to complaint ID ***, the shingles and ridge cap were repaired and hopefully repaired correctly.although the ice and water shield was not brought up to code my builder assures me I should not have any issues with this.hopefully this documentation will assure this

Robert ***I will except Mr Luciano's original offer in the email sent by him 5/6/The only reason I ever said anything about hardwoods was because the Luciano's told me that may be the only remedy the cracking of the groutThese pictures shown were taken months after the repairThe pictures were just to show that the cracking had already appeared again.
