Mr*** moved his tool box according to the terms of our *** of lading, the contract to which we move freightThose terms are consistent with the Carmack Amendment, which is federal transportation lawThe *** of lading clearly states that used freight will move at a released value of $.10/lb
up to a total limit of liability of $USDCarlile reviewed the claim and paid the claim accordinglyUnder the terms of the *** of lading, to which he agreed to both implicitly through his tender of freight and explicitly through his signature on the *** of lading, was made wholeTo this end, Carlile has taken the position that since he was made whole the matter is closed

I am rejecting this response because: my problem is not with shipping. It's with the loading damage. I feel The fork lift driver doesn't take on any responsibilitie for what they load. As if they don't care about any damages that might occur to someone else's property. The damage to my tool box is not from shipping it's from loading  that's  something that can be control by the fork lift driver. They should take the time to treat it like it's their own and don't want it damaged. Basically take responsibility for what they do. I am looking for replacement of the tool due to their irresponsibility of the fork lift drivers under your employment. When another shipping company damaged my tool box just like you did fork lift damage  Carlile had no problem having them replace the tool box  but that your the cause of the damage. Carlile throws out .10 cents a pound now. Instead of just replacing the tool box that is now only worth a third of its value from your fork lift drivers negligence under your employment.If I treated someone's property like you did I would have to pay for it. This is not fair at all. Negligence, irresponsibility and carelessness on Carlile's care.
