Initial Business Response / [redacted] (1000, 5, 2015/07/27) */ Contact Name and Title: Carmen & Sons Concrete Contact Phone: XXX-XXX-XXXX Contact Email: [redacted] @yahoo.com We are more then happy to come out and fix and solve [redacted] situation ***, here estimator has came out and looked at here job and seen what needs to be doneWe can defiantly help her out with here cement work On the back of here contract on paragraph F, it states, " Costs of repairs expressed through our warranty are subject to a 20% charge of original total cost of the job." We are sorry for the misconfusion and interoperationWe have to follow the rules of our contract, and there are no refunds as stated on our contracts as well We will try and get this resolved within next month Thank You Initial Consumer Rebuttal / [redacted] (3000, 7, 2015/08/04) */ (The consumer indicated he/she DID NOT accept the response from the business.) In regards to the response from Carmen and Sons to my complaint, there was never any "confusion" or "misinterpretation"There was, however, MISREPRESENTATION on the company's behalf! To my knowledge, [redacted] nor anyone else from this company have ever been to my house to inspect the job since it's completion over a year ago! They have never returned any of my phone calls or attempted to communicate with me in any wayOnly during the 5th and final phone call that I made to them, did they tell me to inspect my contract because material is NOT covered under warranty! This is NOT what [redacted] told me when he sold me the jobHe specifically told me the entire job was covered for a year but "it will look like new for at least years"Only when the product failed, is when they fell back on the fine print of the contract! I understand I signed the contract and should have read it in its entirety, but because of the poor product quality, the outright lies by the company representatives, and awful customer service, I think the company should honor what was verbally told to me by the salesman and replace the product at NO CHARGE! If the failure of the product was the result of the product itself, then they should hold the manufacturer responsible, and if it's an installation issue, then they should be responsibleNone of the responsibility should be put on the customer who paid for a product in good faith that failed in less than a year!! By putting in their contract that the customer is responsible for 20% of the cost of the job for repairs, tells me that failure of the product is a common occurrenceAs I previously stated, the manufacturer should then be held accountable for the cost of repair, NOT the customer

I just spoke to you (James [redacted] ) on the phone 1:p.mon 10/4/16, I believe there was a miscommunication with our staffI'm sorry for the misleading previous phone calls, we will be out to perform the work that we agreed upon (9/1/16) for repair and recap the front porch with steps and sides plus the top coat of sealerThis will be completely around the time frame of 10/17/-- 10/21/(depending on the weather), its half a day of work to be finalizedBy this time of the month, the bees will be less of an influence and not a problem Hopefully we can both agree on these terms, and have this case be discontinued and still be clients for future projectsIf you have any questions or wish to talk to us please call our office; [redacted] Thank you

Complaint: I am rejecting this response because:once the job is done with warrantie or money is returned I will be satisfied and I willagree I feel this way there will be less chance of confusion in the future Sincerely, James [redacted]

As a family owned company we treat our clients with the best care and patience, we still want to perform the work that was contracted with our estimator and MrJames *** on 9/1/Due to the bee nest he has by his house, we can not perform the work that we agreed uponOur crew (workers) are
highly allergic to bees, and we are responsible for all our workers health. If Mr*** wishes to remove the bee nest, we are more then happy to comply with the work that is supposed to be done, ( repair and resurface and seal his front porch)We are a professional company, and understand both sides on which what happened that day, we still wish and legally obligated to perform his work as written on both of our contract. On the back of Mr*** contract on paragraph (J.), any cancellation or determination of a obliqued contract and to return a deposit has to be within business daysMr*** had to send us a written reason as of why he's canceling or stopping the contract as well as his pink version of the contractIn which done of the steps were completed. We understand, its not his fault for the bee nest, at the same time we have to make sure our workers are in best safety working environmentIf Mr*** can please remove the bees, we are more then happy to comply with the work. Thank You
